Covered Activities

This waiver covers participation in all Panther City Dance LLC events, competitions, lessons, social events, and other related activities, programs, or events organized by the Company or its Hosts, at the listed Hosts or any other venues used by the Company.

Term / Duration of Release

This Liability Release and Waiver shall be valid for a period of one (1) year from the date of execution by the undersigned and shall apply to all Covered Activities occurring during that one-year period, unless earlier revoked in writing by the undersigned. Any participation by the undersigned in Covered Activities after the expiration of this one-year period shall require execution of a new Liability Release and Waiver.

Parties & Hosts Definition

Panther City Dance LLC (the “Company”) shall be referred to as the Company. The term “Hosts” shall include the following named venues: Guitars & Cadillacs, Stagecoach Ballroom, Rodeo Exchange, Billy Bob’s Texas, Lil’ Red’s Longhorn Saloon, Madam Pearl’s Dancehall & Saloon, The Cowboy Palace, Rhinestone Saloon, Cantina Cadillac, and Cowboys Red River. The term “Hosts” also includes any other current venues where the Company conducts events, lessons, competitions, or other activities, whether named or unnamed, and any future venues, locations, or facilities where the Company may conduct such activities, whether named or unnamed.

The term “Releases” shall include the Company, Hosts, judges, co-hosts, volunteers, and their respective affiliates, managers, officers, partners, agents, and employees, and any other persons acting on behalf of the Company or Hosts in connection with events, competitions, lessons, or related activities.

Consideration / Release

In consideration for the consent of the Company and Hosts, and other good and valuable consideration, I, for myself and my heirs and my representatives, hereby waive and release, assume all risks, covenant not to sue, and agree to indemnify and hold harmless the Releases from and against any and all claims for death, personal injury, property damage, or claims for damages of any kind whatsoever, arising directly or indirectly out of my (or any of my invitees’) attendance at events, lessons, competitions, or activities of the Company at any Hosts, including, without limitation, any liability arising from negligence, alcohol consumption, or other risks associated with music, dancing, crowd activities, or use of facilities, whether known or unknown.

Indemnification

I agree that if, despite this waiver and release, and my assumption of all risk, anyone on my behalf makes a claim against any of the Releases, I will indemnify and hold harmless each of the Releases from any litigation expenses, attorney fees, losses, liability, damages, or costs that any may incur as a result of such claim, to the fullest extent permitted by applicable law.

Assumption of Specific Risks & Emergency Services

I understand and acknowledge that my participation in dance competitions and associated activities may involve, but is not limited to, the following risks:

- Slips, trips, or falls on the dance floor or surrounding areas

- Collisions with other participants, staff, or bystanders

- Injuries resulting from dancing, lifting, or physical exertion

- Falls, drops, or injuries resulting from lifts, throws, or aerial/acrobatic dance movements

- Exposure to loud music, lighting effects, or crowded conditions

- Risks associated with alcohol consumption by myself or others

- Damage to personal property or loss of belongings

- Other Risks: I understand and acknowledge that there may be other risks, hazards, or dangers not specifically listed above, and I voluntarily assume all such unnamed or unforeseen risks associated with my participation in events, lessons, competitions, or other activities conducted by the Company at any Hosts.

By signing below, I acknowledge and agree that I am voluntarily assuming all risks described above and any other risks associated with participation in Covered Activities.

Emergency Services Authorization

By signing below, I authorize representatives of the Company, Hosts, or third parties acting in good faith to contact emergency services (including but not limited to paramedics, ambulance, and law enforcement) on my behalf if an injury, accident, or medical emergency occurs.. I further agree I am responsible for any costs associated with emergency response or medical treatment that I (or my invitees) receive as a result of such an incident.

Acknowledgment / Signature

By signing below, I acknowledge that I:
1. Have read this entire Liability Release and Waiver, including the Media Release, Emergency Services Authorization, Assumption of Risk, Release of Liability for NEGLIGENCE, and Indemnification provisions;
2. Understand its terms;
3. Have had the opportunity to consult an attorney if I wish;
4. Intend this to be a complete and unconditional release of all liability permitted by law, including risks associated with alcohol, dancing, lifts, throws, aerial/acrobatic movements, emergency response actions, general venue activities, and media use;
5. Am signing this voluntarily and not under duress.

Media Release

By signing below, I hereby grant the Company and the Hosts, and their affiliates, the irrevocable right to take, use, reproduce, publish, and distribute photographs, video recordings, or other recordings of me or my performance during events, competitions, lessons, or other activities for promotional, marketing, educational, or informational purposes, without compensation, and without further approval or notice.

Governing Law / Jurisdiction (Multi-State)

This Waiver and General Release shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws provisions; provided, however, that for events, competitions, lessons, or other activities held outside the State of Texas, this Waiver and General Release shall be governed by and construed in accordance with the laws of the state in which such event takes place. Any disputes arising under this Waiver shall be brought exclusively in the courts of the state applicable to the event location or, if in Texas, in the state or federal courts located in Tarrant County, Texas.

Severability

If any provision of this Waiver and General Release is held invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect.
