These Terms of Use ("Terms") govern your use of the Photo Collage Maker app (the "App"), provided by Goutom Dhar, an independent developer ("we", "us", "our"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
The App is licensed to you through the Apple App Store. Apple's Licensed Application End User License Agreement ("Apple Standard EULA") applies to your use of the App, together with these Terms. If these Terms conflict with the Apple Standard EULA, these Terms apply to the extent permitted by Apple. Apple is not a party to these Terms and is not responsible for the App or its content, maintenance, support or warranty. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for lawful purposes. You do not acquire ownership of the App or its content.
The App offers free features. The free version may show advertisements and may add a watermark to exported collages.
Pro access unlocks additional features such as premium templates, fonts, stickers and frames, HD export, and removal of the watermark and ads. Features offered under Pro may change over time.
We may offer promotions, free trials and special offers. These may be limited in time or availability.
Plans. Pro may be offered as an auto-renewing subscription (for example weekly, monthly or yearly) and/or as a one-time "lifetime" purchase. The plans, prices and any free-trial or introductory offer available to you are shown on the purchase screen before you confirm, in your local currency.
Payment. Payment is charged to your Apple ID account when you confirm the purchase (or at the end of a free trial or introductory period, if one applies).
Automatic renewal. Subscriptions renew automatically at the price shown for the same period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
Free trials. If a free trial is offered, a trial is available once per eligible Apple ID. Any unused part of a free-trial period is forfeited when you purchase a subscription. If you do not cancel at least 24 hours before the trial ends, you will be charged for the first paid period.
Managing and cancelling. You can manage or cancel subscriptions at any time in Settings > [your name] > Subscriptions on your device, or in the App Store account settings. Deleting the App does not cancel a subscription.
Lifetime purchase. A lifetime purchase is a one-time payment with no recurring charge. "Lifetime" means for as long as the App and the purchased feature remain available.
Refunds. All payments are processed by Apple. We cannot issue refunds directly. You can request a refund from Apple at reportaproblem.apple.com, subject to Apple's policies and applicable law.
Restore. You can restore previous purchases using "Restore" in the App on a device signed in to the same Apple ID.
Price changes. We may change prices for future periods. Apple will notify you where required, and you can cancel before a new price takes effect.
You choose the photos you use in the App. Photos and collages are processed and stored on your device and are not uploaded to our servers (see the Privacy Policy for details of the limited data the App does send).
You keep ownership of your photos and of the collages you create.
You are responsible for having the right to use any photos you add, and for what you create and share. Do not use the App to create or share content that is unlawful, infringing, hateful, harassing, sexually exploitative, or that violates others' privacy or intellectual property rights.
AI-generated images. AI stickers and backgrounds are created with Apple's Image Playground, which is available only on supported devices with Apple Intelligence turned on. Results may be inaccurate, unexpected or inappropriate. You are responsible for what you ask it to create and for how you use the results, and Apple's terms apply to the creation of the images. We do not review images you generate and do not claim ownership of them.
You may use collages you create for personal and commercial purposes, subject to the rights of third parties in any photos or content you include and to the licenses described in Section 6.
The App may include templates, frames, stickers and fonts that we provide, and stock photos provided by Unsplash. Unsplash photos are subject to the Unsplash License and remain the property of their photographers.
The free version may display advertisements from third parties. We do not control or endorse advertisers and are not responsible for their content or products.
The App may link to third-party websites or services. We are not responsible for them.
Our use of third-party services is described in the Privacy Policy.
You agree not to: (a) copy, modify, decompile, reverse engineer or attempt to extract the source code of the App, except as permitted by law; (b) remove or alter copyright, trademark or watermark notices, or circumvent or disable security, purchase verification or access-control features, including to access Pro features without payment; (c) use bots, scrapers or automated means against the App or our services; (d) interfere with or overload the App or our services; (e) use the App to violate any law or the rights of others; or (f) resell, rent or redistribute the App or our content other than as part of your own creations as permitted in Section 5.
If you allow notifications, we may send reminders and tips (for example about unfinished collage drafts or features you may like). You can turn notifications off at any time in your device Settings.
The App and its content, including software, design, templates, frames, stickers, graphics and text, are owned by us or our licensors and are protected by intellectual property laws. Except for the license in Section 2 and your rights in your own creations, no rights are granted to you.

To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the App will be uninterrupted or error-free, or that features such as AI cutout, AI stickers or automatic layouts will produce results suited to your needs. Keep a copy of photos you care about; we are not responsible for data loss on your device.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data or profits, arising from your use of the App. Our total liability to you for any claim relating to the App will not exceed the amount you paid us through the App in the 12 months before the claim arose, or USD 100 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law, and you may have consumer rights under your local law that these Terms do not affect.
To the extent permitted by law, you agree to indemnify us against claims arising from content you create or share using the App or from your breach of these Terms.
We may suspend or end your access to the App if you breach these Terms. You may stop using the App at any time. Sections that by their nature should survive termination will survive.
If you believe content in the App infringes your copyright, email us at goutom.developer@gmail.com with your contact details, a description of the work and the allegedly infringing content, and a statement that you have a good-faith belief the use is unauthorized.
These Terms are governed by the laws of the Republic of Bangladesh, without regard to conflict-of-law rules, except where mandatory consumer-protection law of your country of residence applies. Before starting any formal proceeding, please contact us at the email below so we can try to resolve the issue informally.
We may update these Terms or the App from time to time. We will post the updated Terms here and update the effective date. Continued use of the App after an update means you accept the updated Terms.
