## Who We Are
Sweeply ("we", "us", "our", "the app") is a phone-cleaning application for iOS developed and maintained by Ints Graveris. By downloading, installing, or using Sweeply, you ("you", "user") agree to these Terms and Conditions in full. If you do not agree, please uninstall the app and do not use it.

## 1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Ints Graveris governing your use of Sweeply. These Terms apply to all users of the app, including users of the free tier and users who have purchased lifetime access.
We reserve the right to update these Terms at any time. The "Last updated" date at the top of this page will reflect any changes. Continued use of Sweeply after changes are posted constitutes your acceptance of the revised Terms.

## 2. Description of the App
Sweeply is a device-cleaning application that helps you:
- Find and remove duplicate and similar photos
- Identify and delete screenshots and burst photos
- Locate and remove large videos and files
- Detect and merge duplicate contacts
- View storage usage analytics on your device
All scanning and processing happens locally on your device. Sweeply does not back up, sync, or upload your photos, videos, or contacts to any server.

## 3. Eligibility
You must be at least **13 years of age** to use Sweeply. By using the app you confirm that you meet this requirement. If you are between 13 and 18 years of age, you confirm that you have your parent's or legal guardian's permission to use the app and agree to these Terms.

## 4. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Sweeply on any Apple device that you own or control, solely for your personal, non-commercial purposes.
You may not:
- Copy, modify, distribute, sell, or lease any part of Sweeply
- Reverse-engineer, decompile, or attempt to extract the source code
- Use the app for any unlawful or unauthorised purpose
- Remove any copyright or proprietary notices from the app

## 5. In-App Purchases — Lifetime Access
### 5.1 What You Get
Sweeply offers a one-time **Lifetime Access** purchase that unlocks all premium features permanently, including:
- Unlimited duplicate and similar photo removal
- Large video and file deletion
- Bulk screenshot and burst cleanup
- Full storage analytics dashboard
- Contacts duplicate cleaner
- No ads
### 5.2 Payment
All payments are processed by Apple through the App Store. By completing a purchase you agree to Apple's payment terms. We do not store your payment information.
### 5.3 One-Time Purchase — No Subscription
Lifetime Access is a **one-time payment with no recurring charges**. There is no free trial period. Once purchased, access is permanent for the account that made the purchase.
### 5.4 Refunds
All purchases are final and non-refundable, except where required by applicable law. If you believe you are entitled to a refund under applicable consumer protection law, please contact Apple Support directly, as all payments are handled by Apple.
### 5.5 Restoring a Purchase
If you reinstall Sweeply or use it on a new device with the same Apple ID, you can restore your Lifetime Access at no additional charge using the "Restore previous purchase" option within the app.

## 6. Free Tier Limitations
The free version of Sweeply provides limited access to features. We reserve the right to change which features are available in the free tier at any time without prior notice.

## 7. Permissions and Data Access
Sweeply requests access to your photo library, contacts, camera, and optionally your location. These permissions are used solely to provide the app's core functionality. You can revoke any permission at any time in your device Settings. Revoking a permission will disable the features that depend on it.

## 8. Deletion of Content — Your Responsibility
Sweeply helps you identify and delete files from your device. **All deletions are permanent and cannot be undone within the app.** Once you confirm a deletion:
- Photos and videos are removed from your iOS photo library
- Files are permanently deleted from your device storage
- Contacts are merged or deleted from your address book
We strongly recommend reviewing all items carefully before confirming any deletion. We accept no liability for the accidental deletion of content you intended to keep.
You are solely responsible for maintaining backups of any content you wish to preserve. We recommend enabling iCloud Photos or another backup service before running any cleanup.

## 9. AI Features
Sweeply uses the Google Gemini API to power certain intelligent analysis features. When these features are active, limited data (such as a compressed photo representation) may be sent to Google's API solely for the purpose of analysis. No data is stored by Google beyond the API call. Use of these features is subject to Google's Terms of Service.

## 10. Intellectual Property
All content, design, code, graphics, logos, and other materials within Sweeply are the exclusive property of Ints Graveris or are used under license. Nothing in these Terms transfers any intellectual property rights to you.
"Sweeply" and its logo are proprietary. You may not use our name, logo, or branding in any way without our prior written consent.

## 11. Prohibited Conduct
You agree not to use Sweeply to:
- Violate any applicable local, national, or international law or regulation
- Delete content belonging to another person without their authorisation
- Attempt to interfere with, disrupt, or gain unauthorised access to any system
- Use the app in any way that could damage, disable, or impair its functioning
- Engage in any conduct that is fraudulent, harmful, or objectionable

## 12. Disclaimer of Warranties
Sweeply is provided **"as is"** and **"as available"** without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The app will be uninterrupted, error-free, or free of viruses or other harmful components
- The results obtained from using the app will be accurate or reliable
- Any errors in the app will be corrected
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

## 13. Limitation of Liability
To the maximum extent permitted by applicable law, Ints Graveris shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data, photos, videos, or contacts
- Loss of revenue or profits
- Damage to your device
- Any other intangible losses
arising out of or in connection with your use of Sweeply, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or relating to these Terms or the use of Sweeply shall not exceed the amount you paid for Lifetime Access, or **$10.00 USD** if no purchase was made.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. If you are in such a jurisdiction, some of the above limitations may not apply to you.

## 14. Indemnification
You agree to defend, indemnify, and hold harmless Ints Graveris from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:
- Your use of or inability to use Sweeply
- Your violation of these Terms
- Your violation of any third-party right, including intellectual property rights
- Any content you delete or modify using the app

## 15. Third-Party Services
Sweeply integrates with the following third-party services:

## 16. App Store — Additional Terms
Because Sweeply is distributed via the Apple App Store, the following also applies:
- These Terms are between you and Ints Graveris only, not Apple
- Apple has no obligation to provide any maintenance or support for Sweeply
- In the event of any failure of Sweeply to conform to any applicable warranty, you may notify Apple, and Apple will refund your purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation
- Apple is not responsible for addressing any claims by you or a third party relating to Sweeply
- Apple is a third-party beneficiary of these Terms and may enforce them against you

## 17. Governing Law
These Terms are governed by and construed in accordance with the laws of **Latvia**, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Latvia.
If you are a consumer in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

## 18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable.

## 19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ints Graveris regarding Sweeply and supersede all prior agreements or understandings.
