TERMS OF SERVICE

These are my standard terms of service for a model purchase. Minor details may vary for individual sales.
Please read these carefully before going ahead with a purchase. 

Inquiries 

If you are interested in a design I have available, please inquire via the contact form or get in touch via twitter (@sionidae). 

Finished Models - Ready-to-purchase models are sold as-is. I will not make major design or detail changes, with the exception of minor edits to facilitate easier production (like printing, mold making, or pouring), for free.
I may be willing to offer variations of a model, or additional designs based on the original (for example: a packer version of an insertable, a penetrable version of a grinder design, etc.) for additional payment. Please contact me for a quote if this is something you'd like to discuss.

Works In Progress - I often post works-in-progreess (WIPs) on twitter. Most can be enquired about and reserved, with the consideration that they do not represent the final model and may go through multiple iterations and changes before completion. If you reserve a WIP design, I may contact you to discuss any major changes to the design before they are finalized, but minor changes can be made at my discretion.
Currently, I am only accepting reserves for WIPs from shops I have worked with before or from shops that are well established in the scene.

I will only sell my designs to established shops and makers. I am also happy to sell to startups and up-and-coming makers on the condition that I will request information to ensure that your business will be viable. This may include information about your business plan, expected timeline, experience with 3D printing/Mold Making/Silicone, etc. If the information provided isn't satisfactory, I may refuse sale until a further date or upon better evidence of said information.

Please note that toy sales are not necessarily made on a "first come, first served" basis. If multiple parties inquire about one design I may choose the shop I think the model would fit best rather than the first to send a message.

I reserve the right to refuse sale to any person or business at my discretion. I will not associate with or sell designs to makers or shops that have a history of poor customer service, bad quality control, affiliations with AI generated content or cryptocurrencies/NFTs, nor to those with a history of racism, antisemitism, homophobia, transphobia, or otherwise immoral or discriminatory behavior.

Holds

I am willing to hold a design for a maximum of 2 weeks if requested. While a design is on hold, I will turn away any other interested parties during this time. If no purchase is made, the design will be made publicly available again.

 
I may refuse to hold future designs for an inquirer if they repeatedly request holds and do not follow through with a purchase. 

Purchase

Once a purchase is agreed upon by both parties, payment will be made via a PayPal Invoice. I request that payment is prompt, preferably within 48 hours, or I reserve the right to cancel the sale and make the model avaiable for purchase again. 

Once payment is confirmed, I will require the following information: 

• An email I can send the file to;

• Your preferred file type (OBJ, STL, etc.);

• How you would like the purchase to be announced - if you would like to be mentioned or remain anonymous until production is complete, which twitter account I should tag in the announcement, what website link to use, etc.

Once purchased, designs cannot be “returned” or refunded. Refunds will only be made in the event of failure on my part to deliver the model file to you in your preferred format. 

Price

The price of a model is determined by its complexity, the time it took to create, my own skill and artistic creativity, and includes the rights to distribute the commercial product. 

Model prices are listed on site and are the default price without any negotation. This also includes a copy of the toy once it is in production.
I am open to offers lower than the listed price, depending on the situation. If a lower price is offered, I may request additional payment in the form of a second copy of the toy, or other toys/products available from the buyer.

I am open to increasing prices (in the form of monetary value or of physical items) in exchange for significantly altering my terms of service - such as to provide the buyer with complete editing rights, the right to keep or pass on the model at their own discretion, etc. Feel free to contact me with inquiries about editing my Terms of Service.

I ask that whatever physical items I receive as payment are made to my preference (in size, firmness, and colour), though I do not request full custom items by default. Physical items must be able to be shipped to the UK.

Ownership and Copyright

If you purchase a model from me, you and your shop have exclusive rights to produce and sell commercial products based on that model. I will not redistribute the model to any other individual so long as it is being used by you and your shop. 

You may make minor edits to the model in order to facilitate easier production, but I request that if you plan to make any major changes that you get in touch first.
I may also be able to make minor changes for you, depending on the nature of the edits. Please inquire about this before purchasing.

The model may not be resold by you, and may not be redistributed without permission, unless previously agreed upon otherwise. 

If you encounter a situation where the model will no longer be in production - whether you are retiring the design or closing shop, for example - I reqeust that you make all effort to contact me to discuss what will happen to the design, and where ownership will be transferred in that event. 

Name, Concept, and Character 

When you purchase a model design from me, you have the right to alter the name, concept, and any character that may be associated with it. In the case that a design has an associated character, when you purchase the model you will also receive the rights to the character, though you are not obliged to retain it. 

Credit

I request that I am credited as creator of the model in the description of the model page or catalogue on your website, either by linking to my twitter (@sionidae) or with a link to my website. I would also appreciate being credited as the sculptor when the model is announced for the first time on social media, although this isn't necessary.
