1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the SHADOW mobile application (the “App”), operated by Kello Solutions (“Company,” “we,” “our,” or “us”).

By downloading, accessing, or using SHADOW, you agree to be bound by these Terms. If you do not agree, you must not use the App.

2. Description of Service

SHADOW provides AI-powered real-time communication analysis and coaching features, including:

• Filler word detection
• Confidence analysis
• Clarity feedback
• Session scoring
• Performance tracking

SHADOW is intended for professional development and personal improvement purposes only.

The App does not provide medical, psychological, therapeutic, or legal advice.

3. Eligibility

You must be at least 16 years old to use SHADOW.

By using the App, you represent that:

• You are legally capable of entering into binding agreements.
• You comply with all applicable laws in your jurisdiction.

4. User Responsibilities

You agree:

• To use the App only for lawful purposes.
• Not to misuse microphone access.
• Not to attempt to reverse engineer or exploit the App.
• Not to interfere with the App’s functionality or security.

You are responsible for obtaining consent from others if you use SHADOW during conversations where recording or monitoring laws apply in your jurisdiction.

Kello Solutions is not responsible for how you use the App during meetings or conversations.

5. Microphone & Audio Processing

When enabled, SHADOW accesses your device microphone during active sessions for real-time analysis.

Audio:

• Is processed temporarily
• Is transmitted securely
• Is not permanently stored by Kello Solutions

AI analysis may be provided through third-party services (including the Gemini API). Audio data is processed solely to generate feedback and is not retained by us as raw recordings.

You are responsible for ensuring your use of microphone-based features complies with local laws regarding consent and recording.

6. Accounts

To access certain features, you may need to create an account.

You agree to:

• Provide accurate information
• Keep your login credentials secure
• Notify us of unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Subscriptions & Payments

Some features may require a paid subscription.

By purchasing a subscription:

• You agree to the pricing displayed at purchase
• Payments may auto-renew unless canceled
• You may cancel according to App Store or Google Play policies

Refunds are handled according to the platform’s payment provider policies.

We reserve the right to modify subscription pricing with reasonable notice.

8. Intellectual Property

All content, branding, technology, algorithms, and design within SHADOW are owned by Kello Solutions.

You may not:

• Copy
• Modify
• Distribute
• Reverse engineer
• Reproduce

Any part of the App without written permission.

All rights not expressly granted are reserved.

9. Disclaimer of Warranties

SHADOW is provided “as is” and “as available.”

We do not guarantee:

• Continuous, uninterrupted service
• Error-free performance
• Perfect AI accuracy
• That feedback will result in specific outcomes

AI-generated insights are automated assessments and may not always be accurate.

Use of the App is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Kello Solutions shall not be liable for:

• Indirect or consequential damages
• Loss of profits
• Business interruption
• Data loss
• Misuse of microphone functionality

11. Termination

We may suspend or terminate access if:

• You violate these Terms
• You misuse the App
• Required by law

You may stop using SHADOW at any time.

12. Privacy

Your use of SHADOW is also governed by our Privacy Policy.

Please review the Privacy Policy for details about data processing and AI usage.

13. Changes to Terms

We may update these Terms periodically.

Continued use of the App after updates constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of Latvia.

Any disputes shall be resolved in the courts of that jurisdiction.
