Terms of Service

Welcome to Award Expert. These Terms of Service ("Terms") govern your access to and use of the Award Expert mobile application (the "App") and related services, including the media outlet associated with Award Expert. By using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have the consent of a parent or legal guardian. The App is not intended for children under 13, and if you are under 13, do not use the App. By using the App, you represent and warrant that you meet these requirements.

2. User Accounts

To use certain features, you must create an account by providing an email address (or signing in with Apple or Google), a display name, and a unique username. Your email is used only for authentication and is not visible to other users. You are responsible for safeguarding your login credentials and for all activity on your account. Notify us immediately of any unauthorized access or use.

3. User Content

You may submit content through the App, including predictions, posts, comments, profile information, and curated lists ("User Content"). All User Content is public and viewable by all users. By posting, you grant Award Expert a non-exclusive, royalty-free, worldwide license to use, display, distribute, reproduce, modify, and promote your User Content in connection with the App and related media activities.

This license includes use of User Content in editorial and promotional coverage by Award Expert's affiliated media outlet. You may opt out of future editorial usage of your content via the app’s settings. Opting out does not remove content already published.

You represent that:

• You own or have rights to all submitted content;

• Your content complies with these Terms and the Community Guidelines;

• Your content does not infringe on intellectual property or other legal rights.

4. Community Guidelines

We aim to foster a vibrant and respectful movie-loving community. You agree not to post or engage in behavior that:

• Harasses, bullies, or threatens individuals or groups;

• Includes hate speech or discriminatory content (including racism, homophobia, transphobia, sexism, or other targeted attacks);

• Is sexually explicit, graphically violent, or otherwise inappropriate for a general audience;

• Spams the feed or promotes unrelated commercial activity without permission;

• Misleads or impersonates others;

• Violates intellectual property rights.

• Privacy and sharing of personal information (sometimes referred to as doxing)

• Illegal activity

You may report other users' content as you see fit.

If enough users report a post, it will be automatically censored from public view. We may issue posting suspensions for accounts with repeated violations or whose posts consistently meet the censorship threshold. We reserve the right to remove content and suspend or terminate accounts at our discretion.

5. Intellectual Property

Award Expert and its licensors own all rights in the App and its features (excluding User Content), including the design, branding, and technology. You may not reproduce, copy, modify, or create derivative works based on the App or any of its components without our permission.

The App uses The Movie Database (TMDb) API for movie data and imagery. TMDb content is provided subject to their terms of use.

6. Paid Subscriptions (Award Expert Plus)

Award Expert offers an optional "Plus" subscription tier, available monthly or annually through Apple or Google Play. Plus may include premium features such as additional customization, exclusive content, or advanced prediction tools. Subscriptions are handled through the App and Google Play store platforms and subject to their billing policies.

7. Use of User Content in Media

Award Expert operates a media outlet covering film and awards season. Your posts, predictions, and comments may be quoted, referenced, or featured in this coverage unless you opt out in your settings. Attribution typically includes your name and/or username. Already-published content cannot be retroactively removed, but we will honor opt-outs going forward. You can opt-out of mentions of your posts in our media outlet in the app settings.

8. Account Deletion

You may delete your account by:

• Tapping the menu button in the Home tab

• Going to Settings

• Selecting “Delete Account” at the bottom

When you delete your account:

• Your profile becomes undiscoverable and unviewable by other users

• Your posts and comments are hidden from public view

• Your following/follower data is erased

• Your email is retained to allow you to recover your data

To permanently delete your email and associated data, contact support@oscarexpert.com.

9. Termination

We may suspend or terminate your access at any time for violating these Terms, breaking laws, or engaging in behavior we deem harmful to the community.

10. Disclaimers

The App is provided "as is" and "as available." We make no warranties or guarantees regarding the App’s availability, accuracy, or reliability. Use is at your own risk.

We are not liable for:

• Actions or content of other users

• Interruptions, errors, or bugs in the App

• Decisions or predictions made using the App

11. Limitation of Liability

To the fullest extent permitted by law, Award Expert and its team shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability shall not exceed fifty dollars ($50.00).

12. Modifications to the Terms

We may revise these Terms from time to time. When we do, we’ll notify you in-app in the notifications section and update the "Last updated" date. Continued use of the App after any changes means you agree to the updated Terms.

13. Privacy

Your use of the App is governed by our Privacy Policy. This policy explains how we collect, store, and use your information.

14. Platform Terms

If you download the App via Apple or Google Play, their respective terms also apply:

• Apple: Apple Standard EULA

• Google: Google Play Terms of Service

15. Governing Law

These Terms are governed by the laws of the State of New York. Any disputes will be resolved in the courts located in New York County, New York, unless otherwise required by law.
