These Terms and Conditions (“Terms”) explain the rules and conditions for using the SantaWise mobile application (the “Service”). By downloading, accessing, or using SantaWise, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please discontinue use of the application.

1. General Information

Eligibility

SantaWise is intended for users who are 18 years of age or older. By using the Service, you confirm that you meet this requirement.

Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information, and forms part of these Terms. Please review it carefully before using the Service.

Nature of the Service

SantaWise offers a collection of probability-based mini-games designed purely for entertainment.
The games do not involve real-money gambling and do not guarantee any outcomes or rewards.

2. Ownership and Use of the Service

All content within SantaWise—including game mechanics, designs, visuals, Santa-themed elements, and software code—is owned by SantaWise or licensed to us.

You are granted a limited, personal, non-commercial, and revocable license to use the Service for your own entertainment. You may not copy, modify, distribute, or exploit any part of the Service without prior written permission.

3. Third-Party Services

SantaWise may interact with third-party platforms such as the Google Play Store, Apple App Store, or optional social services.

We do not control these third-party services and are not responsible for their content, policies, or practices. Your use of any third-party service is governed by their own terms and policies.

4. Suspension and Termination

We reserve the right to restrict, suspend, or terminate access to SantaWise at any time if we reasonably believe that:

• These Terms have been violated, or
  
  

• The Service is being misused, or
  
  

• Continued access may cause harm to the Service or other users
  
  

Upon termination, your right to use the Service will immediately end.

5. Disclaimer and Limitation of Liability

No Warranties

SantaWise is provided “as is” and “as available.”
We do not guarantee that the Service will always function without interruptions, errors, or technical issues.

Limitation of Liability

To the maximum extent permitted by law, SantaWise will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

If liability is established, our total responsibility shall not exceed:

• The amount you have paid through the Service, or
  
  

• USD 100, if no payment has been made.

6. Governing Law and Dispute Resolution

These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law principles.

If you have a dispute or concern, you agree to first contact us and attempt to resolve the issue informally before pursuing any legal action.

7. U.S. Legal Compliance

By using the Service, you confirm that:

• You are not located in a country subject to U.S. government sanctions or embargoes, and
  
  

• You are not listed on any U.S. government restricted or prohibited party lists.

8. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service or legal requirements.

If changes are significant, we will provide at least 30 days’ notice through the app or via email.
Continued use of SantaWise after the updated Terms take effect means you accept the revised version.
