# Terms of Use — ScreenX Recorder

These Terms of Use ("Terms") are an agreement between you and **MD Developer
Studio** ("we", "us", "our") covering your use of the **ScreenX Recorder**
Android application, package `com.screenx.recorder` (the "App").
**By installing or using the App, you accept these Terms.** If you do not accept
them, do not install or use the App.

## 1. Who may use the App
You may use the App if you are at least 13 years old. If you are under 18, you
may use it only with the involvement of a parent or guardian, and you must not
make any purchase without their permission.
You must also comply with the Google Play Terms of Service, which apply to your
download of the App.

## 2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to
install and use the App on devices you own or control, for your own purposes
(including commercial content you create yourself).
You may not:
- copy, sell, rent, sub-license or redistribute the App;
- reverse-engineer, decompile or disassemble it, except to the limited extent
that applicable law expressly permits despite this restriction;
- remove, obscure or alter any notice of ownership in the App;
- circumvent, disable or interfere with any licensing check, advertising, or
premium entitlement mechanism;
- use the App to build a competing product, or use automated means to interact
with it at scale.
The App is licensed to you, not sold. We keep all rights we do not expressly
grant here.

## 3. Your content is yours
Everything you record, edit, export or stream with the App — your "Content" — is
and remains yours. We claim no ownership of it and no licence over it.
We do not receive your Content. It stays on your device unless you share it, save
it to your gallery, or stream it to a destination you chose. See our Privacy
Policy for detail.

## 4. Your responsibilities when recording
**This is the most important section of these Terms.** A screen recorder can very
easily be used to capture things you are not entitled to capture.
You are solely responsible for your Content and for how you obtained it. You
agree that you will not use the App to:
- record any person without whatever consent the law where you are requires —
laws on recording voices, faces and calls differ substantially between
countries and states, and some require every participant's consent;
- record or redistribute material you do not own or have permission to use,
including films, television, live sport, paid courses, e-books or subscription
streaming services;
- capture another person's private, confidential, financial, medical or personal
information;
- capture content in breach of another app's or service's own terms — many
services prohibit screen recording;
- create or distribute material that is unlawful, defamatory, harassing, hateful,
sexually exploitative, or that depicts or endangers minors;
- infringe anyone's intellectual property, privacy, publicity or contractual
rights;
- do anything unlawful in your jurisdiction.
You are responsible for obtaining any consent, licence or permission your
recording requires. We do not review, monitor, host or moderate your Content, and
we cannot do so — it never reaches us.

## 5. Live streaming to third-party services
The App can send your screen and audio to a third-party streaming service you
configure, such as YouTube, Twitch, Facebook or Kick.
- Your stream goes **directly from your device to that service**. It does not pass
through our systems.
- Your use of that service is governed by **that service's own terms and privacy
policy**, including its community rules and its rights to suspend or remove your
broadcast.
- You are responsible for keeping your stream key secret. Anyone holding it can
broadcast to your channel.
- We are not responsible for that service's availability, its behaviour, its
moderation decisions, or any loss of a stream caused by it or by your network.

## 6. The free version and advertising
The App is offered in a free, advertising-supported version and a paid premium
version.
By using the free version you agree that:
- the App will display advertising supplied by **Google AdMob**, including banner
ads on the Record and Library screens and occasional full-screen ads after a
recording is saved;
- advertising uses your device's advertising ID and related device information, as
described in **section 3 of our Privacy Policy**;
- you will not block, hide, spoof, automate, artificially click, or otherwise
interfere with the advertising in the App — doing so is a breach of these Terms
and may end your licence;
- advertising content comes from third parties. We do not select individual ads,
we do not endorse advertised products, and we are not responsible for what an
advertiser says, sells or does. Complaints about a specific ad should go to
Google.
Ads are never shown while a recording or live stream is running. Purchasing
premium removes all advertising.
Certain features are limited in the free version — including recording
resolution, frame rate, maximum recording length, and maximum GIF length. Those
limits are shown in the App and may change over time.

## 7. Premium, subscriptions and payment
Premium is available as a **monthly subscription**, a **yearly subscription**, or a
**one-time lifetime unlock**.
- **All purchases are processed by Google Play.** We never see your payment
details.
- **Subscriptions renew automatically** at the then-current price, charged to your
Google Play payment method, until you cancel. You can cancel at any time in
**Google Play → Subscriptions**; cancellation takes effect at the end of the
current billing period, and you keep premium until then.
- The **lifetime unlock** is a single payment for use of the premium features of
this App. "Lifetime" means the lifetime of the App and of your Google account's
entitlement to it — it is not a promise that the App will be published, or that
any specific feature will exist, forever.
- **Refunds are handled by Google Play**, under Google Play's refund policy and
any refund rights you have under your local consumer law. We cannot process
refunds ourselves.
- **Prices may change.** For a subscription, Google Play will notify you of a
price change and seek any consent the law requires before it takes effect.
- Premium is tied to the Google account that bought it. Use **Refresh** in
Settings to restore an entitlement on a new device.
We may add, change or discontinue premium features. If we remove a feature that
was a material part of what you paid for, we will tell you in the App.

## 8. Availability, updates and changes
We work to keep the App functional, but we do not promise uninterrupted or
error-free operation. In particular:
- screen recording, internal-audio capture, facecam and hardware encoding depend
on your device, its manufacturer's software and your Android version, and some
devices restrict or do not support them;
- Android or another app may interrupt or block a capture;
- a recording may be lost if your device runs out of storage, is switched off, or
the system stops the App.
We may release updates, change features, or stop supporting older Android
versions or older devices. We may suspend or discontinue the App entirely, with
notice where reasonably practicable.

## 9. No warranty
**The App is provided "as is" and "as available", without warranty of any kind.**
To the fullest extent permitted by law we disclaim all warranties, express or
implied, including any implied warranty of merchantability, fitness for a
particular purpose, accuracy, or non-infringement.
We do not warrant that the App will meet your requirements, that any specific
recording will succeed, that recordings will be free of defects or of any quality
in particular, or that captured files will never be lost or corrupted.
**Keep your own backups of anything you cannot afford to lose.**
Nothing in these Terms excludes or limits any right you have under mandatory
consumer-protection law that cannot lawfully be excluded.

## 10. Limitation of liability
To the fullest extent permitted by law:
- we are not liable for any indirect, incidental, special, consequential,
exemplary or punitive damages, or for lost profits, lost revenue, lost
goodwill, lost data or lost recordings, however caused;
- we are not liable for any claim arising from what you chose to record, or from
your sharing or streaming of it;
- our total liability to you for all claims relating to the App is limited to the
greater of (a) the amount you actually paid us for the App in the twelve months
before the claim arose, or (b) INR 1,000.
These limits apply even if we were advised of the possibility of the loss, and
even if a remedy fails of its essential purpose. They do not apply to liability
that cannot be limited under applicable law, including for death or personal
injury caused by negligence, or for fraud.

## 11. Indemnity
You agree to indemnify and hold us harmless from any claim, demand, loss,
liability, or reasonable legal cost brought by a third party and arising from:
- your Content, or your recording, sharing or streaming of it;
- your breach of these Terms; or
- your violation of any law or of anyone's rights.

## 12. Termination
You may stop using the App at any time by uninstalling it.
We may suspend or terminate your licence if you materially breach these Terms —
in particular sections 2, 4 or 6. On termination, the licence in section 2 ends
and you must stop using the App. Sections 9, 10, 11, 13 and 14 survive
termination.
Terminating your licence does not delete anything from your device; uninstalling
does.

## 13. Governing law and jurisdiction
These Terms are governed by the laws of **India**, without regard to its conflict
of laws rules.
Subject to any right you have under mandatory local consumer law to bring
proceedings where you live, you and we agree that the **courts at Surat, Gujarat,
India** have exclusive jurisdiction over any dispute arising out of or relating to
these Terms or the App.

## 14. General
- **Entire agreement.** These Terms, together with our Privacy Policy, are the
whole agreement between you and us about the App.
- **Severability.** If any provision is held unenforceable, the rest remains in
force and the unenforceable part is applied to the maximum extent permitted.
- **No waiver.** Our failure to enforce a provision is not a waiver of it.
- **Assignment.** You may not assign these Terms. We may assign them in
connection with a merger, acquisition or sale of assets.
- **Third parties.** Google is not a party to these Terms and has no obligation
under them.

## 15. Changes to these Terms
We may update these Terms. We will change the "Last updated" date above and, for
changes that materially affect your rights, tell you inside the App. If you keep
using the App after a change takes effect, you accept the updated Terms. If you do
not accept them, stop using the App and uninstall it.
