By using the PostMax mobile application (“App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.

1. Description of Service

PostMax provides AI-assisted analysis of user-submitted images, including creative feedback, captions, and music suggestions. Outputs are generated using automated artificial intelligence systems.

2. AI Processing Disclosure

By uploading content, you acknowledge and agree that:

• Content may be transmitted to third-party AI providers (including OpenAI) for processing.
• AI-generated outputs may be automated, probabilistic, and imperfect.
• Results may vary between uses.

3. User Content

You retain ownership of your uploaded content.

You represent that:

• You own or have permission to use uploaded content
• Content does not violate laws or third-party rights

You grant PostMax a limited, non-exclusive, temporary license to process your content solely to provide App functionality.

4. Prohibited Content

You agree not to upload content that is:

• Illegal
• Exploitative or harmful
• Sexually explicit involving minors
• Intended to harass, threaten, or abuse others

We may restrict or terminate access if misuse is detected.

5. Subscriptions and Payments

Certain features require a paid subscription.

• Payments are processed through Apple’s App Store and subject to Apple’s billing terms.
• Access to features is provided on an “as available” basis.
• We do not guarantee specific results, performance outcomes, popularity increases, or creative success.

Purchasing a subscription grants access to features, not guaranteed outcomes or benefits.

6. AI Output Disclaimer

AI-generated content:

• Is provided for informational and creative purposes only
• May be inaccurate, incomplete, or subjective
• Should not be relied upon as professional advice

7. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided “as is” and “as available.”
• We make no warranties regarding accuracy, reliability, or suitability.
• PostMax shall not be liable for indirect, incidental, special, consequential, or punitive damages.
• We are not responsible for loss of data, user decisions based on AI output, or unmet expectations regarding subscriptions or results.

8. Service Availability

We do not guarantee uninterrupted or error-free operation. Features may change, be modified, or discontinued at any time.

9. Termination

We may suspend or terminate access for violations of these Terms or misuse of the App.

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. Temporary interruptions may occur due to maintenance, technical issues, or third-party services.

Purchases are processed through Apple’s App Store, and refund requests are subject to Apple’s refund policies. We are not responsible for issuing refunds except where required by law.

 Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages resulting from use of or inability to use the Service.

 Third-Party Services Disclaimer 

Since you use AI APIs:

The Service may rely on third-party providers. We are not responsible for outages or disruptions caused by third-party services.

Changes to Terms

We may update these Terms periodically. Continued use constitutes acceptance of updated Terms.
