The figure below is adopted from the guidelines issued by DepEd CALABARZON as per Regional Memorandum No. 217, s. 2021. It shall serve as guide of the schools on how to proceed when a complaint or report on incident of bullying or other forms or any violation of the rules and regulations of the school is filed. This also includes complaints for acts committed by pupils or students outside the school premises when the pupils or students are engaged in activities authorized by the school.
Under Section 8 Article 2 of the said RO guidelines, the SH/P shall have authority, accountability, and responsibility for creating an environment within the school that is conducive to both teaching and learning.
After reporting the incident of bullying or violation of the rules and regulations of the school or any of the offenses mentioned in the guidelines to the RO through its email address, the RGC/Guidance Teacher/Coordinator/Advocate shall conduct Fact-Finding and Documentation and immediate intervention. The CPC shall monitor the implementation of the intervention program. The fact-finding to be conducted is limited to gathering of information for purposes of determining the needed intervention.
At the same time, the SH/P shall create a Committee on Student Discipline to determine the seriousness or gravity of the offense and whether the bully or learner-offender has violated the rules and regulations of the school or committed any of the offenses mentioned in the guidelines.
Note:
The procedure shall be observed when face-to-face instruction is being implemented as a mode of learning delivery and face-to-face meeting or conference is applicable and allowed under normal conditions.
The above stated procedure is also applicable when distance learning is the mode of learning delivery adopted in schools which may take place when a state of national emergency is declared by the authorities.
However, further modification is made to ensure that the procedure remains relevant and applicable to the current situation where online learning and modular instruction are the modes of learning delivery implemented in the Division. Hence, if face-to-face meeting or conference is not allowed by existing law, order, or regulation, the procedure in Figure 1 shall be conducted through the use, in succession, of the following mediums.
All prescribed health and safety protocols are to be strictly followed in the conduct of the meeting or conference. The meeting or conference may be recorded through electronic means provided that all the parties are informed of such recording and said recording shall be for official use only in relation to the disciplinary proceedings involved in the complaint.
The said procedure shall be applicable if the offense committed by the learner during distance learning delivery is directed against his or her classmate, schoolmate, teachers, non-teaching staff of the school or other personnel of the school or division, if the offense is related to a school related activity or those committed while in actual online class or those acts which may fall within the offenses described in this Manual. Commission of acts tending to cause damage to the image and reputation of the school as an educational institution may also subject the learner to appropriate disciplinary action.
