1. The Council demises unto the Association ALL THAT piece of land situate off Cavendish Road, Carlton, Nottingham, (the Allotments) and TOGETHER with the existing Toilet Block and meeting room provided on the Allotments (the building) TO HOLD the same unto the Association for the term of twenty years from the 1st day of October 2001.
2. To keep every hedge and pathway that may form part of the individual Allotment Plots properly maintained cut and trimmed and all ditches properly cleaned and to use their best endeavours to protect any fences or gates that may be on the Allotments.
3. To permit the Council its officers servants and agents at all reasonable times to enter and examine the condition of the Allotments.
4. To use the Allotments for the purpose only of sub-letting to members of the Association as allotment gardens to be wholly or mainly cultivated by the member himself/herself for the production of flowers vegetable or fruit crops for consumption by the member or his/her family and such user to comply in all respects with the authorised objects of the Association.
5. At all times during the said term to provide that the allotments are kept clean and in a good state of cultivation and good condition.
6. To use or permit the use of the building provided on the Allotments only by Members of the Association and their guests in connection with the use of the Allotments as permitted by this Lease and not to make any alteration or addition to the said building except with the previous consent in writing of the Council.
7. To be responsible for the security and maintenance of the internal fabric of the building, the cost of all heat and light provided for the building and to keep the building in a clean and tidy condition at all times.
8. Not to cause or permit or suffer to be caused any nuisance or annoyance to the Council its other tenants or the occupiers of adjoining land.
9. Not to assign underlet or part with possession of the Allotment except for the purpose provided in Clause 4 above. Any such sub-letting to require the members to comply with the covenants contained herein.
10. Not to cut or to suffer to be cut any timber or other trees on the Allotments or upon any adjoining land belonging to the Council or to take soil or carry away any mineral gravel soil sand or clay from the Allotments without the consent of the Council.
11. Not to keep or permit or suffer to be kept any livestock on the Allotments or in any building erected thereon except to the extent permitted by Clause 12 of the Allotments Act 1950.
12. Not to use or permit or suffer the Allotments or any part thereof to be used for trade purposes (the sale by the Association of seeds compost and other related products to its Members for use in the cultivation of the Allotments excepted).
13. Not to sell or store or to permit or suffer any intoxicating liquors or other refreshments of any kind or any tobacco products to be sold or stored on the Allotments or in any building erected thereon.
14. Not to erect or to permit or suffer to be erected on the Allotments any greenhouse shed growing tunnel or other structure without prior approval of the Council. (Save for such structures complying with the Council’s rules or regulations in force for the time being in this respect as notified to the Trustees. The erection of any such structures by the members to be approved by the Trustees).
15. If required to do so by the Council to remove or cause to be removed at the expense of the members or in the case of a deceased member at the expense of his/her estate on the determination of this Lease all buildings and erections of every kind at any time built or erected by the member on the Allotments or any part thereof and to level and make good the sites of any buildings or erections which may have been so removed and to remove all rubbish to the satisfaction of the Council and the Committee.
16. To indemnify and keep indemnified the Council from and against all actions proceedings losses costs claims and demand arising by reason of the use of the Allotments for the purposes authorised by this Lease the Association to take out public liability insurance through the National Society of Allotment and Leisure Gardens in this respect to the value of not less than two million pound.
