  • The Supreme Court Ruling on June 27, 2018 held that requiring non-members to pay "fair-share dues" or "agency fees" is unconstitutional on First Ammendment grounds.
  • As of Spring 2018, all full-time SMC faculty are members of the Santa Monica College Faculty Association (SMCFA) and this ruling has no effect on them.
  • As of Spring 2018, 93% of part-time SMC faculty are members of the SMCFA and this ruling has no effect on them.
  • The 7% of part-time SMC faculty who have either not submitted a membership form or who actively elected to not become members of SMCFA will no longer have to pay fair-share dues to the SMCFA.
  • The Santa Monica College Human Resources department is coordinating with the SMC Payroll Department to ensure that no union dues are deducted from non-member pay checks. As of this moment, SMC Faculty Association does not have an estimate from the district on when they will be able to implement this stop on non-member dues payment.
  • Any non-member dues remitted to the SMCFA by the district in error will be refunded to the non-members expeditiously.
