TERMS OF USE (End User License Agreement)

This End User License Agreement ("EULA") explains how you ("the User(s)" or "you") may use the Alpha Creation Apps application ("the App"), provided to you by Alpha Creation Apps. ("the Company," "we," "our," or "us"). Please carefully read this EULA before downloading, installing, or using the App, as your use of the App is subject to the terms and conditions set forth herein.

What Data We Collected

To provide Caller ID and spam detection services, we need access to your Contacts. The data will be securely uploaded to our server at https://callerid.qtonzapps.in to identify unknown callers and detect spam. We do not share your data with third parties for marketing purposes. By proceeding, you consent to this data collection. 

Details of Data Collected:

We collect the following information from your Contact List:

• Contact Names

• Phone Numbers

• Email Addresses

Purpose of Data Collection

The purpose of collecting this data is to:

• Provide caller identification services.

• Detect and alert users about potential spam or fraudulent calls.

How the Data is Used

• Your data is securely stored on our servers and used for analytics to improve the accuracy of caller identification and spam detection.

• We do not share your data with any third parties.

User Rights

We respect your rights regarding your personal data. You have the ability to:

• Delete Your Account: You can delete your account along with all associated data at any time.

• Revoke Consent: You may revoke consent for data collection and stop using the service.

• Request Data Deletion: You can request that we delete your data from our servers permanently.

1. ACCEPTANCE OF THE TERMS 

By downloading, installing, accessing, or using the Caller ID & Spam Blocker application ("App"), you acknowledge that you have read, understood, and agreed to be bound by this End User License Agreement (EULA) and our Privacy Policy (collectively referred to as "the Terms").

By proceeding to use the App, you:

• Agree to comply with all applicable laws and regulations, including those of India.

• Confirm your consent to the practices described in this agreement and our privacy documentation.

IMPORTANT:
IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE APP.
IMMEDIATELY DELETE IT FROM YOUR DEVICE.

2. INTRODUCTION 

The Caller ID & Spam Blocker  application (hereinafter referred to as "the App") is developed and operated by Alpha Creation Apps (referred to as "the Company", "MBit Music", "our", "us", or "we"). The App functions as a communication utility and caller identification platform, enabling users ("you", "User(s)") to:

• Identify unknown callers in real-time

• Block spam calls and unwanted messages

• Manage call history, SMS, and contact information

• Customize caller themes for an enhanced user experience

These Terms of Use (collectively referred to as "the Agreement") govern your access to and usage of both the App and the official website at https://qtonzglobal.com  (together, "the Service").

By installing, accessing, or using any part of the Service, you affirmatively agree to be legally bound by these Terms. If you do not agree to any provision of this Agreement, you must not use the App or any associated Services.

Feature Permissions Notice
To use the App effectively, you may need to grant certain permissions, including but not limited to:

• Contacts: for identifying incoming callers

• Phone & SMS: for call and text management

• Storage & Media: for personalizing themes or saving preferences

• Location (optional): for enhanced caller context and region-based blocking features

Additionally, specific features or services within the App may be governed by separate guidelines or terms. These are hereby incorporated into this Agreement by reference and are considered binding as part of your overall acceptance of the Terms.

3. GRANT OF LICENSE 

Subject to your compliance with the Terms, we grant you a limited, personal, non-commercial, non-exclusive, revocable, non-sublicensable, and non-transferable license to download, install, and use the App on a compatible device owned or controlled by you.

You may only use the Service for personal purposes as permitted under this Agreement and applicable laws. The Company reserves the right to restrict, suspend, or terminate your access to the Service at its discretion, with or without notice, for any reason, including breach of this Agreement.

4. LIMITATION ON USE 

You agree not to:

• Impersonate any individual or entity or provide false or misleading information.

• Copy, modify, decompile, reverse-engineer, disassemble, or attempt to extract source code from the App.

• Disrupt or interfere with the Service, including transmitting viruses or overloading servers.

• Remove or alter any proprietary notices or branding present in the App.

• Share, distribute, or sublicense the App for use on multiple devices not owned by you.

• Collect or harvest any personal data without consent, including automated means.

• Engage in activities that violate applicable Indian laws, including promoting fraudulent, obscene, or offensive content.

5. ACCOUNT CREATION AND SECURITY 

Some features of the App may require you to create an account ("Account"). You agree to provide accurate and complete information and maintain the security of your account credentials. You are solely responsible for all activities occurring through your Account and must notify us immediately at apps.alphacreation@gmail.com in case of unauthorized use or security breaches.

6. ELIGIBILITY 

You may only use the Service if you are at least 13 years old. If you are under 18 years of age, you must obtain verifiable consent from a parent or legal guardian before using the App or any of its services.

We reserve the right to:

• Request proof of age at any time.

• Terminate or suspend your account and access to the Service if we discover that you have misrepresented your age or used the Service without proper consent.

By using the App, you confirm that you meet these age requirements and agree to abide by all applicable laws regarding age restrictions and parental consent.

7. USER SUBMISSIONS 

The App may allow you to upload, submit, or share content, including but not limited to contact details, feedback, or customizations ("User Submissions"). By submitting any content through the App, you acknowledge and agree to the following:

Your Responsibility

• You are solely responsible for all content you submit.

• You represent and warrant that you own or have necessary rights and permissions to use, share, and license such content.

License Grant

By submitting content, you grant the Company a worldwide, non-exclusive, royalty-free, irrevocable license to use, reproduce, distribute, display, and adapt your User Submissions solely for the purpose of operating and improving the Service.

Prohibited Submissions

You agree not to upload or share any content that:

• Violates applicable laws, regulations, or third-party rights, including copyright and data protection laws.

• Contains personal, sensitive, or confidential information of others without their explicit and informed consent.

• Is offensive, obscene, defamatory, harassing, violent, or harmful in nature, or otherwise promotes hate or abuse.

8. PROPRIETARY RIGHTS 

All rights, title, and interest in and to the App, including but not limited to its design, functionality, content, graphics, user interface, text, software code, trademarks, and other intellectual property (collectively, the "Materials"), are owned by Alpha Creation Apps. or its respective licensors.

Restrictions on Use:

You may not, without prior written permission from the Company:

• Copy, reproduce, distribute, publish, display, modify, or create derivative works based on any Materials.

• Reverse-engineer, decompile, or extract source code from the App.

• Use any trademarks, logos, or brand elements owned by the Company for any commercial purpose or public communication without permission.

All rights not expressly granted in these Terms are reserved by Alpha Creation Apps

9. THIRD-PARTY SERVICES 

The App may contain links to, integrate with, or rely on services, websites, and content provided by third parties (“Third-Party Services”).

Important Disclaimers:

• No Control or Endorsement:
  Alpha Creation Apps. does not control, endorse, or assume any responsibility for the content, policies, or practices of any Third-Party Services.

• User’s Responsibility:
  Your use of such Third-Party Services is entirely at your own risk. You are encouraged to review their terms of service and privacy policies before engaging with those services.

• No Liability:
  We shall not be liable for any loss or damage arising from your use of or reliance on Third-Party Services, including any data collection, privacy breaches, or service disruptions caused by such parties.

10. PRIVACY POLICY

11. CONFIDENTIALITY 

You agree to maintain the confidentiality of any non-public, proprietary, or confidential information obtained from Alpha Creation Apps. Ltd. through your use of the App. This includes, but is not limited to:

• Source code, application features, or functionalities not publicly released

• Internal business processes, analytics, or user behavior metrics

• Any communications marked as confidential or reasonably understood to be private

You may only use such information for purposes explicitly permitted under this Agreement. You agree not to disclose or share such information with any third party without prior written consent from the Company, and to take all reasonable precautions to prevent unauthorized disclosure or misuse.

12. EXPORT LAWS 

You agree to comply with all applicable export control laws and regulations of India and any other relevant jurisdictions when using the App. You also agree not to export, re-export, or transfer the App, any part of the Service, or any data or technology derived from the App:

• To any country or individual subject to export restrictions under Indian law, or

• In violation of any applicable international export regulations

It is your responsibility to ensure compliance with all applicable laws, including obtaining any required export licenses or approvals.

13. UPDATES AND MODIFICATIONS 

The Company reserves the right to update, modify, or enhance the App at any time, including adding, altering, or removing features or functionalities. Such updates may occur automatically or may require manual installation by you.

By continuing to access or use the App after such updates are made, you agree to be bound by the modified version of the App and acknowledge that continued use constitutes your acceptance of the changes. The Company is not obligated to provide prior notice for any modifications.

14. INDEMNIFICATION 

To the maximum extent permitted by Indian law, you agree to indemnify, defend, and hold harmless Alpha Creation Apps, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use or misuse of the App or Service;

• Your breach of this Agreement;

• Your violation of any rights of a third party, including but not limited to intellectual property rights, privacy rights, or data protection laws;

• Any User Submissions or content you provide through the App.

This indemnification obligation will survive the termination of this Agreement and your use of the App.

15. LIMITATION OF LIABILITY 

To the fullest extent permitted by applicable Indian law:

• Alpha Creation Apps. shall not be liable for any indirect, incidental, punitive, special, or consequential damages, including but not limited to loss of profits, data, goodwill, or other intangible losses resulting from your use or inability to use the App.

• In no event shall the total aggregate liability of the Company for any claims arising out of or related to the use of the Service exceed the total amount paid by you (if any) to the Company for the Service during the three (3) months immediately preceding the claim.

16. TERMINATION 

We may, at our sole discretion, suspend or terminate your access to the App or Service at any time, with or without prior notice, for any reason, including but not limited to your violation of this Agreement.

Upon termination:

• Your rights to access and use the App will cease immediately.

• Any user data or content associated with your account may be deleted, unless otherwise required by law.

• You will no longer be entitled to use any features or access any part of the Service.

You acknowledge that we are not liable to you or any third party for termination of your access to the Service.

17. GOVERNING LAW AND JURISDICTION 

This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

You agree that any dispute, controversy, or claim arising out of or in connection with this Agreement, or the breach thereof, shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

19. AMENDMENTS TO THE AGREEMENT 

Alpha Creation Apps. reserves the right to modify or update this Agreement at any time. Any significant changes will be communicated to you via the App interface or on our official website.

Your continued use of the App after such modifications constitutes your acknowledgment and acceptance of the revised terms.
