Welcome to Photopea. By downloading, accessing, or using our app (the "App"), you agree to these Terms & Conditions ("Terms"). If you do not agree, please do not use the App.
By using Photopea, you confirm that:
You have read and understood these Terms
You agree to comply with them
You are at least 13 years old (or the minimum age required in your jurisdiction) and legally capable of entering into this agreement
If you are a minor, your parent or legal guardian has reviewed and agreed to these Terms on your behalf
Photopea grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes on devices you own or control, in accordance with the Apple Media Services Terms of Use.
You agree not to:
Use the App for illegal, infringing, or unauthorised purposes
Copy, modify, decompile, disassemble, or reverse-engineer the App
Interfere with or circumvent App functionality, security, or usage limits
Tamper with, spoof, or automate requests to our servers, or attempt to bypass subscription, credit, or daily-limit checks
Use the App to create content that is unlawful, defamatory, hateful, harassing, sexually explicit, or that depicts minors inappropriately
Upload images of other people without their permission, or create misleading deepfakes or impersonations of real individuals
Resell, sublicense, or redistribute access to the App or its outputs as a competing service
You may upload images, prompts, and other content to use App features.
By doing so:
You retain ownership of your content
You grant us a limited, temporary, worldwide licence to host, transmit, and process your content solely to deliver the features you request
You confirm that you own the content or have all necessary rights and consents to use it, including the consent of any identifiable person appearing in it
You accept that this licence ends when processing completes and your content is deleted from our servers
We do not claim ownership of your images and do not use them to train AI models. See our Privacy Policy for details.
Photopea uses AI-based technologies to process images and generate outputs.
Results are automatically generated and may be inaccurate, unexpected, distorted, or not match your prompt
AI output is probabilistic; identical prompts may produce different results, and we do not guarantee any specific outcome
Subject to your compliance with these Terms, you may use the images you generate for personal purposes; you are solely responsible for how you use them
You must not present AI-generated content as authentic photography where doing so would deceive or harm others
We may refuse, block, or filter requests that appear to violate these Terms or applicable law
If your content includes faces:
It is processed only to apply the effects or transformations you request
We do not identify individuals or create biometric data or faceprints
Images are processed temporarily and are not stored long-term on our servers

The App provides a limited number of free generations. Once exhausted, you may continue by subscribing or, where offered, by watching a rewarded advertisement to earn additional credits.
Free allowances, credit costs, daily limits, and rewarded-ad availability are set by us and may be changed, reduced, or withdrawn at any time without notice.
Credits earned through rewarded ads have no monetary value, are non-transferable, are not redeemable for cash, and may expire.
The App displays advertisements supplied by third-party ad networks. We do not control and are not responsible for advertised products, services, or ad content.
Subscribers may see fewer or no advertisements, subject to the plan purchased.
Attempting to manipulate, spoof, or automate ad views or usage counters may result in loss of credits and termination of access.
Photopea offers optional auto-renewable subscriptions ("Photopea Pro") and, where available, consumable in-app purchases.
Plans and pricing — Available plans (weekly and yearly, including any discounted or gift offers) and their prices are shown in the App before purchase. Prices are charged in your local currency and may vary by region and over time.
Billing — Payment is charged to your Apple Account at confirmation of purchase. All purchases are processed by Apple; we never handle your payment details.
Auto-renewal — Subscriptions renew automatically at the then-current price for the same period unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period.
Free trials and introductory offers — Where offered, unused portions of a free trial are forfeited if you purchase a subscription during the trial. Trials convert to a paid subscription automatically unless cancelled at least 24 hours before the trial ends. Introductory and promotional pricing applies to the stated period only, after which the standard price applies.
Managing and cancelling — You can manage or cancel your subscription at any time in App Store → your Apple Account → Subscriptions. Cancellation takes effect at the end of the current billing period; you retain access until then. Deleting the App does not cancel your subscription.
Refunds — All purchases are final and non-refundable except where required by law. Refunds are handled solely by Apple under the Apple Media Services Terms of Use; we cannot issue or guarantee refunds. Requests can be made at reportaproblem.apple.com.
Restoring purchases — You can restore an existing subscription on a new or reset device using the "Restore Purchases" option in the App with the same Apple Account.
Price changes — We may change subscription prices. Where required, Apple will notify you and, depending on the change, ask for your consent before the next renewal. You may cancel if you do not accept a new price.
All rights in the App, including its design, features, source code, technology, artwork, sample images, animations, and branding, are owned by us or our licensors and are protected by intellectual property laws.
You may not:
Copy, redistribute, or create derivative works from any part of the App
Extract or reuse our sample images, templates, icons, or assets outside the App
Use our name, logo, or branding without prior written permission
The App integrates third-party services, including Apple (payments), Google Firebase (analytics, crash reporting, and configuration), and Google AdMob (advertising). Your use of these services is also governed by their own terms and privacy policies.
We are not responsible for:
Their content, availability, or accuracy
Their privacy or data practices
Any loss or issue caused by third-party services
We may add, modify, suspend, or discontinue features, tools, limits, or offers at any time
We may require you to install an update to continue using the App, and may block outdated versions where necessary for security or compatibility
Server-side AI processing depends on third-party infrastructure and may be temporarily unavailable, rate-limited, or slower than usual
We reserve the right to suspend, restrict, or terminate your access to the App or its services, with or without notice, if you violate these Terms, misuse the App, or attempt to circumvent limits or payments. On termination, your licence ends immediately. Termination does not entitle you to a refund of any unused subscription period except where required by law.
You may terminate these Terms at any time by cancelling any subscription and uninstalling the App.
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee:
Error-free or uninterrupted operation
Continuous availability of the App or its AI features
The accuracy, quality, or suitability of AI-generated results
That your generated images will be preserved; you are responsible for saving and backing up anything you wish to keep
To the fullest extent permitted by law:
We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from your use of the App
This includes data loss, deleted or corrupted images, incorrect or offensive AI results, missed credits, and service interruptions
Our total aggregate liability for any claim relating to the App will not exceed the greater of (a) the amount you paid us for the App in the twelve months preceding the claim, or (b) USD 50
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence or for fraud.
You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your content, your use of AI-generated output, or your breach of these Terms or of any third party's rights.
You acknowledge that:
These Terms are between you and us, not with Apple, and Apple is not responsible for the App or its content
Apple has no obligation to provide maintenance or support for the App
In the event of a failure to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; Apple has no other warranty obligation
Apple is not responsible for addressing any claim relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims
Apple is not responsible for the investigation, defence, settlement, or discharge of any third-party intellectual property infringement claim relating to the App
You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you
We may update these Terms at any time.
Updates will be posted here with a new "Last Updated" date
Where changes are material, we will provide reasonable notice within the App
Continued use of the App after an update means you accept the revised Terms
These Terms are governed by the laws applicable in your jurisdiction of residence, without regard to conflict-of-law principles. Where permitted, disputes will first be addressed informally by contacting us at the address below; we aim to resolve issues within 30 days before any formal proceedings.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce a right does not waive it. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
