These Terms of Use ("Terms") set out the conditions for using "Sky Share" (the "App"), an iPhone app provided by an individual developer Kanta Hori (the "Developer"). By using the App, you agree to these Terms. The Japanese version is the official text; this English version is a translation.
Once a day, the App sends a notification. You take a photo of the sky and swap it, one for one, with someone somewhere in the world.
There are no features for exchanging names or messages with your swap partner. Your swap partner is chosen automatically by the App's server.
Users who swap friend codes and follow each other can show each other the pair of skies they swapped that day (their own sky and their swap partner's sky) for 24 hours and send ❤️ ("Friends"). Your friends see a name you choose yourself and, if you set one, an icon (a photo you choose).
The App is for people aged 13 and over. If you are under 13, you may not use the App.
If you are under 18, please get permission from a parent or guardian before using the App.
You may only send photos of the sky that you took yourself with the App's camera.
Make sure your photos do not show faces, information that identifies someone (such as names, addresses or licence plates), or anything that infringes the rights of others (such as copyright, image rights or privacy).
The App has zero tolerance for objectionable content or abusive behavior. The following are prohibited:
Sending sexual, violent or gory content, content that promotes discrimination or hatred, or content showing illegal acts
Sending other people's personal information or anything that identifies another person
Trying to identify your swap partner or to contact them outside the App
Using a friend name or icon that impersonates someone else or contains offensive, discriminatory or sexual words or images
Unauthorized access to the App or its servers, automated use, mass registration, or anything that disrupts the service
Anything else that breaks the law or public order, or that the Developer considers inappropriate
You keep the rights to the photos you take.
By sending a photo, you grant, free of charge, permission for your swap partner to view it in the App and, if your swap partner uses Friends, for their friends to view it in the App for 24 hours as one half of the pair. Your name and icon are never shown with that photo.
By showing your sky with Friends, you grant your friends, free of charge, permission to view it in the App.
The Developer handles photos only to deliver swaps, review inappropriate content, and run the App safely, and never uses them for other purposes such as advertising or sale.
If you receive an inappropriate photo, or a friend shows an inappropriate sky, you can report it in the App. You will not be matched with that person again, and you will no longer be friends. The Developer reviews reports and aims to act within 24 hours.
You can remove or block a friend at any time. They will not be told.
If the Developer decides that these Terms have been broken, the Developer may remove photos or suspend use of the App without notice.
The notification time changes every day, and delivery is not guaranteed. Sometimes no partner can be found and a swap will not take place.
The App is free to use. You are responsible for any data charges.
A sky you receive is deleted from your iPhone once you open and close it, and cannot be viewed again.
You can delete your data on the server and on your iPhone with "Delete all data" in Settings.
The Developer does not guarantee that the App is free of defects or fit for a particular purpose, nor does the Developer guarantee the content of photos sent by other users.
Except in cases of intent or gross negligence, the Developer is not liable for damages arising from use of the App.
The Developer may change the App or these Terms, or stop providing the App. If these Terms change, you will be notified in the App.
These Terms are governed by the laws of Japan. The court with jurisdiction over the Developer's place of residence has exclusive jurisdiction in the first instance over any dispute about the App.
