Sellzy – Online Secondhand Marketplace

Welcome to Sellzy! Before using the Sellzy application (“App,” “Service”), please read these Terms carefully. By accessing or using the App, you (“User,” “you”) agree to be bound by these Terms. If you do not agree, please stop using the App immediately.

1. General Information

Sellzy is a platform that facilitates the posting of secondhand items for sale and purchase. Sellzy does not participate directly in transactions between buyers and sellers.

2. Registration and User Accounts

• Users must be at least 18 years old or have parental consent (if under 18).

• Users must provide accurate and up-to-date information and must not impersonate another person.

• Users are responsible for maintaining the security of their passwords and for all activity under their accounts.
  
  

3. Usage Conditions 

Users agree not to:

• Sell illegal items, counterfeit goods, or items that violate any laws or regulations.

• Post false, misleading, pornographic, obscene, violent, hateful, racist, discriminatory, or otherwise harmful content.

• Engage in harassment, threats, bullying, abusive language, hate speech, or any behavior that disrupts the community.

• Use automated systems such as bots or scrapers to access or use the App.

• Sellzy has a strict “No Tolerance” policy for objectionable content or abusive behavior. If inappropriate content, avatars, usernames, or behavior is detected, Sellzy may immediately suspend or terminate the user’s account without prior notice.
  
  

4. User Responsibilities

• Sellers are directly responsible for the accuracy and quality of the items they list.

• Buyers should carefully review item details and verify seller credibility before completing transactions.

• Sellzy is not responsible for damages arising from transactions between users.
  
  

5. Fees

• Sellzy may charge usage or transaction fees in the future and will provide reasonable prior notice.

• Payments processed through third-party services (e.g., payment gateways) are subject to those providers’ terms and conditions.

6. User-Posted Content

• Users retain ownership of the content they post (e.g., photos, text) but grant Sellzy a license to display or promote it within the App.

• Sellzy reserves the right to remove any inappropriate or infringing content without prior notice.
  
  

7. Account Suspension or Termination

Sellzy may suspend or terminate accounts immediately if users violate these Terms, engage in harmful behavior, or otherwise disrupt the platform or community.

8. Legal Liability

Sellzy shall not be held liable for:

• Damages arising from transactions between users.

• Financial losses or personal data breaches caused by user actions

• Technical issues, errors, or temporary service interruptions.

9. Privacy Protection

The collection and processing of your data are governed by Sellzy’s Privacy Policy, which forms part of these Terms.

10. Changes to the Terms

Sellzy may modify these Terms at any time, with notice provided through the App or other appropriate channels. Continued use of the App after updates indicates your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Thailand. Any disputes shall be submitted to the competent courts of Thailand.

ยินดีต้อนรับสู่ Sellzy! ก่อนใชงานแอปพลิเคชัน Sellzy ("แอป", "บริการ") กรุณาอ่านเงื่อนไขฉบับนี้อย่างละเอียด การเข้าใช้งานแอป ถือว่าคุณ ("ผู้ใช้งาน", "คุณ") ยอมรับและตกลงที่จะปฏิบัติตามข้อตกลงฉบับนี้ หากคุณไม่ยินยอม กรุณาหยุดใช้งานทันที

1. ข้อมูลทั่วไป

Sellzy เป็นแพลตฟอร์มกลางสำหรับผู้ใช้งานในการลงประกาศซื้อ-ขายสินค้ามือสอง โดยไม่ได้มีส่วนร่วมในธุรกรรมระหว่างผู้ซื้อและผู้ขายโดยตรง

2. การลงทะเบียนและบัญชีผู้ใช้งาน

• ผู้ใช้งานต้องมีอายุไม่ต่ำกว่า 18 ปี หรือได้รับความยินยอมจากผู้ปกครอง (ในกรณีที่อายุต่ำกว่า)

• ผู้ใช้งานต้องให้ข้อมูลที่ถูกต้อง เป็นปัจจุบัน และไม่แอบอ้างบุคคลอื่น

• ผู้ใช้งานต้องรับผิดชอบต่อการดูแลรักษารหัสผ่านและการใช้งานบัญชีของตนเอง

3. เงื่อนไขในการใช้งาน

ผู้ใช้งานตกลงที่จะไม่:

• ขายสินค้าผิดกฎหมาย ละเมิดลิขสิทธิ์ หรือสินค้าที่ฝ่าฝืนข้อบังคับใด ๆ

• โพสต์เนื้อหาที่เป็นเท็จ หลอกลวง ลามก อนาจาร ความรุนแรง ความเกลียดชัง เหยียดเชื้อชาติ ศาสนา เพศ หรือเนื้อหาใด ๆ ที่เป็นอันตรายต่อบุคคลหรือสังคม

• กระทำการล่วงละเมิด ข่มขู่ คุกคาม หรือใช้ภาษาที่หยาบคาย ดูหมิ่น หรือก่อให้เกิดความขัดแย้งในชุมชน

• ใช้ระบบอัตโนมัติ เช่น bots หรือ scrapers ในการใช้งานแอป

• Sellzy มีนโยบาย "ไม่อดทน" ต่อเนื้อหาและพฤติกรรมที่ไม่เหมาะสม หากตรวจพบเนื้อหา อวตาร ชื่อบัญชี หรือพฤติกรรมที่ไม่เหมาะสม บัญชีผู้ใช้งานอาจถูกระงับหรือลบออกทันทีโดยไม่ต้องแจ้งล่วงหน้า

4. ความรับผิดชอบของผู้ใช้งาน

• ผู้ขายเป็นผู้รับผิดชอบโดยตรงต่อความถูกต้องของข้อมูลสินค้าและคุณภาพของสินค้า

• ผู้ซื้อควรตรวจสอบข้อมูลสินค้าและผู้ขายให้รอบคอบก่อนทำธุรกรรม

• Sellzy ไม่รับผิดชอบต่อความเสียหายที่เกิดจากการซื้อขายโดยตรงระหว่างผู้ใช้งาน

5. ค่าธรรมเนียม

• Sellzy อาจเรียกเก็บค่าธรรมเนียมการใช้งานหรือค่าธรรมเนียมธุรกรรมในอนาคต โดยจะแจ้งล่วงหน้าอย่างเหมาะสม

• การชำระเงินผ่านบริการของบุคคลที่สาม เช่น ผู้ให้บริการชำระเงิน อยู่ภายใต้ข้อกำหนดของผู้ให้บริการนั้น

6. เนื้อหาที่ผู้ใช้งานโพสต์

• ผู้ใช้งานยังคงเป็นเจ้าของเนื้อหาที่โพสต์ (รูปภาพ ข้อความ ฯลฯ) แต่ตกลงให้ Sellzy ใช้เพื่อการแสดงผลหรือส่งเสริมภายในแอป

• Sellzy ขอสงวนสิทธิ์ในการลบเนื้อหาที่ไม่เหมาะสม ละเมิดสิทธิ์ผู้อื่น หรือฝ่าฝืนข้อกำหนด โดยไม่ต้องแจ้งล่วงหน้า

7. การระงับบัญชีหรือยกเลิกการใช้งาน

Sellzy อาจระงับ หรือลบบัญชีผู้ใช้งานทันที หากพบว่าผู้ใช้งานละเมิดข้อตกลงฉบับนี้ หรือกระทำการที่อาจส่งผลเสียต่อระบบ ผู้อื่น หรือขัดต่อกฎหมาย

8. ความรับผิดชอบตามกฎหมาย

Sellzy ไม่รับผิดชอบต่อ:

• ความเสียหายจากธุรกรรมระหว่างผู้ใช้งาน

• ความสูญเสียทางการเงินหรือข้อมูลส่วนบุคคลที่เกิดจากผู้ใช้งานเอง

• ความผิดพลาดทางเทคนิคหรือการหยุดให้บริการชั่วคราว

9. การปกป้องข้อมูลส่วนบุคคล

การเก็บรวบรวมและประมวลผลข้อมูลของคุณเป็นไปตาม นโยบายความเป็นส่วนตัวของ Sellzy ซึ่งเป็นส่วนหนึ่งของข้อตกลงนี้

10. การเปลี่ยนแปลงข้อตกลง

Sellzy อาจแก้ไขข้อตกลงนี้ได้ทุกเมื่อ โดยจะแจ้งให้คุณทราบล่วงหน้าผ่านแอปหรือช่องทางที่เหมาะสม การใช้งานต่อหลังการอัปเดต ถือว่าคุณยอมรับข้อตกลงที่แก้ไขแล้ว

11. กฎหมายที่ใช้บังคับ

ข้อตกลงนี้อยู่ภายใต้กฎหมายของประเทศไทย หากมีข้อพิพาท ให้ยื่นต่อศาลที่มีอำนาจในประเทศไทย
