Following the refusal of planning permission, an applicant's rights are:

Appeal to the Secretary of State. If you do not agree with the decision made by the council, you can lodge an appeal with the Secretary of State.

Twelve weeks for a Householder planning application, Minor Commercial and Householder prior approval applications.

Eight weeks for applications for advertisement consent. You may need to apply for advertisement consent to display an advertisement with or without illumination outside your property or business premises.

6 months: Full (excluding Householder and Minor Commercial applications), prior approval applications. There is no time limit for Certificate of lawful development (proposed/existing) applications.

Time frame for an enforcement notice. An appeal against an enforcement notice must be received before the effective date of the notice. The effective date of the notice will be on the notice.

Who can appeal against an enforcement notice? If you rent, own, or lawfully occupy the property or land you should be able to appeal.

What is an Enforcement Notice?

If the enforcement officer of your local council feel that a development may have been carried out without the correct, or any planning permission, (or in breach of planning control) they may issue an Enforcement Notice.
