These Terms of Service ("Terms") constitute a legally binding agreement between you and DataStream Tech Inc. ("Redwine," "we," "us," or "our") governing your access to and use of the Redwine social networking application and related services (the "Service").
By accessing or using the Service, you agree to be bound by these Terms and the Redwine Privacy Policy.
1. Acceptance of Terms
You must be at least 18 years old to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you do not agree to these Terms, do not use the Service.
2. Your Redwine Account
Account Creation: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Termination by You: You may terminate your account at any time by following the instructions in the app.
Termination by Us: We may suspend or terminate your account and your access to the Service at any time, for any reason (or no reason), including if we believe you have violated these Terms.
3. User Content and License
User Content: You are solely responsible for all content—including photos, text, comments, and messages—that you upload, post, or display on or through the Service ("User Content").
Content Ownership: You retain all rights in and to your User Content.
License to Redwine: By posting User Content to the Service, you grant Redwine a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display such User Content in connection with operating and providing the Service and for Redwine’s marketing and promotional purposes.
Representations and Warranties: You represent and warrant that you own the User Content or have the necessary rights and permissions to grant the above license.
4. Prohibited Activities
You agree not to do any of the following:
Post or transmit content that is illegal, abusive, harassing, hateful, or racially/ethically offensive.
Harass, abuse, or harm another person or group.
Use the Service for any commercial or unlawful purpose.
Impersonate any person or entity.
Send unsolicited or unauthorized advertising, promotional materials, or spam.
Interfere with or disrupt the Service or servers/networks connected to the Service.
5. Intellectual Property
The Service and its original content, features, and functionality (excluding User Content) are and will remain the exclusive property of Redwine and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Redwine.
6. Disclaimers and Limitation of Liability
Disclaimer: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Redwine expressly disclaims all warranties of any kind, whether express or implied.
Limitation of Liability: In no event shall Redwine, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory.
7. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
