These Terms of Service ("Terms") govern your access to and use of the Omilive mobile application, website, products, features, and related services (collectively, the "Service"). "Omilive," "we," "us," or "our" refers to the operator of the Service.
By creating an account, accessing, or using Omilive, you agree to these Terms. If you do not agree, you must not use the Service.
Omilive is intended only for users who are 18 years of age or older. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
Minors are strictly prohibited from using Omilive. If we learn or reasonably suspect that a user is under 18, we may suspend or delete the account and take appropriate safety measures.
You may register using an email address and password. You agree to provide accurate information and to keep your login credentials secure.
You are responsible for all activity that occurs under your account. You must not share, sell, transfer, or allow others to use your account. You must notify us promptly if you believe your account has been compromised.
Omilive allows users to communicate through chat, private images, video messages, voice calls, video calls, and related social features.
You are solely responsible for your interactions with other users. Omilive does not guarantee the identity, intentions, background, compatibility, conduct, responses, availability, or offline behavior of any user.
If you choose to meet another user offline, you do so at your own risk. Omilive is not responsible for offline interactions between users.
For your safety, consider meeting only in public places, telling someone you trust where you are going, arranging your own transportation, avoiding disclosure of home address or financial information, and ending communication if behavior feels suspicious, coercive, abusive, or unsafe.
"User Content" means any content or information that users submit, upload, send, display, transmit, or otherwise make available through the Service, including messages, images, videos, profile information, report evidence, and call-related content.
You retain ownership of your User Content. By using the Service, you grant Omilive a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, transmit, display, moderate, remove, and use your User Content as necessary to operate, provide, secure, improve, and enforce the Service and our policies.
You represent and warrant that you have all rights, permissions, and consents necessary to submit your User Content and that your User Content does not violate these Terms, our Community Guidelines, our CSAE Policy, or applicable law.
You must not:
Use Omilive if you are under 18.
Misrepresent your age or identity.
Impersonate another person or entity.
Upload, request, share, promote, or distribute sexual content involving minors or persons who appear to be minors.
Engage in grooming, exploitation, coercion, sextortion, trafficking, or predatory behavior.
Harass, threaten, stalk, bully, intimidate, shame, or abuse others.
Share non-consensual intimate images, videos, or private information.
Pressure users into chats, calls, images, videos, gifts, purchases, relationships, or offline meetings.
Send spam, scams, phishing, fraudulent investment offers, financial abuse, or deceptive content.
Upload malware, interfere with security, scrape data, or disrupt the Service.
Use the Service for illegal activity or to encourage others to violate the law.
Sell, trade, transfer, or exchange accounts, Coins, Credits, subscriptions, or benefits outside official Omilive channels.
Circumvent blocks, bans, moderation actions, purchase systems, or safety features.
Omilive provides in-app tools for reporting objectionable content, abusive behavior, suspected underage users, and other violations. Users may also block other users.
If you believe a user is under 18, you may report the account by selecting "Underage User" in the report flow.
We may review reports and user activity to enforce these Terms and our policies. We may remove content, restrict features, suspend accounts, permanently ban users, preserve evidence, or report conduct to law enforcement, regulators, or child-safety organizations where appropriate or required by law.
Omilive has zero tolerance for Child Sexual Abuse and Exploitation (CSAE), child sexual abuse material (CSAM), grooming, sextortion, trafficking, or any conduct that harms or exploits minors.
Any violation of our CSAE Policy may result in immediate account termination, preservation of evidence, and reporting to relevant authorities or child-safety organizations.
Omilive may offer VIP subscriptions, Coins, Credits, and other paid features. Purchases are subject to our VIP Membership Agreement / Subscription Agreement, Google Play Billing terms, and applicable law.
VIP subscriptions purchased through Google Play Billing may renew automatically unless canceled through Google Play before the renewal date. Deleting the Omilive app or deleting your Omilive account does not necessarily cancel your subscription.
Paid features do not guarantee matches, replies, calls, gifts, popularity, relationships, offline meetings, income, or any specific social outcome.
Omilive does not currently display third-party advertisements.
You may stop using Omilive at any time and may delete your account in the app. We may suspend, restrict, or terminate your account if we believe you have violated these Terms, our Community Guidelines, our CSAE Policy, payment rules, applicable law, or the rights or safety of others.
If your account is suspended or terminated for violations, you may lose access to content, paid features, Coins, Credits, and VIP benefits to the extent permitted by law.
We may modify, suspend, or discontinue all or part of the Service at any time. We may update features, eligibility rules, pricing, technical requirements, or policies as needed to operate and improve Omilive.
Omilive, including its software, design, logos, trademarks, service marks, content, and features, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Service except as permitted by law or authorized by us in writing.
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, safety, and reliability.
We do not guarantee that the Service will be uninterrupted, error-free, secure, or that any user interaction will meet your expectations.
To the maximum extent permitted by law, Omilive and its affiliates, officers, employees, agents, service providers, and licensors will not be liable for indirect, incidental, consequential, special, punitive, exemplary, or lost-profit damages arising out of or related to your use of the Service.
To the maximum extent permitted by law, our total liability for any claim related to the Service will be limited to the amount you paid to Omilive through the Service in the three months before the event giving rise to the claim, or USD $50, whichever is greater.
You agree to defend, indemnify, and hold harmless Omilive and its affiliates, officers, employees, agents, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from your User Content, your use of the Service, your violation of these Terms, your violation of law, or your violation of another person's rights.
Unless otherwise required by applicable consumer protection law, these Terms are governed by the laws of the jurisdiction where the operator of Omilive is established, without regard to conflict-of-law principles. Courts located in that jurisdiction will have authority to resolve disputes, except where applicable law gives you mandatory rights to bring claims elsewhere.
We may update these Terms from time to time. If we make material changes, we may provide notice through the Service or by other reasonable means. Continued use of Omilive after updated Terms become effective means you accept the updated Terms.
