Welcome to Podsture ("Podsture", "we", "our", or "us").

These Terms of Use ("Terms") govern your access to and use of the Podsture mobile application. By downloading, accessing, or using the application, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the application.

1. Description of the Service

Podsture is a posture assistance application designed for users with compatible Apple AirPods. The app uses motion data from supported devices, with your permission, to provide posture guidance and reminders intended to encourage healthier posture habits.

Podsture is intended for informational and wellness purposes only.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the application.

By using Podsture, you represent that you have the legal capacity to enter into these Terms.

3. Permissions

Certain features require device permissions, including:

• Motion & Fitness access

• Notifications

• App Tracking Transparency (optional)

You may revoke these permissions at any time through your device settings. Some features may not function properly if required permissions are denied.

4. Health Disclaimer

Podsture is not a medical device and does not provide medical advice, diagnosis, treatment, or healthcare services.

The posture guidance provided by the application is intended solely for general wellness purposes.

You should consult a qualified healthcare professional regarding any medical condition, injury, pain, or posture-related concerns.

Do not rely on Podsture as a substitute for professional medical advice.

5. User Responsibilities

You agree to:

• use the application only for lawful purposes;

• use compatible hardware as required;

• not interfere with the operation or security of the application;

• not reverse engineer, modify, copy, or distribute the application except where permitted by applicable law.

6. Subscriptions and Payments

Certain features may require a paid subscription.

Subscriptions are processed through your Apple App Store account.

Unless canceled at least 24 hours before the end of the current billing period, subscriptions automatically renew.

You may manage or cancel your subscription through your Apple ID Account Settings.

Refund requests are handled by Apple in accordance with Apple's policies.

7. Intellectual Property

The application, including its software, design, graphics, trademarks, logos, and content, is owned by Podsture or its licensors and is protected by applicable intellectual property laws.

No rights are granted except those expressly stated in these Terms.

8. Privacy

Your use of Podsture is also governed by our Privacy Policy.

9. Disclaimer of Warranties

Podsture is provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by law, we make no warranties regarding:

• uninterrupted availability;

• accuracy of posture detection;

• fitness for a particular purpose;

• error-free operation.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Podsture and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the application.

Our total liability shall not exceed the amount you paid, if any, for the use of the application during the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate access to the application if you violate these Terms or if continued access would create legal or security risks.

You may stop using the application at any time by uninstalling it.

12. Changes to These Terms

We may update these Terms from time to time.

Continued use of the application after updated Terms become effective constitutes acceptance of those changes.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable in the jurisdiction where the developer is established, without regard to conflict of law principles.
