Terms of Use
These Terms of Use (hereinafter referred to as the “Terms”) set forth the conditions for using the “SelfFocus” service (hereinafter referred to as the “Service”). All users of the Service (hereinafter referred to as “Users”) shall use the Service in accordance with these Terms.
Article 1 (Application)
These Terms apply to all relations between Users and the Service “SelfFocus” regarding the use of the Service.
In addition to these Terms, the Service may establish various rules and regulations (hereinafter referred to as “Individual Provisions”) for usage, etc. Regardless of their names, these Individual Provisions shall constitute part of these Terms.
In the event that any provision of these Terms conflicts with any provision of the Individual Provisions, the Individual Provisions shall prevail unless otherwise specified.
Article 2 (User Registration)
No registration is required for using the Service.
By agreeing to these Terms, Users can immediately begin using the Service.
Article 3 (Usage Fees and Payment Method)
The Service is provided free of charge in principle; however, some parts of the Service may be offered for a fee in the future.
In the event that there are paid portions of the Service, Users shall pay the usage fees separately determined and indicated on the Service’s website, using the method specified by the Service.
Article 4 (Prohibited Acts)
When using the Service, Users shall not engage in any of the following acts:
Acts that violate laws or public order and morals
Acts related to criminal activity
Infringement of intellectual property rights including copyrights or trademark rights related to the Service’s content, or any intellectual property rights contained in the Service
Acts that destroy or interfere with the functioning of the servers or networks of the Service, other Users, or third parties
Commercial use of information obtained through the Service
Any act that may interfere with the operation of the Service
Unauthorized access or attempts
Collecting or accumulating personal information, etc. of other Users
Using the Service with an unlawful or unauthorized purpose
Acts that cause disadvantage, damage, or discomfort to other Users or other third parties
Impersonating other Users
Advertising, marketing, soliciting, or conducting business activities on the Service without the Service’s permission
Acts aimed at meeting unfamiliar individuals of the opposite sex
Directly or indirectly providing profits to antisocial forces in connection with the Service
Any other acts deemed inappropriate by the Service
Article 5 (Suspension, etc. of Service Provision)
The Service may, without prior notice to Users, suspend or interrupt the provision of all or part of the Service if it determines that any of the following circumstances apply:
When performing maintenance or updating of the computer system related to the Service
When provision of the Service becomes difficult due to force majeure such as earthquakes, lightning strikes, fires, power outages, or natural disasters
When the computer or communication lines are stopped due to an accident
Other cases where the Service deems it difficult to provide the Service
Under no circumstances will the Service assume any liability for disadvantages or damages suffered by Users or third parties due to the suspension or interruption of the Service provision.
Article 6 (Usage Restrictions and Deregistration)
The Service may, without prior notice, restrict the use of all or part of the Service for a User if it determines any of the following applies:
If the User breaches any of the provisions of these Terms
If any false information is discovered in the registered information (if any)
If there is a default in the payment of fees or other obligations
If the Service receives no response from the User for a certain period of time
If the User does not use the Service for a certain period since the last use
If the Service otherwise deems the User’s use of the Service inappropriate
The Service shall bear no liability whatsoever for damages incurred by the User as a result of actions taken under this Article.
Article 7 (Disclaimer of Warranties and Limitation of Liability)
The Service does not warrant, either explicitly or implicitly, that the Service is free from factual or legal defects (including defects, errors, bugs, infringements of rights, issues regarding safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, or security). Except in cases of willful misconduct or gross negligence by the Service, it assumes no liability for any and all damages incurred by the User arising from or in connection with the Service.
However, if the contract between the User and the Service regarding the Service (including these Terms) constitutes a consumer contract as defined by the Consumer Contract Act, the above disclaimer does not apply.
The Service assumes no responsibility whatsoever for transactions, communications, or disputes arising between Users or between a User and any third party in connection with the Service.
Article 8 (Changes to Service Content)
The Service may, upon notice to Users given in advance, change, add, or discontinue the content of the Service, and Users agree to such changes.
Article 9 (Changes to These Terms)
The Service may change these Terms without obtaining the individual consent of Users in any of the following cases:
When the changes to these Terms are in the general interest of Users.
When the changes do not conflict with the purpose of the contract for use of the Service and are reasonable in light of the necessity of the changes, the appropriateness of the changed content, and other relevant circumstances.
When changing these Terms pursuant to the preceding paragraph, the Service shall notify Users in advance of the fact that these Terms will be changed, the content of the changed Terms, and the effective date of the change.
Article 10 (Handling of Personal Information)
The handling of personal information obtained through the use of the Service shall be managed appropriately in accordance with the Service’s Privacy Policy.
Article 11 (Notices and Communications)
Notices and communications between the User and the Service shall be carried out in the manner prescribed by the Service.
Unless the User provides a notification of change following a method separately specified by the Service, the Service will regard the currently registered contact information as valid and send notices or communications to such contact information. These notices or communications will be deemed to have reached the User at the time of dispatch.
Article 12 (Prohibition of Transfer of Rights and Obligations)
Users may not assign, transfer, provide as collateral, or otherwise dispose of their contractual status under the usage contract or any rights or obligations under these Terms to any third party without prior written consent from the Service.
Article 13 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan.
