# Smart Noter AI Voice Notes — Privacy Policy

## 1. Introduction
Smart Noter AI Voice Notes ("App") is developed and operated by JanoGroup LLC ("we," "us," or "our"). This Privacy Policy explains what information we collect, how we use it, who we share it with, and what controls you have.
By downloading, installing, or using the App, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the App.
You must be at least 13 years old to use the App, or at least 16 years old if you are located in the European Economic Area (EEA). If you are under the age of majority in your jurisdiction, your parent or legal guardian must review and agree to this Policy on your behalf.
## 2. Information We Collect
### 2.1 Information You Provide
- **No Account Required.** You can use Smart Noter AI Voice Notes without creating an account or providing any personally identifiable information (PII) such as your name, email address, or phone number.
- **Support Communications.** If you contact us by email, we receive your contact details and message solely to respond and provide support.
### 2.2 Audio Recordings and Notes
- **Local Storage.** All voice recordings, text notes, transcriptions, translations, and summaries you create are stored locally on your device. We do not access or transmit these to our own servers.
- **App Preferences.** Basic settings (theme, language selection, subscription state) are stored locally on your device.
### 2.3 Data Sent to Third-Party AI Services (OpenAI)
**The App uses OpenAI's API to provide AI-powered features. Before any data is sent to OpenAI, the App will inform you what will be shared and ask for your confirmation.**

**What OpenAI does with your data:** OpenAI processes the submitted content to return a result (transcription, summary, or translation) and does not retain your data for training by default under its API data usage policies. For details, see OpenAI's Privacy Policy at https://openai.com/privacy.
**Your audio and text data are not stored on JanoGroup LLC's servers.** We transmit them directly to OpenAI and receive only the processed result back.
**Third-Party Data Protection:** OpenAI, LLC maintains data protection practices and security measures consistent with or exceeding industry standards. Their data handling practices are governed by their Privacy Policy and applicable data protection laws.
### 2.4 On-Device Transcription (Apple Speech)
When you use on-device transcription, audio is processed using Apple's on-device Speech Recognition framework. No audio data leaves your device for this feature.
### 2.5 Advertising (Google AdMob)
The App displays banner advertisements through Google AdMob. AdMob may collect device identifiers (such as the Apple Advertising Identifier / IDFA), IP address, and usage signals for ad serving and measurement. This data collection is governed by Google's Privacy Policy at https://policies.google.com/privacy. You can control ad personalization through your device settings (Settings > Privacy & Security > Tracking on iOS).
### 2.6 Platform Diagnostics
Apple may collect crash logs or technical diagnostics according to their own privacy policies and your device settings. We do not control this data collection.
## 3. How We Use Information
We use information only as necessary to:
- Enable voice recording, transcription, translation, and summarization features.
- Send relevant content to OpenAI's API to fulfill AI feature requests you initiate.
- Display advertisements through Google AdMob.
- Manage subscription status, usage limits, and feature access.
- Respond to support requests.
- Maintain app functionality and comply with legal obligations.
## 4. How We Share Information
We do not sell, rent, or trade your personal data.
We share data only as follows:

## 5. User Consent for AI Data Sharing
Before the App sends any of your audio recordings or note content to OpenAI, the App:
1. Displays what data will be sent (audio file or text content).
2. Identifies who the data is sent to (OpenAI, LLC).
3. Requires your explicit confirmation before proceeding.
You may decline the AI feature at any time. All core note-taking, local recording, and on-device transcription functions remain available without sending any data to OpenAI.
## 6. Data Storage and Retention
- **Local Storage Only.** All recordings, notes, transcriptions, translations, summaries, and preferences remain on your device.
- **No JanoGroup Servers.** We do not store or retain your recordings or note content on our own servers.
- **OpenAI Processing.** OpenAI does not retain API-submitted content for training by default. See OpenAI's Privacy Policy for current retention details.
- **Your Controls.** You can delete individual notes, clear app data, or uninstall the App at any time to remove all locally stored information.
## 7. Data Security
We rely on your device's secure operating system environment and industry-standard encryption for local data storage. Connections to OpenAI's API are made over HTTPS/TLS. We encourage you to keep your device locked and protected with a passcode or biometric authentication.
## 8. Children's Privacy
The App is not directed to children under 13 (or under 16 in the EEA). We do not knowingly collect personal information from minors. If you believe a minor has used the App and sent data to a third-party AI service, please contact us at janogroupllc@gmail.com.
## 9. Your Rights and Choices
- **AI Feature Opt-Out.** You may choose not to use any AI-powered feature. No audio or text will be sent to OpenAI unless you explicitly activate an AI feature.
- **Device Permissions.** You can manage microphone and speech recognition permissions at any time through your iOS system settings.
- **Ad Personalization.** You can limit ad tracking through Settings > Privacy & Security > Tracking on iOS.
- **Data Deletion.** Delete individual notes, clear app data, or uninstall the App to remove all locally saved data. For data held by OpenAI or Google, refer to their respective privacy policies.
- **EEA/UK/California Rights.** If you are located in the EEA, UK, or California, you may have additional rights (access, rectification, erasure, portability, objection). Contact us at janogroupllc@gmail.com to exercise these rights.
## 10. International Data Transfers
When you use AI features, your data is transmitted to OpenAI's servers, which are located in the United States. When you view ads, Google AdMob may process data in the United States or other regions. By using the App, you acknowledge these international transfers.
## 11. Subscriptions and Billing
Subscription billing, renewals, cancellations, and refunds are handled by Apple via the App Store. We receive only non-identifiable confirmation of your subscription status. We do not receive or store payment card information.
## 12. No Warranties; AI Accuracy Disclaimer
AI-generated transcriptions, summaries, and translations are provided for convenience and may contain errors. Do not rely on them for legal, medical, financial, or other professional purposes without independent verification.
## 13. Changes to This Privacy Policy
We may update this Privacy Policy periodically. Material changes will be communicated through an in-app notice or by updating the "Last Updated" date above. Your continued use of the App after changes become effective constitutes acceptance of the revised Policy.
