These Terms of Service and End-User Licence Agreement (“Terms”) are a legal agreement between you and Phone Dipping in British Columbia, Canada (“Phone Dipping,” “we,” “us,” or “our”) for the Phone Dipping iOS application, website and related service (together, the “Service”). They are not an agreement with Apple Inc. (“Apple”).
By tapping “Accept and continue,” creating content, voting, or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service. Contact: no1pine@hotmail.com.
You must be at least 13 years old. If you have not reached the age of legal majority where you live, a parent or guardian must review and agree to these Terms and supervise waterside activity. You may not use the Service if law prohibits you from doing so.
The Service is not in Apple’s Kids Category and is not designed for unsupervised children.
Phone Dipping lets people create privacy-protected surface locations (“Dip Spots”), share underwater photos and user-reported observations (“Dips”), browse a community map, vote in a monthly recognition contest, report content, block users, and optionally purchase Pro creator tools.
The Service is for media sharing. It is not a navigation chart, weather service, depth sounder, hazard map, emergency service, scientific instrument, wildlife guide, or substitute for local rules and professional safety advice. Locations, depths, temperatures, conditions, observations and safety notes are supplied by users and may be incomplete, outdated or wrong.
The Service may create an anonymous account identifier automatically. You may optionally secure that account with Sign in with Apple. You are responsible for your device, Apple Account and activity under your account. Do not sell, transfer, lend or share account access.
Tell us promptly at no1pine@hotmail.com if you believe an account is compromised. We may restrict, suspend or terminate an account to protect users, investigate abuse, comply with law or enforce these Terms.
You may delete the account in Me → Delete my account and content. Account deletion does not cancel an Apple subscription; manage subscriptions separately through Apple.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the App on Apple-branded products you own or control, as permitted by the Apple Media Services Terms and Conditions Usage Rules. The App may also be accessed by other accounts associated with the purchaser through Apple Family Sharing or volume purchasing where Apple permits it.
You may not reverse engineer, bypass security or access controls, scrape the Service, interfere with operation, use automated voting, probe for another user’s private information, introduce malware, copy protected design/code except where law permits, or use the Service to build a competing dataset without written permission.
All rights not expressly granted are reserved.
Phone dipping can involve docks, shores, boats, slippery surfaces, currents, waves, cold water, falling objects, fishing gear, wildlife, swimmers, vehicle/vessel traffic and electrical devices. These hazards can cause property loss, environmental harm, serious injury or death.
You agree to:
remain on a stable, lawful and permitted surface;
use a properly closed, depth-rated waterproof phone case appropriate for the intended depth;
secure the device and inspect all equipment before use;
keep equipment and lines away from swimmers, wildlife, vessel routes, propellers, float planes, working docks and restricted areas;
obtain landowner, marina, park, cultural-site or other permission when required;
follow law, posted notices, weather warnings and competent local advice;
avoid trespass and do no damage;
never enter dangerous water, dive, climb, lean over an unsafe edge, operate a device while controlling a moving vehicle/vessel, or take a risk for a photo, vote or contest placement; and
stop immediately if conditions are uncertain.
You voluntarily assume the ordinary and inherent risks of your own waterside choices and equipment use. You remain solely responsible for deciding whether, where and how to make a Dip. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for our own conduct where applicable consumer law prohibits exclusion.
In an emergency, contact local emergency services. The Service and support inbox are not monitored in real time.
You must not submit, promote, solicit or link to content or conduct that:
is illegal, fraudulent, deceptive or encourages dangerous or criminal activity;
is pornographic, sexually exploitative, graphically violent or depicts abuse;
harasses, threatens, bullies, humiliates, hates or discriminates against a person or protected group;
sexualizes, exploits, endangers or identifies a child inappropriately;
reveals another person’s private or precise location, identity or personal information without permission;
infringes copyright, trademark, privacy, publicity or other rights;
impersonates another person or misrepresents ownership, depth, temperature, location, votes or capture circumstances;
is spam, malware, commercial solicitation, vote manipulation or coordinated inauthentic behaviour;
disturbs wildlife, damages habitat, trespasses, or shows unsafe conduct presented for imitation; or
is otherwise objectionable, harmful to the community, or inconsistent with these Terms.
Do not include passwords, payment details or sensitive personal information in posts, reports or support messages.
You keep ownership of User Content you submit. You represent and warrant that you created it or have all permissions needed to submit it; people depicted consent where required; it does not violate law or another person’s rights; and its factual claims are not knowingly false.
You grant Phone Dipping a worldwide, non-exclusive, royalty-free, transferable to our service providers, sublicensable licence to host, store, reproduce, encode, resize, transmit, display, distribute and moderate User Content only as reasonably needed to operate, secure, improve and promote the Service. Promotion outside the ordinary in-App community experience will use public content responsibly; we will seek additional permission before featuring a person-identifiable image in paid advertising where reasonably practicable or legally required.
This licence lasts while the content is on the Service and for a reasonable technical backup period after deletion. It also continues for copies we must keep to meet law, document enforcement, resolve disputes or protect rights. It does not give us ownership of User Content.
Public content may be copied or reshared by other users outside our control. Use Regional or Approximate location unless you deliberately want an Exact public coordinate. Never expose a productive, private, unsafe or culturally sensitive place without permission.
We may use automated rules, access controls, reports and human review to filter, restrict, refuse, remove or preserve content and to suspend accounts. A visible post is not an endorsement and we cannot guarantee that all prohibited content will be detected immediately.
Use Report this Dip for prohibited content. A report hides the Dip for the reporter immediately and enters the moderation queue when online. Use Block this Dipper to remove that author’s content from your map, feed and leaderboard. For urgent moderation concerns, email no1pine@hotmail.com.
We aim to acknowledge moderation/privacy concerns within 24 hours, but response time may vary with severity and available information. We may notify authorities where reasonably necessary to protect a person or comply with law. Abuse of reporting or blocking tools may itself violate these Terms.
The public “Dip of the Month” is a skill/community-recognition feature, not gambling, a sweepstakes or a cash-prize promotion.
Prize: recognition in the App and possible homepage/archive placement only. There is no cash prize, product prize or guaranteed monetary value in version 1.
Entry: submitting an eligible public Dip during the displayed calendar month. No purchase is required to enter or vote.
Voting: one free vote per account, per Dip, per contest month. Purchases never create votes, multiply voting power, boost ranking or influence moderation.
Timing: the contest month is shown in the App. Server time controls eligibility and closing. A Dip belongs to the month derived from its capture/post record under the Service rules.
Selection: after month end, the highest valid vote total is the provisional community favourite. In a tie, the earlier eligible captured time ranks first.
Integrity review: we may remove fraudulent, automated, coordinated, purchased or otherwise invalid votes; disqualify content/accounts that violate these Terms; withhold recognition while reviewing reports; correct a technical error; or name the next eligible Dip.
No guarantee: display, ranking and recognition may change following moderation, deletion, fraud review or correction. Recognition does not mean the location, conduct or factual claims were verified.
Where local law would require registration, a bond, official rules or other treatment inconsistent with a recognition-only feature, we may exclude that location or user. We may modify or discontinue future monthly contests, but will not convert a closed month into a paid contest.
Apple does not sponsor, endorse or administer the contest and is not responsible for it.
Core browsing, posting, reporting, blocking and voting are free. Pro unlocks the creator tools described on the paywall. Subscription options are intended to be:
pd_pro_monthly: one month, automatically renewing; and
pd_pro_annual: one year, automatically renewing.
Prices are localized and confirmed in Apple’s purchase sheet. A seven-day introductory free trial may be available to eligible new subscribers; Apple determines eligibility, and a person generally receives only one introductory offer within the subscription group.
Payment is charged to the Apple Account at confirmation. A subscription automatically renews unless cancelled at least 24 hours before the current period ends. Apple charges renewal according to the displayed terms. Manage or cancel in iOS Settings → Apple Account → Subscriptions. Deleting Phone Dipping does not cancel the subscription. Use Restore purchases to recover an eligible entitlement. Refund requests are handled under Apple’s processes and applicable law.
We may change future pricing or Pro features subject to Apple’s rules and legally required notice/consent. We will provide ongoing value during a paid period. Subscription status may require a network connection to validate, but a temporary service failure does not remove core free functions.
The App, software, brand, interface, graphics and non-user content are owned by or licensed to Phone Dipping and protected by intellectual-property law. “Phone Dipping,” associated artwork and branding may not be used to imply endorsement without permission.
If you believe content infringes your rights, email no1pine@hotmail.com with your contact information, identification of the work/right, the exact Dip or location, a good-faith statement, and evidence of authority. Knowingly false notices may create liability.
If a third party claims that the App or your possession/use of it infringes intellectual property, Phone Dipping—not Apple—is responsible for investigating, defending, settling and discharging the claim to the extent required by these Terms or law.
The Service depends on Apple, Supabase, RevenueCat, network providers, maps and hosting/email providers. Your use must comply with applicable third-party terms, including the Apple Media Services Terms and carrier/network terms. Third-party services may change or fail outside our control. Their own terms and privacy policies govern their independent activities.
We may maintain, update, limit or discontinue all or part of the Service. We do not guarantee uninterrupted availability, permanent retention of community content, a particular number of users/Dips, or that a given Spot is lawful or safe to access. Use the offline cache as a convenience, not as a sole archive of an important photo.
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, quiet enjoyment and availability. We do not warrant that user content, votes, locations, depths, temperatures, safety notes, signed photo URLs or contest results are accurate, safe, complete or uninterrupted.
Some jurisdictions do not allow certain exclusions, so those exclusions apply only to the extent lawful. Statutory consumer rights remain unaffected.
If the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price for the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Phone Dipping is responsible for other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty, to the extent required by law.
To the maximum extent permitted by law, Phone Dipping and its personnel will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages; loss of data, profits, goodwill or opportunity; device/equipment loss; or harm caused by reliance on user-reported information, even if advised of the possibility.
To the maximum extent permitted by law, total aggregate liability arising from the Service will not exceed the greater of (a) the amount you paid to Phone Dipping through the App during the 12 months before the event giving rise to the claim, or (b) CAD $100.
These limits do not apply where prohibited, including to liability that cannot be limited for fraud, wilful misconduct, gross negligence, personal injury or applicable consumer rights.
To the extent permitted by law, you will indemnify and hold Phone Dipping and its personnel harmless from third-party claims, damages and reasonable costs arising from your unlawful conduct, your User Content, your material breach of these Terms, or your infringement of another person’s rights. This does not require indemnification for our own unlawful conduct and does not limit non-waivable consumer rights.
Phone Dipping—not Apple—is responsible for addressing claims relating to the App or your possession/use, including product-liability claims, claims that the App fails to meet a legal/regulatory requirement, and consumer-protection/privacy claims, except where law assigns responsibility otherwise.
You may stop using and delete the account at any time. We may suspend or terminate access, remove content or preserve evidence if we reasonably believe it is necessary for safety, security, legal compliance, investigation or enforcement. Where appropriate, we will provide notice and a way to contact support.
Sections that by nature should survive—content licences for retained copies, moderation records, intellectual property, disclaimers, liability, disputes and Apple terms—survive termination.
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict rules. Subject to non-waivable consumer rights, courts located in British Columbia have jurisdiction.
Before filing a claim, email no1pine@hotmail.com with a concise description and requested resolution so both sides can try in good faith to resolve it for 30 days. This does not prevent urgent injunctive relief, a legally required filing, or a complaint to a regulator.
You and Phone Dipping acknowledge:
these Terms are between you and Phone Dipping only, not Apple; Phone Dipping is solely responsible for the App and its content;
Apple has no obligation to provide maintenance or support for the App;
the licence in section 4 is limited to Apple-branded products and Apple’s Usage Rules;
Phone Dipping, not Apple, is responsible for product, legal, privacy and intellectual-property claims as described above;
you are not located in a country subject to a United States government embargo and are not listed on a United States government prohibited/restricted-party list;
you will comply with applicable third-party agreement terms; and
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you upon your acceptance.
We may update these Terms for future use to reflect Service or legal changes. The “Last updated” date will change. Material changes will receive reasonable notice and renewed acceptance where required. Changes do not retroactively convert a recognition-only closed contest into a paid contest or remove vested statutory rights.
