TERMS OF USE — PDF Editor

These Terms of Use ("Terms") are a legal agreement between you and appmerge ("we," "us," or "our") governing your use of the PDF Editor mobile application and related services (the "App"). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. LICENSE
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device that you own or control, as permitted by the Apple App Store Usage Rules. This license is for your personal or internal business use only.
2. ELIGIBILITY
You must be at least 13 years old (or the minimum age of digital consent in your country) and able to form a binding contract to use the App. If you use the App on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.
3. YOUR CONTENT
You retain all rights to the documents, files, images, signatures, and other content you create, import, or process in the App ("Your Content"). We do not claim ownership of Your Content. Because the App is designed to process files on your device, we do not access Your Content except as described in our Privacy Policy (for example, optional AI features and optional iCloud sync). You are solely responsible for Your Content and for keeping your own backups.
4. SUBSCRIPTIONS, FREE TRIAL, AND BILLING
The App offers auto-renewable subscriptions that unlock premium features.
- Price and billing period are shown in the App before you purchase (for example, a weekly plan). Payment is charged to your Apple ID account at confirmation of purchase.
- Free trial: if a free trial is offered (for example, a 3-day free trial), your subscription begins as a free trial and automatically converts to a paid, auto-renewing subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
- Auto-renewal: subscriptions renew automatically for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Managing and cancelling: you can manage or cancel your subscription and turn off auto-renew in your Apple ID Account Settings after purchase. Deleting the App does not cancel your subscription.
- Refunds: all purchases are processed by Apple and are subject to Apple's refund policies. We do not directly control or issue App Store refunds.
- Price changes: we may change subscription prices; changes apply to future billing periods and, where required, only after notice and your consent as handled by Apple.
5. AI FEATURES
Certain features use artificial intelligence to process text you submit and return generated results. AI output may be inaccurate, incomplete, or unsuitable for your purpose, and it does not constitute legal, financial, medical, or professional advice. You are responsible for reviewing and verifying AI output before relying on it. Do not submit content that you are not permitted to share with a third-party processing service. We may set reasonable usage limits on AI features.
6. ACCEPTABLE USE
You agree not to:
- use the App for any unlawful, infringing, or harmful purpose;
- upload, process, or distribute content that violates the rights of others or applicable law;
- forge, fraudulently alter, or misuse documents or signatures;
- reverse engineer, decompile, disassemble, or attempt to extract source code, except to the extent permitted by law;
- circumvent, disable, or interfere with security, subscription, or licensing features;
- resell, sublicense, rent, or commercially redistribute the App or its outputs except as expressly allowed;
- use automated means to access the App in a manner that burdens our systems.
7. INTELLECTUAL PROPERTY
The App, including its software, design, text, graphics, logos, and other materials (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. Except for the license granted above, no rights are granted to you. "PDF Editor" and appmerge branding may not be used without our permission.
8. THIRD-PARTY SERVICES
The App relies on third-party services (including Apple for the App Store, in-app purchases, Sign in with Apple, iCloud, and notifications; a subscription management provider; an AI processing provider; and analytics/crash-reporting providers). Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services.
9. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT FILE CONVERSIONS OR AI OUTPUTS WILL BE ACCURATE OR COMPLETE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. INDEMNIFICATION
You agree to indemnify and hold us harmless from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Content, your use of the App, or your violation of these Terms or applicable law.
12. TERMINATION
These Terms remain in effect while you use the App. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Upon termination, the license granted to you ends and you must stop using and delete the App. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
13. CHANGES
We may modify these Terms or the App at any time. We will post the updated Terms with a new "Last updated" date and, where appropriate, notify you in the App. Your continued use after changes take effect constitutes acceptance.
14. GOVERNING LAW
These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules, and subject to any mandatory consumer-protection rights available to you in your country of residence.
15. APPLE APP STORE — ADDITIONAL TERMS
These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content. To the extent applicable:
- The license is limited to use on Apple-branded devices under the App Store Usage Rules.
- We, not Apple, are solely responsible for the App and for providing any maintenance and support. Apple has no obligation to furnish support.
- In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- We, not Apple, are responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar laws.
- We, not Apple, are responsible for investigating and resolving any third-party claim that the App or your use of it infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
