This Privacy Policy (this "Policy") describes how the operator of Pixova AI: Video Maker (the "Company", "we", "us", or "our") collects, processes, discloses, and retains information in connection with the Pixova AI: Video Maker mobile application and any related features and services (collectively, the "Service").
This Policy forms part of, and should be read together with, our Terms of Service. By installing, accessing, or using the Service, you acknowledge that you have read and understood this Policy.
1. Definitions
1.1 "Input Content" means images, video files, text prompts, and other media that you submit to the Service for processing or generation.
1.2 "Output" means the video, image, or other media produced by the Service in response to your Input Content.
1.3 "Device Data" means technical information automatically generated by or associated with your device, as further described in Section 3.2.
1.4 "Advertising Identifier" means a resettable identifier provided by your operating system (such as the Android Advertising ID) used for advertising and measurement purposes.
1.5 "Processing" means any operation performed on information, including collection, transmission, storage, use, disclosure, and deletion.
2. Scope and Data Minimization
2.1 This Policy applies solely to information Processed by us through the Service. It does not apply to third-party products, websites, or services that we do not control.
2.2 The Service is designed on a principle of data minimization. We limit our Processing to what is reasonably necessary to (a) deliver the AI-powered features you request; (b) operate, maintain, and secure the Service; and (c) comply with our legal obligations.
3. Categories of Information We Process
3.1 Content You Provide for AI Processing
When you use the generative or editing features of the Service, you may submit Input Content, which may include photographs, video files, and text prompts. The handling of Input Content is described in Section 4.
3.2 Information Collected Automatically
To operate and secure the Service, we may Process Device Data, which may include:
(a) IP address and approximate, network-derived location;
(b) device model, operating system, and system configuration;
(c) in-app activity and feature-usage events;
(d) diagnostic information, crash reports, and performance logs; and
(e) Advertising Identifiers.
3.3 Support Communications
If you contact us, we Process the email address you use and the contents of your communication solely to respond to and administer your request.
We do not require you to create an account in order to use the core features of the Service, and we do not knowingly Process special categories of personal data except as incidental to media you choose to submit (see Section 4.3).
4. Handling of User-Provided Content (AI Features)
4.1 Purpose Limitation
Input Content is transmitted, in a secured manner, to cloud-based processing infrastructure for the sole purpose of generating the Output you request. Input Content is not repurposed for unrelated objectives.
4.2 No Use for Model Training
We do not use your Input Content or Output to train, fine-tune, or develop shared or general-purpose artificial-intelligence models, and we do not use such content to improve the Service for other users. Where any future use of your content for model training would be contemplated, we will first obtain your separate, affirmative consent or rely on another lawful basis as required by applicable law.
4.3 Media Containing Faces
Where Input Content includes human faces, the following limitations apply:
(a) we do not perform biometric identification or recognition of individuals;
(b) we do not create, derive, or maintain any facial-recognition database; and
(c) facial features are referenced only to the extent technically necessary to apply the visual effect or transformation you have requested.
4.4 Retention and Deletion of Content
Input Content and Output are removed from active processing systems after the requested operation is completed, except where temporary retention is necessary for system integrity, abuse prevention, or compliance with a legal obligation. General retention practices are described in Section 8.
5. Purposes and Legal Bases for Processing
5.1 We Process information for the following purposes: (a) producing the Output you request; (b) operating, maintaining, securing, and improving the Service; (c) detecting, preventing, and investigating fraud, abuse, and security incidents; (d) responding to your inquiries; and (e) complying with applicable law.
5.2 Where you are located in the European Economic Area, the United Kingdom, or another jurisdiction requiring a stated legal basis, we rely on one or more of the following: (a) your consent; (b) performance of a contract or your request for services; (c) our legitimate interests in operating and securing the Service; and (d) compliance with a legal obligation. You may withdraw consent at any time, without affecting the lawfulness of Processing already carried out.
5.3 We do not engage in unauthorized tracking, behavioral profiling, or automated decision-making producing legal or similarly significant effects.
6. Advertising and Advertising Identifiers
6.1 The Service may display advertising delivered through third-party advertising partners, such as Google AdMob and other advertising networks and mediation providers.
6.2 In connection with advertising, such partners may Process Advertising Identifiers, IP address, and ad-interaction data under their own privacy policies. We do not control, and are not responsible for, the independent data practices of these partners.
6.3 We do not sell your personal data. You may limit or reset personalized advertising through your device settings. Where required by law (for example, under the applicable consent framework in the EEA and the United Kingdom), consent for advertising-related Processing will be requested before such Processing occurs.
7. Disclosure of Information
7.1 We do not disclose your information except as set out below.
7.2 Service Providers. We engage infrastructure, cloud-processing, and analytics providers that Process information on our behalf, under contractual obligations restricting their use of that information to the services they provide to us.
7.3 Legal and Safety. We may disclose information where we reasonably believe disclosure is required by law or legal process, or is necessary to protect the rights, safety, or property of users, the public, or the Company.
7.4 Business Transfers. If the Service or the Company is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this Policy or a successor policy.
8. Data Retention
8.1 We retain information only for as long as necessary for the purposes described in this Policy or as required by law. As a general matter: (a) Input Content and Output are removed after Processing, subject to Section 4.4; (b) support communications are retained for the period needed to administer the request; (c) technical and diagnostic logs are typically retained for a limited period (commonly 30 to 90 days); and (d) information necessary for security, fraud prevention, or legal compliance may be retained for a longer period where justified.
8.2 Requesting Deletion. You may request deletion of information relating to you by contacting help@pixovaa8.com. We endeavor to address such requests within seven (7) days, except where a longer period is permitted or required by law.
9. International Transfers
9.1 Your information may be Processed on servers located outside your country or region of residence. Where such transfers occur from the EEA, the United Kingdom, or other jurisdictions imposing transfer restrictions, we implement appropriate safeguards (such as recognized contractual mechanisms) consistent with applicable law.
10. Security
10.1 We implement commercially reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, alteration, disclosure, or destruction. No method of transmission or storage, however, is completely secure, and we cannot guarantee absolute security.
11. Your Rights
11.1 General Rights. Subject to applicable law, you may have the right to access, correct, delete, or restrict the Processing of information relating to you, to object to certain Processing, to data portability, and to withdraw consent. To exercise these rights, contact help@pixovaa8.com.
11.2 California Residents. If you are a California resident, you may request information about the categories and specific pieces of personal information we have collected, request deletion, and opt out of any "sale" or "sharing" of personal information as those terms are defined under California law. We do not sell personal data, and we will not discriminate against you for exercising your rights.
11.3 EEA and United Kingdom Residents. You additionally have the right to lodge a complaint with your local supervisory authority.
12. Children
12.1 The Service is not directed to, and is not intended for use by, children under the age of 13 (or such higher age as may apply in your jurisdiction). We do not knowingly collect personal data from children under that age. If we become aware that such data has been collected without appropriate authorization, we will take steps to delete it.
13. App Permissions
13.1 To enable specific features you choose to use, the Service may request the following device permissions:
(a) camera — to capture media within the app;
(b) photos and media/storage — to allow you to select or save files;
(c) network access — to transmit Input Content for processing and to deliver Output.
Permissions are requested only where necessary for a feature you elect to use, and may be managed through your device settings.
14. Third-Party Services
14.1 The Service may integrate third-party tools and software development kits (for example, cloud processing, analytics, and advertising). The data practices of these third parties are governed by their own policies, for which we are not responsible.
15. Changes to This Policy
15.1 We may revise this Policy from time to time. Any revised version will be posted with an updated "Last Updated" date. Where required by law, we will provide additional notice of material changes.
