PlotTwist TERMS AND CONDITIONS

Welcome to PlotTwist! These Terms and Conditions ("Terms") constitute a legal agreement between you ("Parent," "you," or "your") and PlotTwist ("we," "us," or "our") governing your and your child's use of the PlotTwist mobile application (the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1.1. These Terms apply to all users of the PlotTwist App, including parents and children under 13 years of age.
1.2. By creating an account and providing verifiable parental consent, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
1.3. You must be at least 18 years old or the legal age of majority in your jurisdiction to accept these Terms on behalf of your child.
1.4. If you are accessing the App on behalf of an organization or entity, you represent that you have authority to bind that organization to these Terms.
2.1. PlotTwist is an AI-powered storytelling application designed for children that generates personalized stories with voice narration.
2.2. The App uses artificial intelligence technology (Claude AI by Anthropic) to create unique stories based on user preferences and interests.
2.3. Stories are narrated using text-to-speech voice generation services provided by ElevenLabs.
2.4. We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice.
3.1. To use the App, parents must create an account and provide verifiable parental consent for their child's use of the service.
3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
3.4. You must notify us immediately of any unauthorized use of your account or any other breach of security.
3.5. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
PlotTwist offers subscription-based access with various pricing tiers. Subscription details, including pricing and features, are available in the App and may be updated from time to time.
We may offer free trial periods for new users. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
4.3.1. Subscriptions automatically renew at the end of each billing period (monthly or annually) unless canceled before the renewal date.
4.3.2. You authorize us to charge your payment method for the applicable subscription fees, plus any applicable taxes.
4.3.3. Subscription fees are billed in advance of each billing period.
4.3.4. If automatic billing fails, we will attempt to notify you and may suspend your access until payment is received.
We reserve the right to modify subscription fees. Price changes will be communicated at least 30 days in advance and will take effect at your next renewal date. Continued use of the App after the price change constitutes acceptance of the new pricing.
The App may offer in-app purchases for additional credits, features, or content. All in-app purchases are final and non-refundable except as required by law.
4.6.1. You may cancel your subscription at any time through the App settings or by contacting customer support.
4.6.2. Cancellation will be effective at the end of the current billing period.
4.6.3. You will retain access to subscription features until the end of the paid period.
4.6.4. No refunds or credits will be provided for partial subscription periods, except as required by law.
All sales are final. However, we may provide refunds at our sole discretion for technical issues, billing errors, or other extenuating circumstances. Refund requests must be submitted within 7 days of the charge. Contact support@plottwist.app with your request.
5.1. The App uses a credit-based system for story generation with voice narration. Each generated story with audio consumes credits based on length and complexity.
5.2. Subscription plans include a specified number of monthly credits that reset at the beginning of each billing cycle.
5.3. Unused credits do not roll over to the next billing period unless explicitly stated in your subscription plan.
5.4. Additional credits may be purchased as needed through in-app purchases.
5.5. Credit pricing and allocation are subject to change with reasonable notice to subscribers.
6.1. You agree to supervise your child's use of the App and ensure they use it appropriately.
6.2. You and your child agree NOT to:
• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to the App, servers, or networks
• Reverse engineer, decompile, or disassemble any aspect of the App
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use automated scripts, bots, or other automated means to access the App
• Interfere with or disrupt the App or servers
• Share account credentials with others
• Use the App to create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Resell, redistribute, or commercially exploit the App or its content
• Violate any applicable laws, regulations, or third-party rights
6.3. Violation of these usage restrictions may result in immediate termination of your account without refund.
7.1.1. The App, including all software, code, features, functionality, designs, graphics, interfaces, and content (excluding user-generated stories) is owned by PlotTwist and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
7.1.2. PlotTwist®, the PlotTwist logo, and other marks are trademarks of PlotTwist. You may not use these marks without our prior written permission.
7.1.3. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes.
7.2.1. Stories generated through the App using AI technology are created based on user inputs and preferences.
7.2.2. You retain ownership of the specific story content generated for your child through the App.
7.2.3. By using the App, you grant PlotTwist a limited, worldwide, royalty-free license to:
• Store and display generated stories within your account
• Process stories through our AI and voice synthesis systems
• Use aggregated, anonymized story data to improve the App
7.2.4. We will not share, publish, or use your child's specific story content for marketing purposes without separate explicit consent.
7.2.5. Stories may contain elements created by third-party AI services (Anthropic Claude), which are subject to their respective terms of service.
The App may use third-party services including AI story generation (Anthropic) and voice synthesis (ElevenLabs). Your use of these services through the App is subject to their respective terms and conditions.
8.1. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
8.2. We comply with the Children's Online Privacy Protection Act (COPPA) and other applicable privacy laws.
8.3. You acknowledge and agree that we collect, use, and share information as described in our Privacy Policy.
8.4. By accepting these Terms, you provide verifiable parental consent for the collection and use of your child's information as described in the Privacy Policy.
9.1. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
9.2. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, COMPLETENESS, OR RELIABILITY OF CONTENT
• UNINTERRUPTED OR ERROR-FREE SERVICE
9.3. We do not warrant that:
• The App will meet your specific requirements
• AI-generated stories will be appropriate for all children or educational needs
• The App will be available at all times or free from bugs or errors
• Any defects will be corrected
9.4. Content Disclaimer: Stories are generated by artificial intelligence and may occasionally contain unexpected or inappropriate content despite our content filtering. Parents should review generated content and report any concerns immediately.
9.5. Educational Disclaimer: PlotTwist is an entertainment application. While stories may have educational value, we make no claims about specific educational outcomes or suitability for particular developmental needs.
9.6. No Professional Advice: The App does not provide medical, psychological, educational, or other professional advice. Consult qualified professionals for specific guidance.
10.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLOTTWIST SHALL NOT BE LIABLE FOR:
• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR USE
• BUSINESS INTERRUPTION
• LOSS OF GOODWILL OR REPUTATION
10.2. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
10.3. These limitations apply even if we have been advised of the possibility of such damages and regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).
10.4. Some jurisdictions do not allow limitation of certain warranties or damages, so some limitations may not apply to you.
You agree to indemnify, defend, and hold harmless PlotTwist, its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your or your child's use or misuse of the App; (b) violation of these Terms; (c) violation of any rights of third parties; or (d) any content generated through your account.
12.1. The App may be available through third-party app stores (Apple App Store, Google Play Store). Your use of these platforms is subject to their respective terms and conditions.
12.2. App store providers are third-party beneficiaries of these Terms and may enforce them directly against you.
12.3. We are not responsible for app store policies, fees, or technical requirements that may affect your use of the App.
12.4. For iOS users: These Terms are between you and PlotTwist only, not with Apple Inc. Apple has no responsibility for the App or these Terms.
13.1. You may terminate your account at any time by canceling your subscription and contacting support@plottwist.app.
13.2. We may suspend or terminate your account immediately, without prior notice, if:
• You violate these Terms
• Payment fails or subscription expires
• We suspect fraudulent, abusive, or illegal activity
• Required by law or legal process
13.3. Upon termination:
• Your access to the App will cease immediately
• Your data will be deleted according to our Privacy Policy
• You remain liable for any outstanding fees
• Provisions that by their nature should survive will continue to apply
These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict of law principles.
Before filing any formal claim, you agree to contact us at support@plottwist.app to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes within 30 days.
14.3.1. If informal resolution fails, you agree that any dispute, claim, or controversy arising from or relating to these Terms or the App shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
14.3.2. Arbitration will be conducted in Springfield, Missouri, or another mutually agreed location, or via telephone/video conference.
14.3.3. The arbitrator's decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.
14.3.4. Each party bears its own attorneys' fees and costs, except as awarded by the arbitrator.
YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS.
Either party may seek injunctive or equitable relief in court to protect intellectual property rights or prevent unauthorized use of the App.
You may opt out of the arbitration agreement within 30 days of first accepting these Terms by sending written notice to legal@plottwist.app. Opting out does not affect any other provisions of these Terms.
15.1. We reserve the right to modify these Terms at any time.
15.2. Material changes will be communicated via email or in-app notification at least 30 days before taking effect.
15.3. Your continued use of the App after changes become effective constitutes acceptance of the modified Terms.
15.4. If you do not agree to modified Terms, you must stop using the App and cancel your subscription.
15.5. The "Effective Date" at the top of these Terms indicates when they were last updated.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PlotTwist regarding the App and supersede all prior agreements and understandings.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to reflect the parties' intent to the maximum extent permitted by law.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or internet/telecommunications failures.
The App is subject to U.S. export control laws. You agree not to export, re-export, or transfer the App in violation of such laws.
If you are a U.S. government entity, the App is "Commercial Computer Software" as defined in FAR 12.212 and DFARS 227.7202, and your rights are limited to those granted in these Terms.
These Terms do not create any third-party beneficiary rights except as expressly stated regarding app store providers.
