This Terms of Use ("Terms") is a legally binding agreement between you and CloudVibe International Limited (“CloudVibe,” “QMatch,” “we,” “our,” or “us”) and governs your access to and use of the QMatch mobile application (“QMatch,” “App,” or “Service”).
By downloading, accessing, or using QMatch, you agree to be bound by these Terms and our [Privacy Policy]. If you do not agree, you must not use QMatch.
We may revise these Terms from time to time. Any changes will become effective upon posting within the App or on our website. You will be deemed to have accepted the revised Terms if you continue using QMatch after the updated version becomes effective.
These Terms include our policies for acceptable use, user content, rights and obligations, account rules, and other important legal provisions.
1. Eligibility and Safety
You must be at least 18 years old to download or use QMatch. This Service is strictly for adults. We do not knowingly collect information from anyone under 18. If you are under 18, you must not use the App or provide any personal data. Any misrepresentation of your age will result in the immediate termination of your account.
You are solely responsible for the content and information you post on QMatch. Profiles or content containing nudity, violence, hate speech, or any offensive material are strictly prohibited.
We may, at our sole discretion, remove or refuse to post any content or terminate your access at any time, without notice or liability.
2. General Terms
We reserve the right to change, suspend, or discontinue any part of the App at any time. We will notify you through the App or email where possible.
If you disagree with these Terms or any future updates, your only recourse is to delete your account and discontinue use.
By using QMatch, you represent and warrant that:
You are at least 18 years old.
You are not required to register as a sex offender in any jurisdiction.
Your use complies with all applicable local laws and regulations.
QMatch is free to download. However, mobile data charges and in-app purchases may apply.
3. Data and Privacy
We collect information about your activities on the App, including usage data, purchases, and interactions, as described in our [Privacy Policy]. Please review it carefully to understand how we collect and use your information.
4. User Accounts
You may provide optional profile information such as photos, name, gender, and interests.
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
You must notify us immediately of any unauthorized access or breach of security.
5. Prohibited Activities
You agree not to engage in any of the following prohibited behaviors:
Impersonating another person or entity.
Soliciting money, gifts, or personal information from other users.
Harassing, stalking, threatening, or harming others.
Posting content that infringes any third party’s rights or violates any law.
Using bots, scrapers, or any automated systems to collect data from QMatch.
Uploading malware, viruses, or harmful code.
Promoting illegal activities or commercial solicitations without consent.
Misrepresenting your age, gender, or location.
Violation may lead to account suspension or permanent ban without refund or notice.
6. User Content
You are solely responsible for the content you post or transmit via QMatch.
By posting content, you grant CloudVibe a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content solely for operating and promoting the Service.
Prohibited content includes but is not limited to:
Offensive, defamatory, or harassing material.
Pornographic, violent, or discriminatory material.
Fraudulent or misleading information.
Content promoting illegal or unsafe acts.
Solicitations, spam, or pyramid schemes.
We reserve the right to remove any content that violates these Terms or applicable law.
7. Spam and Misuse
Spamming, commercial solicitation, or any automated message activity is prohibited. Violations may result in immediate account termination and potential legal action.
8. Interactions with Other Users
You are solely responsible for your interactions with other users, both online and offline.
We do not conduct background checks but reserve the right to do so.
Exercise caution in sharing personal or financial information.
QMatch is not responsible for any user behavior or damages arising from your interactions.
9. Community Safety and Zero-Tolerance Policy for CSAE
9.1 Commitment to Safety
CloudVibe is committed to fostering a safe and respectful community. We encourage you to report any behavior or content that violates these Terms, including any activity that puts minors at risk.
9.2 Zero-Tolerance for Child Sexual Abuse and Exploitation (CSAE)
We have a strict, zero-tolerance policy against any content or conduct that involves or promotes Child Sexual Abuse and Exploitation (CSAE). You are expressly prohibited from uploading, posting, sharing, or transmitting any content that depicts, describes, or facilitates CSAE. This includes, but is not limited to, images, videos, illustrations, links, or text.
9.3 Reporting to Law Enforcement
In compliance with laws and platform policies such as those from Google Play, you acknowledge and agree that CloudVibe will report any and all content that appears to be CSAE, along with the involved user account information, to relevant law enforcement authorities and/or organizations such as the National Center for Missing & Exploited Children (NCMEC).
9.4 Consequences of Violation
Any user found to have violated this policy will be subject to immediate and permanent termination of their account without notice or refund. We will fully cooperate with law enforcement in any subsequent investigations.
10. Service Changes and Termination
We may modify, suspend, or terminate the Service at any time.
You may delete your account at any time.
We may suspend or terminate your access without notice if you violate these Terms.
11. Subscriptions, Virtual Currency, and Payments
11.1 Subscriptions
Subscriptions are billed through Google Play or Apple iTunes. Auto-renewal can be turned off in your account settings.
All purchases are non-refundable and non-transferable. Prices and features may change without notice.
11.2 Virtual Currency
Virtual currency (such as coins) is a limited, non-transferable, non-refundable digital item.
It has no cash value and cannot be redeemed for money.
We may change or discontinue virtual items at any time without liability.
11.3 Payment Terms
If you purchase paid services via third-party stores, billing is managed by those platforms. You must cancel subscriptions through them directly.
12. Disclaimer and Limitation of Liability
QMatch is provided “as is” and “as available.”
We make no warranties or guarantees regarding uninterrupted or error-free operation.
To the fullest extent permitted by law, CloudVibe International Limited disclaims all warranties, express or implied.
We are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits or data, arising out of your use of QMatch.
13. Dispute Resolution
Any dispute or claim arising from these Terms or your use of QMatch shall be resolved by binding arbitration under Hong Kong law, administered in English.
You agree to waive your right to a jury trial or class action, except as prohibited by law.
14. Indemnification
You agree to indemnify and hold harmless CloudVibe International Limited, its affiliates, officers, employees, and agents from any claim, loss, or expense arising from your violation of these Terms or applicable law.
15. Copyright Policy
If you believe that content on QMatch infringes your copyright, please contact our Designated Agent with details per the Digital Millennium Copyright Act (DMCA) or equivalent Hong Kong IP law.
16. Export Compliance
You agree not to use or export QMatch in violation of any applicable laws, including Hong Kong and U.S. export regulations.
17. Customer Conduct
When communicating with QMatch staff, you agree not to use abusive, threatening, or discriminatory language. We may terminate your account for inappropriate behavior.
18. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Hong Kong SAR.
You agree that any dispute shall be submitted to the exclusive jurisdiction of the courts of Hong Kong (unless arbitration applies).
19. Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and CloudVibe regarding your use of QMatch.
If any provision is found invalid, the remaining terms remain in effect.
