Welcome to our game emulator application (the "Application," "App," or "Service"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "You") and PocketEmu ("Company," "We," or "Us").
BY DOWNLOADING, INSTALLING, OR USING THIS APPLICATION, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICE.
Our Application is emulation software that enables users to run classic video game files on modern devices including mobile phones, tablets, and computers. Our Service is:
Ad-free: We do not display advertisements of any kind
Privacy-focused: We do not collect, store, or process any personal user information
Independent: We operate as an independent software provider
IMPORTANT: We do NOT provide game ROM files, BIOS files, or any copyrighted game content. Users are solely responsible for:
Legally obtaining all game files
Ensuring they have legal rights to use such files
Complying with all applicable copyright laws
DISCLAIMER OF AFFILIATION: Our emulator is NOT affiliated with, authorized by, endorsed by, or in any way officially connected with Nintendo, Sega, Sony, Microsoft, Atari, or any other game console manufacturers or game publishers. All mentioned console names, game titles, and trademarks are used solely to describe the emulation environments supported by our Application and do not imply any partnership, cooperation, or official relationship with the aforementioned companies. All game console names, game titles, and related trademarks are registered trademarks of their respective owners and are used here under fair use for descriptive purposes only.
You must be at least 13 years old to use this Service
Users under 18 should obtain parental guidance before use
You must have legal capacity to enter binding agreements
ACCOUNT-FREE SERVICE: Our Application does not require user registration, account creation, or personal information. You can use the Service immediately upon installation without providing any personal data.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes only.
You may NOT:
Reverse engineer, decompile, or modify the Application
Use the Application for commercial purposes without permission
Distribute, share, or transfer the Application to others
Remove copyright notices or proprietary markings
Use automated tools or bots with the Service
Violate any applicable laws or regulations
Upload or use copyrighted ROMs without legal authorization
Circumvent security measures or access controls
CRITICAL NOTICE: You bear complete legal responsibility for all ROM files used with our Application. You represent that:
You legally own or have authorized access to all game files
Your use complies with copyright laws and fair use doctrines
You will not use pirated or illegally obtained content
You understand downloading copyrighted ROMs from unauthorized sources is illegal
When you upload content (save files, screenshots, etc.), you grant us a license to store, process, and display such content as necessary to provide the Service. You retain ownership of your original content.
We own all rights to the Application software and proprietary technology, including user interface, design elements, and underlying algorithms developed by us.

The Application may include open-source emulation cores and components subject to their respective licenses, including but not limited to GPL, MIT, and BSD licenses.

PRIVACY BY DESIGN: Our Application is designed with privacy as a core principle:
No Personal Data Collection: We do not collect, store, or process any personal information
No User Tracking: We do not track user behavior, preferences, or usage patterns
Local Storage Only: All user settings, save states, and configurations are stored locally on your device
No Account Required: Our Service does not require user registration or account creation
The only data processed by our Application includes:
Game files that you provide and load into the emulator
Save states and game progress stored locally on your device
Application settings and preferences stored locally on your device
Error logs generated locally for debugging purposes (not transmitted)
Since we do not collect user data:
There is no risk of data breaches involving your personal information
Your privacy is protected by the local-only nature of our Application
You maintain complete control over all data associated with your use of the Service
We do not integrate with third-party analytics, advertising, or data collection services that could compromise your privacy.
We strive to maintain service availability but do not guarantee uninterrupted access. Service may be unavailable due to maintenance, technical issues, or circumstances beyond our control.
We may update the Application to fix bugs, add features, enhance security, or maintain compatibility. You agree to install available updates.
We provide technical support through documentation and community resources on a best-effort basis. Since we do not collect user data or maintain accounts, support is limited to general technical guidance and troubleshooting.
THE SERVICE IS PROVIDED "AS-IS" AND "AS-AVAILABLE." WE DISCLAIM ALL WARRANTIES, INCLUDING:
Merchantability and fitness for a particular purpose
Non-infringement of third-party rights
Accuracy, completeness, or reliability
Security or freedom from errors
Continuous availability or compatibility
We do not guarantee:
Perfect emulation accuracy or game compatibility
Consistent performance across all devices
Preservation of user data or content
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS.
WE ARE NOT LIABLE FOR:
Indirect, incidental, special, or consequential damages
Loss of profits, revenue, data, or goodwill
Business interruption or lost opportunities
Personal injury or property damage (except where prohibited by law)
You agree to defend and hold us harmless from claims arising from:
Your use of the Service and violation of these Terms
Your user content and any infringement claims
Your violation of laws or third-party rights
Your use of ROM files or copyrighted content
Since our Application does not require accounts or collect user data, there are no accounts to terminate or suspend.
We reserve the right to discontinue the Service for business or legal reasons. In such cases, users may continue to use previously downloaded versions of the Application.
Before formal legal action, you agree to contact us to resolve disputes informally for 30 days.
US users agree to binding arbitration for disputes, except for small claims court matters and intellectual property disputes. You waive class action rights.
Non-US users are subject to local dispute resolution laws and consumer protections.
We may modify these Terms at any time. Material changes will be communicated through email, in-app notifications, or website postings. Continued use after changes constitutes acceptance.
These Terms are governed by [Your Jurisdiction] law. Legal proceedings are subject to arbitration provisions or appropriate court jurisdiction.
These Terms and our Privacy Policy constitute the entire agreement between us.
If any provision is unenforceable, it will be modified or removed without affecting other provisions.
