🪧 Right to Honor Picket Lines & Sympathy Strikes
Although SEIU supports the demands and rights of other labor unions’ membership to strike, SEIU's contract language forbids the Union from being able to officially sanction and engage their membership in a "sympathy strike."Â
If individuals elect to exercise their individual right to honor a picket line, then they should see the highlighted language below; including notifying their immediate supervisor and reporting their absence in Frontline (leave without pay).
Below is the relevant language in our contract concerning this matter:Â
ARTICLE 38 - CONCERTED ACTIVITIES (OSEA) - It is agreed and understood that there shall be no strike, work stoppage, slow-down, on-site picketing, or refusal or failure to fully and faithfully perform job functions and responsibilities, or willful interference with the operations of the District by means of concerted activity by the union or by its officers, agents or members during the term of this Agreement, including compliance with the request of other labor organizations to engage in such activity. The District agrees not to lock-out unit members during the term of this Agreement.Â
FAQ’s
What is a sympathy strike?Â
An organized effort by one Union to support a strike organized by a different Union. Public sector Unions have the right to engage in a sympathy strike, a right that can only be waived if a Union's MOU contains a clause specifically preventing sympathy strikes.Â
Is there an individual right of employees to honor a picket line?Â
Yes. Public sector employees have an individual right to honor another Union's strike and not cross a picket line. Individual employees can still choose to honor another Union's picket line even if the Union's MOU contains a no-strike or no-sympathy strike clause. Employers cannot terminate public employees' employment or otherwise retaliate against them for choosing to honor another Union's picket line or their own Union's picket line that involves employees of a different bargaining unit.Â
Will I get paid if I join the strike?Â
No
What can I tell my Supervisor if I individually decide to participate in a sympathy strike and honor a picket line?
With sufficient notice, and each day you are participating, you can say,Â
“Today I will be exercising my individual right to engage in a sympathy strike, and therefore will not be coming into work today. Respectfully,”
