1. Acceptance of Terms
Welcome to PostCardMe (the "App"), provided by PostCardMe ("we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our mobile application and related services (collectively, the "Services").
By downloading, installing, accessing, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you may not use our Services.
2. Description of Services
PostCardMe is an AI-powered application that allows users to upload photographs of their own face ("User Content"). Using artificial intelligence and machine learning models, the App generates a stylized, artistic interpretation of the uploaded image portraying a gender-swapped version of the individual ("AI-Generated Content"). Our Services are for personal, non-commercial entertainment purposes.
3. User Accounts and Eligibility
Eligibility: You must be at least 13 years old to use the App. If you are under the age of legal majority in your jurisdiction, you represent that you have your parent or guardian's permission to use the Services and that they have read and agreed to these Terms on your behalf.
Account Responsibility: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
4. User Content and Licenses
Your Content: You retain all ownership rights in the original photographs you upload to the App.
License to Us: By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, modify, and process your User Content solely for the purpose of operating, improving, and providing the Services to you. This includes, but is not limited to, using your photo as an input to generate the AI-Generated Content.
Representations on Your Content: You represent and warrant that:
You own or have the necessary rights to the User Content you upload and it is a photograph of yourself.
Your User Content does not infringe, misappropriate, or violate any third-party rights, including copyright, trademark, privacy, or publicity rights.
Your User Content is not unlawful, obscene, defamatory, or otherwise objectionable.
5. AI-Generated Content and Ownership
Ownership of Output: Upon generating AI-Generated Content for you, we grant you a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display the AI-Generated Content for your personal, non-commercial purposes. This means you can share it on social media, use it as a profile picture, or print it for yourself.
Prohibited Uses: You may not use the AI-Generated Content for any commercial purpose, including but not limited to:
Selling, licensing, or otherwise commercializing the AI-Generated Content.
Using the AI-Generated Content in connection with any business, product, or service.
Using the AI-Generated Content in a way that is illegal, fraudulent, harassing, or promotes hate speech, violence, or discrimination.
No Guarantee of Uniqueness or Accuracy: You acknowledge that the AI-Generated Content is created by an automated process, may not be a precise or accurate representation, and that similar output may be generated for other users.
6. Prohibited Conduct
You agree not to:
Upload any content that is not a photograph of yourself for which you have the necessary rights.
Use the Services for any illegal or unauthorized purpose.
Upload content that contains viruses, malware, or other malicious code.
Attempt to reverse engineer, decompile, or discover the source code of our AI models.
Use any automated means or bots to access or use the Services.
Impersonate any person or entity or misrepresent your affiliation with a person or entity.
7. Intellectual Property
All rights, title, and interest in and to the Services (excluding User Content and the licensed AI-Generated Content) are and will remain the exclusive property of PostCardMe. This includes all software, technology, designs, trademarks, logos, and the "look and feel" of the App.
8. Disclaimers and Limitation of Liability
Services "As Is": THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE AI-GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.
No Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, PostCardMe AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.
9. Indemnification
You agree to indemnify and hold harmless PostCardMe and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your User Content, or your violation of these Terms.
10. Termination
We may suspend or terminate your access to the Services at any time, with or without cause or notice. You may also terminate these Terms by deleting your account and the App from your device.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of such changes by updating the "Last Updated" date at the top of these Terms and/or by posting a notice within the App. Your continued use of the Services after any change constitutes your acceptance of the new Terms.
