These Terms of Service govern your use of Poolnet, a pool service management application operated by Poolnet LLC.

By accessing or using Poolnet, you agree to these Terms of Service. If you do not agree with these terms, please do not use the application or its services.

Accounts and Eligibility

To use Poolnet, you must:

• Be at least 18 years of age.

• Provide accurate and complete information when creating an account.

• Keep your account credentials secure and confidential.

• Promptly notify us of any unauthorized access to or use of your account.

You are responsible for maintaining the security of your account and for activities conducted through your account.

Poolnet LLC is not responsible for losses resulting from your failure to maintain the security of your account or credentials, except where otherwise required by applicable law.

We reserve the right to suspend or terminate accounts that violate these terms or pose a risk to the security, integrity, or proper functioning of the service.

Access to the Service

Poolnet provides tools for pool service professionals to manage customer information, service routes, maintenance records, service reports, and related business activities.

Poolnet is currently provided without paid features or subscription requirements.

We reserve the right to modify, update, add, or discontinue features of the application as necessary to maintain and improve the service, subject to applicable law.

We will not charge you for access to the application unless we clearly introduce paid services and provide the applicable terms and pricing in advance.

Acceptable Use

You agree to use Poolnet only for lawful purposes and in accordance with these Terms of Service.

You must not:

• Use the service to store, upload, or transmit unlawful, harmful, fraudulent, or unauthorized content.

• Use the application to violate the privacy or legal rights of other individuals.

• Attempt to gain unauthorized access to the application, its infrastructure, or other users' accounts.

• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the application, except where permitted by applicable law.

• Copy, resell, sublicense, distribute, or commercially exploit the application without our prior written permission.

• Interfere with, disrupt, damage, or impair the operation, security, or availability of the service.

• Use the application in any way that violates applicable laws or regulations.

We reserve the right to take appropriate action if we reasonably believe that an account or activity violates these terms or threatens the security or integrity of Poolnet.

Your Data

You retain ownership of the information and content you submit, upload, or store through Poolnet, including customer information, service records, business information, and photographs.

By using Poolnet, you grant Poolnet LLC a limited, non-exclusive right to host, store, transmit, and process your content solely as necessary to operate, maintain, and provide the application and its features.

This permission does not transfer ownership of your content to Poolnet LLC.

You are responsible for ensuring that you have the necessary rights, permissions, and lawful basis to collect, upload, store, and process information about your customers, employees, and other individuals through Poolnet.

We do not sell your personal information or use your business data for targeted advertising.

Client Communications

Poolnet may allow you to send service reports and other communications to your customers using the contact information you provide.

You are responsible for:

• Ensuring that you have the necessary permission or other lawful basis to contact your customers.

• Providing accurate customer email addresses and contact information.

• Ensuring that the content of your communications complies with applicable laws.

• Obtaining any required consent before sending communications where consent is required.

Poolnet LLC does not control or assume responsibility for the content, accuracy, or legality of communications initiated by users through the application.

Location-Based Features

Poolnet may provide location-based features, including GPS coordinates, address search, and service route management.

You are responsible for ensuring that your use of location information and customer addresses complies with applicable privacy and data protection laws.

The availability and accuracy of location-based features may depend on your device, location permissions, and third-party service providers.

Poolnet LLC does not guarantee the accuracy or uninterrupted availability of GPS data, mapping information, or address search results.

Third-Party Services

Poolnet may rely on third-party services to provide certain functionality, including authentication, database hosting, email delivery, mapping, and infrastructure security.

Your use of features that depend on third-party services may also be subject to the terms and policies of those providers.

Poolnet LLC is not responsible for third-party services, their availability, or changes to their functionality, except as required by applicable law.

Service Availability

We make reasonable efforts to keep Poolnet available and functioning properly. However, we do not guarantee uninterrupted, error-free, or continuous access to the application.

The service may occasionally be unavailable due to maintenance, updates, technical issues, third-party service interruptions, or circumstances beyond our reasonable control.

We reserve the right to modify, suspend, or discontinue any part of the service when reasonably necessary.

To the extent permitted by applicable law, Poolnet LLC is not responsible for losses resulting from service interruptions, temporary unavailability, or the failure of third-party services.

Intellectual Property

All software, application designs, graphics, trademarks, logos, and other materials comprising the Poolnet platform are owned by Poolnet LLC or its licensors, unless otherwise stated.

You may use the application only for its intended purposes and in accordance with these Terms of Service.

Nothing in these terms grants you ownership of or any rights to Poolnet's intellectual property, except for the limited right to use the application as permitted by these terms.

You may not use Poolnet's trademarks, branding, or other intellectual property without prior written permission, except as permitted by applicable law.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, Poolnet is provided on an "as is" and "as available" basis.

Poolnet LLC makes no warranties, express or implied, regarding the availability, reliability, accuracy, or suitability of the application for any particular purpose.

We do not guarantee that the service will be uninterrupted, error-free, completely secure, or free from technical defects.

You are responsible for maintaining appropriate backups of important business information and records.

Nothing in these terms excludes or limits any warranties or rights that cannot legally be excluded or limited under applicable law.

Limitation of Liability

To the fullest extent permitted by applicable law, Poolnet LLC and its officers, employees, contractors, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, business opportunities, business data, or goodwill, arising out of or related to your use of the application.

To the extent permitted by law, Poolnet LLC's total liability for claims arising from or relating to these terms or your use of the service shall be limited to the amount, if any, you paid directly to Poolnet LLC for the service during the three months preceding the event giving rise to the claim.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, damages, liabilities, and reasonable expenses arising from your unlawful use of Poolnet, your violation of these terms, or your infringement of the rights of another person.

This provision does not apply to the extent that a claim results from Poolnet LLC's own unlawful conduct or liability that cannot legally be transferred to you.

Termination

You may stop using Poolnet at any time.

You may delete your account through the application, where this functionality is available, or contact us at support@poolnet.app for assistance.

We reserve the right to suspend or terminate access to the service if you materially violate these terms, misuse the application, or create a security or legal risk.

Where reasonably practicable and legally appropriate, we will provide notice before terminating access.

Upon account deletion or termination, your access to the application may cease, and your data will be handled in accordance with our Privacy Policy and applicable law.

Governing Law

These Terms of Service are governed by the laws of the State of California, without regard to its conflict of law principles, except where applicable law requires otherwise.

Any disputes arising from these terms or your use of Poolnet shall be resolved in the competent courts of California, subject to applicable mandatory consumer protection and jurisdictional requirements.

Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to our application, business practices, or legal obligations.

When we make material changes, we will update the date at the top of this page and, where required by law, provide additional notice.

Your continued use of Poolnet after updated terms become effective constitutes acceptance of the revised terms, to the extent permitted by applicable law.

If you do not agree with the updated terms, you should discontinue use of the application.
