RiffLogic LLC ("we," "our," or "us") operates the NixCloud mobile application ("the App"). This Privacy Policy explains how we collect, use, and protect your information when you use NixCloud.

By downloading or using NixCloud, you agree to this Privacy Policy. If you do not agree, do not use the App.

1. Information We Collect

Information Stored Locally on Your Device

The following data is stored exclusively on your device and is never transmitted to our servers:

• Puff and resist timestamps

• Daily check-in responses (mood, craving level, confidence, tags)

• Personal journal entries

• CBT program progress and exercise responses

• Health milestone progress

• Achievement unlock states

• App settings and preferences (theme, notification preferences)

• Quit plan data (device type, puffs per day, triggers, motivations, quit method)

• Your first name (entered during onboarding)

We do not have access to this data. It remains entirely under your control.

Anonymous Analytics (With Your Consent)

If you consent, we may collect anonymized usage data that cannot be linked to your identity or health information:

• Screen views and feature usage patterns

• App crash reports (device model, operating system version, error stack traces)

• Subscription status (for product improvement purposes only, not linked to health data)

• App performance metrics (load times, response times)

Information We Do NOT Collect

We want to be explicit about what we never collect:

• Your real name, email address, or contact information (unless you contact us directly)

• Your location data

• Your contacts, photos, calendar, or other device data

• Health data from Apple Health, Google Fit, or any other health platform

• Biometric data (fingerprint, face scan, voice)

• Financial information (all payment processing is handled by Apple or Google)

• Browsing history or data from other apps

• Advertising identifiers for the purpose of ad targeting

2. How We Use Information

Local data is used exclusively to power app features on your device: tracking visualizations, health timeline calculations, achievement evaluation, behavioral archetype detection, identity stage progression, and personalized content delivery. This processing happens entirely on your device.

Anonymous analytics, if collected, are used to:

• Identify and fix bugs and crashes

• Improve features based on aggregate usage patterns

• Optimize the onboarding and subscription experience

• Measure the effectiveness of cessation support features

We never use analytics data to identify individual users, build advertising profiles, or target content based on personal health information.

3. Third-Party Service Providers

We do not sell, rent, trade, or share your personal health data with any third party under any circumstances.

The following service providers may process anonymous, non-health-related data on our behalf:

• Sentry (sentry.io) — Crash reporting. Receives device model, OS version, and error stack traces to help us fix bugs. No health data is transmitted.

• PostHog (posthog.com) — Product analytics. Receives anonymous screen view and feature usage events. No health data is transmitted.

• RevenueCat (revenuecat.com) — Subscription management. Processes transaction data only to manage subscription status. Has no access to health data.

These providers are contractually bound to process data only as instructed by us, to maintain appropriate security measures, and to not use the data for their own purposes.

4. Data Retention

• Local data: Persists on your device until you delete it via "Reset All Data" in Settings, or until you uninstall the App.

• Anonymous analytics: Retained for a maximum of 12 months, then automatically deleted.

• Crash reports: Retained for 90 days, then automatically deleted.

• Subscription transaction records: Retained by Apple and Google per their respective policies. RiffLogic LLC does not store payment information.

5. Data Security

• All local data is stored using the device's native secure storage with device-level encryption.

• All network communications use HTTPS/TLS encryption.

• We follow the principle of minimal data collection — we only process what is strictly necessary for app functionality.

• We conduct regular security reviews of our codebase and third-party dependencies.

No method of electronic storage or transmission is 100% secure. While we implement commercially reasonable security measures, we cannot guarantee absolute security.

6. Your Rights and Choices

You have the right to:

• Delete all local data at any time via Settings → Reset All Data

• Disable anonymous analytics via Settings → Privacy

• Request deletion of any anonymous analytics data we hold by emailing rifflogic@gmail.com

• Export your data (available to Pro subscribers)

• Opt out of non-essential push notifications at any time via Settings → Notifications

• Cancel your subscription at any time through your device's subscription settings

For Users in the European Economic Area (EEA)

Under the General Data Protection Regulation (GDPR), you additionally have the right to:

• Access the personal data we hold about you

• Rectify inaccurate personal data

• Port your data to another service

• Object to processing of your personal data

• Lodge a complaint with your local supervisory authority

For California Residents

Under the California Consumer Privacy Act (CCPA), you have the right to:

• Know what personal information we collect and how it is used

• Request deletion of your personal information

7. Children's Privacy

NixCloud is designed for users aged 18 and older. The App's content rating is set to 17+ on the Apple App Store and 18+ on the Google Play Store.

We do not knowingly collect data from anyone under the age of 18. If we learn that we have inadvertently collected data from a user under 18, we will take immediate steps to delete that information.

8. International Data Transfers

NixCloud is operated by RiffLogic LLC from the United States. If you are accessing the App from outside the United States, please be aware that any anonymous analytics data may be transferred to and processed in the United States.

By using the App, you consent to this transfer. We comply with applicable data protection regulations, including the GDPR for EEA users and the CCPA for California residents.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you through the App or by other reasonable means prior to the change becoming effective. The "Last Updated" date at the top of this page will be revised.

Your continued use of NixCloud after the effective date of the revised Privacy Policy constitutes your acceptance of the changes.

These Terms of Service ("Terms") govern your use of the NixCloud mobile application ("the App") operated by RiffLogic LLC ("we," "our," or "us"). By downloading, installing, or using NixCloud, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

1. Description of Service

NixCloud is a vaping and nicotine cessation support application that provides puff and resist tracking, daily check-ins, a structured cognitive behavioral therapy (CBT) program, journaling, health recovery tracking, behavioral archetype analysis, identity progression tracking, and related features. The App is designed as a self-help tool to support your quit journey.

2. Medical Disclaimer

NixCloud is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment.

The health recovery timelines, neurological insights, behavioral archetype analysis, and cessation guidance provided in the App are based on published research but represent general population estimates. Individual results vary significantly based on duration and intensity of nicotine use, overall health, genetics, and other factors.

Always consult a qualified healthcare professional before making decisions about nicotine cessation, especially if you have pre-existing health conditions, are pregnant or breastfeeding, or are taking medication.

If you experience a medical emergency, contact emergency services immediately. In the United States, call 911. For mental health crises, contact the 988 Suicide & Crisis Lifeline by dialing 988.

3. Mental Health Disclaimer

The CBT-based exercises, thought records, and behavioral techniques in the App are for informational and self-help purposes only. They do not constitute therapy, counseling, or mental health treatment. They are not a substitute for professional psychological or psychiatric care.

If you are experiencing a mental health crisis, suicidal thoughts, or severe psychological distress, please contact a mental health professional, crisis hotline, or emergency services immediately.

4. Eligibility

NixCloud is intended for users aged 18 and older. By using the App, you represent and warrant that you are at least 18 years of age. If you are under 18, you may not use the App.

5. Subscriptions and Payments

NixCloud offers both free and premium ("Pro") features. NixCloud Pro is available through auto-renewing subscriptions (weekly, monthly, yearly) and a one-time lifetime purchase.

a) Payment is charged to your Apple ID or Google Play account at confirmation of purchase.

b) Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

c) Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

d) You can manage and cancel your subscription in your device settings:

• iOS: Settings → Apple ID → Subscriptions

• Android: Google Play Store → Subscriptions

e) Any unused portion of a free trial period will be forfeited when you purchase a subscription.

f) Refunds are handled by Apple or Google per their respective refund policies. RiffLogic LLC does not process refunds directly.

6. Free Trials

Certain subscription plans may include a free trial period. During the free trial, you have full access to Pro features at no charge. If you do not cancel before the free trial ends, your subscription will begin automatically and your account will be charged at the subscription rate.

You may cancel at any time during the trial through your device's subscription settings at no cost.

7. User Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of information as described in our Privacy Policy.

All personal health data (puffs, resists, journal entries, check-ins, program progress) is stored locally on your device and is not transmitted to our servers.

8. Acceptable Use

You agree to use the App only for its intended purpose of supporting nicotine and vaping cessation. You agree not to:

• Reverse engineer, decompile, or disassemble any part of the App

• Use the App for any unlawful purpose

• Attempt to gain unauthorized access to the App or its related systems

• Use the App to develop a competing product

• Share, transfer, or sublicense your subscription to others

• Misrepresent your identity or provide false information

• Interfere with or disrupt the App's functionality

9. Intellectual Property

All content, design, code, text, graphics, logos, the NixCloud name, the Identity Shift Engine concept, the behavioral archetype system, the containment messaging framework, and all other intellectual property in the App are owned by RiffLogic LLC and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works without prior written permission from RiffLogic LLC.

10. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

RiffLogic LLC does not warrant that:

• The App will be uninterrupted, error-free, or secure

• The App will be free of viruses or other harmful components

• Any specific health outcomes or success in cessation will be achieved

• The information provided in the App is complete, accurate, or current for your individual circumstances

11. Limitation of Liability

To the maximum extent permitted by applicable law, RiffLogic LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or health outcomes arising out of or in connection with your use of the App.

In no event shall RiffLogic LLC's total liability exceed the amount you paid for the App in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless RiffLogic LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately.

Data stored locally on your device remains yours. Active subscriptions continue to be governed by the respective app store terms.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Dallas, Texas. Either party may seek injunctive relief in a court of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and any subscription terms presented at the time of purchase, constitute the entire agreement between you and RiffLogic LLC regarding the use of the App.

17. Changes to These Terms

We reserve the right to update these Terms at any time. If we make material changes, we will notify you through the App or by other reasonable means. Continued use of the App after changes constitutes acceptance of the revised Terms.

The health recovery timelines shown in NixCloud (e.g., "heart rate normalizes in 20 minutes," "lung function improves 30% in 30 days") are based on published medical research on smoking and vaping cessation. These are population-level averages and may not accurately reflect your individual recovery.

Factors including duration and intensity of use, device type, nicotine concentration, age, genetics, and overall health significantly affect recovery timelines.

Behavioral and Psychological Content

The CBT exercises, thought records, identity progression framework, and behavioral archetype system are designed as self-help tools based on established psychological principles. They are not therapy and should not be used as a substitute for professional mental health treatment.

If you experience significant psychological distress, please contact a mental health professional.

Statistical Claims

Statistics cited in the App (e.g., "Pro users are 3.2x more likely to quit") are based on internal data and are not peer-reviewed clinical claims. Individual results depend on personal commitment, circumstances, and many factors outside the control of the App.

If you experience any of the following, stop using the App and seek immediate medical attention:
