Applies to the Android application PadLink, published by DAVIDA.
Read this first. PadLink is free software under the GNU Affero General Public License v3.0. Where anything in these Terms conflicts with that licence, the licence wins. These Terms cover the service relationship between you and us; they do not and cannot take away rights the AGPL grants you.
By installing or using PadLink you agree to these Terms. If you do not agree, do not use the app. If you obtained PadLink through Google Play, Google Play's own terms apply to the distribution in addition to these Terms.
PadLink is an independent client that connects to a game console you already own, over a network you control, and shows its output on your phone while sending your input back to it.
PadLink is not a cloud gaming service. We do not host, stream, sell, rent or provide any games or game content.
PadLink is not a Sony Interactive Entertainment product, is not affiliated with Sony, and is not endorsed by Sony.
PadLink provides no servers. Your session runs directly between your phone and your console.
PadLink is licensed, not sold, and it is licensed to you under the GNU Affero General Public License, version 3.0. Under that licence you may run, study, modify and redistribute the software, provided you meet its conditions — notably the obligation to make corresponding source code available when you distribute it.
The complete corresponding source code for every released version of PadLink is published. PadLink incorporates the chiaki-ng Remote Play engine and other third-party components; their licences and notices are listed inside the app under Settings → Open source licences and in the source repository.
Our name, logo and product branding are not covered by the AGPL. If you redistribute a modified version, you must not present it as PadLink or use our branding in a way that suggests we published or endorsed it.
You agree that you will:
use PadLink only with a console you own or are authorised to use;
comply with the terms of the console platform and of any account you sign in with, including Sony Interactive Entertainment's terms for PlayStation Network;
not use PadLink to circumvent technical protection measures, to access another person's console without permission, or for any unlawful purpose;
keep your own device, network and console credentials secure.
Whether and how you may use Remote Play with your console is determined by the console manufacturer, not by us. If they change or restrict it, PadLink may stop working, and that is outside our control.
PadLink depends on hardware, firmware, network conditions and third-party protocols that we do not control. We do not promise that the app will work with any particular console, firmware version, router, phone model or network, or that it will be available without interruption. We may change, suspend or discontinue any part of the app at any time. Because the app is open source, a discontinued version remains yours to keep, build and maintain.
PadLink is free of charge. It contains no subscription and no in-app purchases. If a future version ever introduces a paid element, it will be disclosed on the Google Play listing before you install that version, and any payment would be processed by Google Play under Google's terms and refund policy — not by us.
We collect no personal data. What the app stores on your device, and why, is described in our Privacy Policy, which forms part of these Terms.
To the fullest extent permitted by law, and consistent with sections 15 and 16 of the AGPL-3.0, PadLink is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. You use it at your own risk.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or exemplary damages, nor for loss of data, loss of profits, loss of game progress, damage to hardware, or interruption of service, arising out of or relating to your use of or inability to use PadLink — even if we were advised such damages were possible. Where liability cannot lawfully be excluded, our total aggregate liability is limited to the greater of the amount you paid us for PadLink (which is zero) or USD 10.
Nothing in these Terms excludes liability that cannot be excluded under the mandatory law that applies to you, including consumer-protection rights.
You may stop using PadLink at any time by uninstalling it. We may end your right to use versions we distribute if you materially breach these Terms. Termination does not affect the rights the AGPL grants you in the source code, and it does not affect sections 8, 9 and 12, which survive.
We may update these Terms. The effective date at the top of this page shows the current version, and material changes will be noted in the app's release notes. Continuing to use the app after an update means you accept the updated Terms.
These Terms are governed by the laws of {{GOVERNING_LAW_COUNTRY}}, without regard to conflict-of-law rules. The courts of {{GOVERNING_LAW_VENUE}} have jurisdiction, except where mandatory consumer law in your country of residence gives you the right to bring proceedings locally.
