These Terms & Conditions (“Terms”) govern your access to and use of the Pivot VPN website located at pivotvpn.net (the “Website”), the Pivot VPN mobile applications, software, network, servers, features, and related services (collectively, the “Service”).
These Terms form a legally binding agreement between you and Hwilo for technical solutions, trading as Pivot VPN (“Pivot VPN,” “we,” “us,” or “our”), with its registered address at Building 20/46, Ain Shams, Marg, Cairo, Egypt.
By accessing or using the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not access or use the Service.
1. Eligibility
You may use the Service only if:
you are at least 18 years old, or the age of legal majority in your place of residence, whichever is higher;
you have the legal capacity to enter into a binding agreement; and
your access to and use of the Service is not prohibited by applicable law.
If you use the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you are authorized to bind that entity to these Terms. In that case, “you” means both you and that entity.
2. About the Service
Pivot VPN is a privacy and network security service that helps route internet traffic through supported VPN infrastructure. The Service may include, without limitation:
VPN access;
mobile and desktop applications;
account management features;
server and location selection;
speed test and connection diagnostics;
free and paid subscription plans;
device management;
support and account-related tools.
The Service may change over time. We may add, remove, improve, limit, or discontinue any feature, server location, protocol, or functionality at any time.
3. Account Registration and Security
Some parts of the Service may require you to create an account.
You agree to:
provide accurate, current, and complete information;
keep your credentials secure and confidential;
promptly update your information if it changes;
accept responsibility for all activity under your account; and
notify us immediately of any suspected unauthorized access or security breach.
You may not sell, rent, transfer, sublicense, share, or otherwise make your account available to any third party except where we expressly allow this within the Service.
We may require reasonable verification of account ownership before providing account-related support, restoring access, processing requests, or taking security actions.
4. Plans, Free Access, and Paid Access
Pivot VPN may offer:
a free plan with limited features, traffic, devices, locations, or availability;
paid subscriptions with recurring billing; and
promotional trials, discounts, introductory offers, or temporary access programs.
Features available under each plan may change from time to time.
Paid subscriptions, billing, renewal, cancellation, and refunds are governed by our Subscription & Refund Policy, which forms part of these Terms. In the event of a conflict between these Terms and the Subscription & Refund Policy regarding billing matters, the Subscription & Refund Policy will control.
5. License to Use the Service
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the Service for your personal, lawful, and non-commercial use, unless we expressly agree otherwise in writing.
You do not acquire any ownership rights in the Service, software, Website, or related intellectual property.
6. Acceptable Use Policy
You may use the Service only in a lawful, responsible, and non-abusive manner.
You must not use the Service to:
violate any applicable law, regulation, court order, or third-party right;
commit fraud or impersonation;
distribute malware, ransomware, spyware, viruses, or other malicious code;
conduct phishing, credential theft, identity theft, or social engineering attacks;
send spam or bulk unsolicited communications;
perform denial-of-service attacks, botnet activity, abusive automated requests, or attempts to overload networks, systems, or infrastructure;
probe, scan, exploit, or interfere with systems, services, or networks without authorization;
host, distribute, access, promote, or facilitate illegal content;
exploit, endanger, or abuse minors in any form;
infringe intellectual property rights;
attempt to hide, facilitate, or support criminal conduct;
resell, lease, sublicense, or commercially exploit the Service without our written permission;
abuse free access, trial access, promotional offers, or refund processes;
create multiple accounts or automated sessions in a way that unreasonably burdens the Service;
interfere with, bypass, or undermine our security, fraud-prevention, account-limiting, or technical protection measures;
use the Service in a way that materially harms other users, our infrastructure, our partners, or our reputation.
You also must not reverse engineer, decompile, modify, copy, create derivative works from, tamper with, or attempt to extract source code from any part of the Service, except where such restriction is prohibited by applicable law.
We may establish technical, operational, or fair-use limits to protect the Service and users. If your usage creates unusual load, threatens stability, appears automated or abusive, or materially degrades the experience of others, we may limit, suspend, or terminate access.
7. Prohibited Content and Zero-Tolerance Conduct
The following is strictly prohibited and may result in immediate suspension or termination, reporting to relevant parties, and refusal of refund where permitted by law:
child sexual abuse material or any exploitative material involving minors;
trafficking in illegal goods or services;
malware deployment or cybercrime infrastructure;
targeted harassment, threats of violence, or credible unlawful threats;
deliberate infringement of law through use of the Service;
repeated or serious abuse of our systems or third-party systems.
8. Device Access and Account Limits
The Service may allow use across one or more devices depending on your plan.
We may set or change limits relating to:
number of devices;
number of simultaneous connections;
traffic allocation;
available server locations;
speed or bandwidth prioritization;
available protocols or technical features.
You may not circumvent these limitations.
9. Software, Updates, and Compatibility
Use of the Service may require software, apps, configurations, or updates provided by us or by third parties.
You agree that:
we may release patches, updates, fixes, and compatibility changes;
some updates may be necessary for security, legal compliance, or continued functionality;
the Service may not work on every device, network, operating system, or configuration; and
performance may vary depending on your device, ISP, local network, location, destination service, selected server, and other external factors.
10. Support
Support may be available through hwilo.app.dev@gmail.com, in-app tools, or other support channels we provide.
We may request information reasonably necessary to verify your identity, diagnose technical issues, or process account-related requests. You are responsible for ensuring that information you provide to support is accurate and lawful.
Unless expressly stated otherwise, support is provided on a commercially reasonable basis and without guaranteed response times.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we process personal data and other information. By using the Service, you acknowledge that such processing may occur in accordance with the Privacy Policy.
12. Intellectual Property
The Website, Service, software, branding, design, text, graphics, interfaces, trademarks, logos, and all related intellectual property are owned by Pivot VPN or its licensors and are protected by applicable intellectual property laws.
Except as expressly allowed in these Terms, you may not:
copy, reproduce, republish, distribute, display, sell, license, or exploit any part of the Service;
use our name, trademarks, logo, or branding without prior written consent;
remove or alter copyright, trademark, or proprietary notices.
13. Feedback
If you send us suggestions, ideas, recommendations, bug reports, reviews, or other feedback regarding the Service (“Feedback”), you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free right to use, reproduce, modify, adapt, publish, and otherwise exploit that Feedback for any lawful purpose without compensation to you.
14. Third-Party Services and Links
The Service may contain links to third-party websites, tools, payment processors, app stores, analytics providers, support tools, or external services. We do not control and are not responsible for third-party services, content, terms, or privacy practices.
Your use of third-party services is at your own risk and subject to the terms of those third parties.
15. Suspension and Termination
We may suspend, restrict, or terminate your access to all or part of the Service immediately, with or without notice, if:
you breach these Terms;
your use creates legal, security, technical, or operational risk;
we suspect fraud, abuse, or unauthorized access;
we are required to do so by law, court order, regulator, payment provider, app marketplace, hosting provider, or infrastructure partner; or
continued provision of the Service is no longer commercially or technically viable.
You may stop using the Service at any time. If you wish to cancel a paid subscription, you must follow the cancellation steps described in the Subscription & Refund Policy and, where applicable, the relevant app store’s billing rules.
Termination does not affect rights or obligations that by nature should survive termination, including provisions on payment, acceptable use, intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution.
16. Service Disclaimer
Pivot VPN is provided as a privacy and security tool. It is not sold or described as a tool for unlawful conduct.
We do not guarantee that the Service will:
be uninterrupted, error-free, or always available;
meet your expectations in every location or on every network;
achieve any specific speed, latency, or performance level;
work with every app, website, streaming platform, payment provider, network, or online service;
bypass geo-restrictions, content restrictions, censorship systems, or third-party blocking measures;
prevent all tracking, profiling, fingerprinting, malware, surveillance, or cyber threats;
make you anonymous or invisible online.
Your online privacy and security also depend on factors outside our control, including browser settings, operating system behavior, installed software, account activity, cookies, device fingerprinting, ISP practices, destination websites, and third-party services.
You are solely responsible for ensuring that your use of the Service complies with the laws and regulations applicable to you and with the terms of any third-party service you access.
17. Warranty Disclaimer
To the maximum extent permitted by law, the Website and Service are provided on an “as is” and “as available” basis.
We disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, reliability, or accuracy.
We do not warrant that defects will be corrected or that the Service will always be secure, available, or free from harmful components.
Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law.
18. Limitation of Liability
To the maximum extent permitted by law, Pivot VPN and its affiliates, officers, directors, employees, contractors, licensors, partners, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, use, or opportunity, arising out of or related to your use of or inability to use the Service.
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of:
the amount you paid us for the Service during the 12 months preceding the event giving rise to the claim; or
EUR 100.
This limitation applies regardless of the form of action and even if a remedy fails of its essential purpose.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable law.
19. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Pivot VPN and its affiliates, officers, directors, employees, contractors, and partners from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or related to:
your use or misuse of the Service;
your breach of these Terms;
your violation of applicable law;
your violation of any third-party right; or
activity occurring through your account or devices due to your failure to maintain account security.
20. Changes to the Service or Terms
We may change the Service and these Terms from time to time.
If we make material changes to these Terms, we may provide notice by updating the Website, within the app, through your account, or by email where appropriate. The updated Terms become effective on the stated effective date. By continuing to use the Service after the updated Terms become effective, you agree to the revised Terms.
If you do not agree to the revised Terms, you must stop using the Service.
21. Governing Law and Dispute Resolution
These Terms are governed by the laws of Egypt, excluding conflict-of-law rules.
If you are a consumer, nothing in these Terms deprives you of mandatory consumer protections available under the laws of your country of residence.
Before filing a formal claim, you agree to contact us at hwilo.app.dev@gmail.com and try to resolve the dispute informally.
Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Building 20/46, Ain Shams, Marg, Cairo, Egypt, unless applicable consumer law requires otherwise.
22. Export, Sanctions, and Restricted Use
You may not use the Service if such use would violate export control laws, sanctions laws, or other applicable trade restrictions. You represent and warrant that you are not prohibited from receiving the Service under applicable law.
23. Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, and Subscription & Refund Policy, form the entire agreement between you and Pivot VPN regarding the Service.
Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
No Waiver
Failure to enforce any provision is not a waiver of that provision or any other provision.
Assignment
We may assign or transfer our rights and obligations under these Terms as part of a merger, acquisition, restructuring, asset sale, or by operation of law. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
Force Majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including infrastructure failures, internet outages, acts of government, natural disasters, labor disputes, war, terrorism, sanctions, epidemics, or failures of suppliers and service providers.
