1. Introduction

These Terms of Service (“Terms”) govern your use of OneTap | Safe (“the App”), developed by GSDSI (“GSDSI”, “we”, “our”, or “us”).

OneTap | Safe is designed to help users maintain scheduled check-ins and notify trusted contacts when a scheduled check-in is missed.

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree with these Terms, do not use the App.

2. Eligibility

You may use the App only if you are legally permitted to enter into these Terms under the laws applicable to you.

If you enter information about another person or designate another person as a trusted contact, you are responsible for having the appropriate permission or lawful basis to provide and use that information.

3. App Purpose

OneTap | Safe is a personal safety and check-in tool.

The App is not an emergency response service, medical device, security monitoring service, or substitute for professional emergency or medical assistance.

The App should not be relied upon as the sole means of protecting your health, safety, or well-being.

If you are experiencing an emergency or believe that someone is in immediate danger, contact the appropriate local emergency services.

4. Check-In and Alert Functionality

The App may allow you to:

• Schedule check-ins

• Receive reminders to check in

• Select trusted contacts

• Trigger notifications or messages when a check-in is missed

• Manage your check-in settings and trusted contacts

You acknowledge that the App cannot guarantee that an alert will be generated, sent, received, or acted upon.

Alerts may depend on:

• Device availability

• Battery level

• Internet or mobile network connectivity

• Operating system functionality

• Notification permissions

• SMS or messaging functionality

• Third-party communication services

• Correct information entered by the user

You should maintain alternative safety arrangements where appropriate.

5. Trusted Contacts

You are responsible for selecting trusted contacts and ensuring that the information you enter is accurate.

By adding a trusted contact, you confirm that you have the appropriate permission or lawful basis to provide their information to the App.

You should only select people who you trust to receive safety-related notifications.

GSDSI is not responsible for the actions, responses, or failure to respond of any trusted contact.

6. Alerts and Communications

When a scheduled check-in is missed, the App may initiate an SMS, notification, or other communication to the trusted contact you have selected.

Delivery of communications is not guaranteed.

Messages may be delayed, blocked, unavailable, or otherwise affected by mobile networks, device settings, service providers, operating systems, or other technical circumstances outside GSDSI's control.

You are responsible for ensuring that the phone numbers and other contact information stored in the App are accurate and up to date.

7. Device Permissions

The App may request permissions necessary to provide its functionality, including:

• Notifications

• Messaging or SMS functionality, where supported

• Other device permissions required for specific features

You may refuse or revoke permissions through your device settings.

If required permissions are disabled, certain features may not function properly.

8. User Responsibilities

You agree to use the App lawfully and responsibly.

You must not:

• Use the App for unlawful purposes

• Provide intentionally false or misleading information

• Enter another person's information without an appropriate basis or permission

• Use the App to harass, threaten, abuse, or unlawfully monitor another person

• Attempt to gain unauthorized access to the App or its systems

• Interfere with the operation or security of the App

• Reverse engineer, decompile, or attempt to extract the source code except where permitted by applicable law

• Use the App in a way that creates an unreasonable safety risk

You are responsible for maintaining accurate check-in schedules, phone numbers, trusted contacts, and other information you provide.

9. Privacy

Your use of the App is also subject to our Privacy Policy.

OneTap | Safe is designed with a privacy-first approach and stores user-provided information locally on the device, as described in the Privacy Policy.

The Privacy Policy explains how information may be processed when you use communication features such as SMS or notifications.

10. Intellectual Property

The App, including its software, design, graphics, interface, text, logos, trademarks, and other content, is owned by or licensed to GSDSI and is protected by applicable intellectual property laws.

Subject to these Terms, GSDSI grants you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended personal purposes.

You may not copy, modify, distribute, sell, sublicense, or create derivative works from the App except where expressly permitted by applicable law.

11. Third-Party Services

The App may depend on third-party services, including mobile networks, SMS providers, operating-system services, notification services, or other technical infrastructure.

These services are controlled by third parties and may have their own terms and privacy policies.

GSDSI does not guarantee the availability, accuracy, security, or performance of third-party services.

12. Availability and Updates

We may update, modify, suspend, or discontinue the App or any feature at any time.

We may release updates to improve functionality, security, compatibility, or performance.

You may need to install updates to continue using certain features.

We do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with every device or operating system.

13. Safety Disclaimer

OneTap | Safe is intended as an additional safety tool and must not be considered a guaranteed emergency notification system.

You acknowledge that:

• A missed check-in may not result in a successful notification

• Notifications or SMS messages may fail or be delayed

• A trusted contact may not see or respond to an alert

• Your device may be switched off, unavailable, damaged, or out of battery

• Network or mobile service may be unavailable

• Technical failures may prevent the App from functioning

You should not rely solely on OneTap | Safe when immediate emergency assistance is required.

14. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided on an “as is” and “as available” basis.

GSDSI does not guarantee that:

• The App will always be available

• Check-in reminders will always be delivered

• Alerts will always be generated

• SMS or notifications will always reach their intended recipients

• Contact information will always be accurate

• The App will operate without errors or interruptions

• The App will meet every user's individual safety requirements

15. Limitation of Liability

To the maximum extent permitted by applicable law, GSDSI and its officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App.

This includes, where permitted by law, losses or damages resulting from:

• Failed or delayed alerts

• Failed or delayed SMS or notifications

• Incorrect contact information

• Network or device failures

• Failure of a trusted contact to respond

• Reliance on the App as an emergency service

• Unauthorized use of information by a trusted contact

• Third-party service failures

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

16. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless GSDSI and its affiliates, officers, employees, contractors, and service providers from claims, damages, liabilities, losses, and expenses arising from:

• Your violation of these Terms

• Your misuse of the App

• Your violation of another person's rights

• Your unauthorized use or disclosure of another person's information

17. Termination

You may stop using the App and delete it from your device at any time.

We may suspend or terminate access to the App where reasonably necessary, including where you materially violate these Terms, misuse the App, or create a security or legal risk.

Upon termination, provisions that by their nature should continue to apply will remain in effect, including provisions concerning intellectual property, disclaimers, limitation of liability, and applicable law.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes to the App, our services, or applicable legal requirements.

If we make material changes, we may provide appropriate notice through the App or by other suitable means.

The updated Terms will include a revised effective date.

Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

19. Governing Law

These Terms are governed by the laws applicable to GSDSI, except where mandatory consumer protection or other laws in your country provide otherwise.

Nothing in these Terms limits any mandatory rights or protections available to consumers under applicable law.
