Please read these Terms of Service ("Terms") carefully before downloading or playing OG Fun Monke Horror (the "Game"), developed and operated by Silly Games ("we," "us," or "our"). 

These Terms form a legally binding agreement between you and Silly Games.

By downloading, installing, or playing the Game, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not download or play the Game.

1. Eligibility

You must meet Meta's minimum age requirement to use a Meta Quest device and play the Game, which is generally 13 years of age or older. Age requirements may vary by region. If you are under 18 years of age, you represent that you have obtained parental or guardian consent, in accordance with Meta's policies and any applicable law in your jurisdiction.

By accepting these Terms, you represent and warrant that you meet the applicable age requirements and have the legal capacity to enter into a binding agreement.

2. License

Subject to your compliance with these Terms, Silly Games grants you a limited, personal, non exclusive, non-transferable, non-sublicensable, and revocable license to download and play OG Fun Monke Horror solely for your own personal, non-commercial entertainment purposes.

You may not:

- Copy, reproduce, distribute, or publicly display the Game or any of its content.

- Modify, adapt, translate, or create derivative works based on the Game.

- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Game.

- Use the Game or any of its content for commercial purposes without prior written permission from Silly Games.

All rights not expressly granted to you in these Terms are reserved by Silly Games and its licensors.

3. User Conduct

By playing OG Fun Monke Horror, you agree to conduct yourself in a manner that is lawful, respectful, and consistent with these Terms.

You agree not to:

- Cheat, hack, or exploit bugs, vulnerabilities, or unintended game mechanics to gain an unfair advantage.

- Use unauthorized third-party software, bots, scripts, or tools in connection with the Game.

- Harass, bully, threaten, stalk, or harm other players in any way.

- Use offensive, discriminatory, defamatory, or abusive language or behavior.

- Attempt to disrupt, interfere with, or damage the Game's servers, infrastructure, or services.

- Impersonate any other person, entity, or Silly Games staff.

- Engage in any conduct that violates applicable local, national, or international law.

Violations of these rules may result in warnings, temporary suspension, permanent account bans, or legal action, at our sole and absolute discretion.

4. In-App Purchases

OG Fun Monke Horror offers optional in-app purchases processed through Meta's payment platform. By making a purchase, you agree to Meta's applicable payment terms.

- All purchases are final and non-refundable, except where required by applicable consumer protection law in your jurisdiction.

- Silly Games reserves the right to modify, adjust, discontinue, or remove virtual items, currencies, or in-game content at any time. You acknowledge that you have no property right or other interest in virtual items, and that they have no real-world monetary value.

- Silly Games is not responsible for unauthorized purchases made through your account. You are responsible for maintaining the security of your account credentials.

5. Intellectual Property

The Game, including all content, artwork, code, audio, user interfaces, and other materials, is owned by or licensed to Silly Games and is protected by applicable copyright, trademark, and intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

Certain trademarks and content within the Game are licensed from Perfect Games. See the Trademark Notice in the next page for details.

6. Privacy

Your use of OG Fun Monke Horror is subject to our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, store, and protect your personal data. By agreeing to these Terms, you also acknowledge and agree to our Privacy Policy.

7. Disclaimers

OG Fun Monke Horror is provided on an "as is" and "as available" basis, without any warranty of any kind, express or implied. To the fullest extent permitted by applicable law, Silly Games disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, or free of viruses or other harmful components. You use the Game at your own risk.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Silly Games and its developer(s), affiliates, officers, and agents shall not be liable for any:

- Indirect, incidental, special, consequential, or punitive damages.

- Loss of profits, revenue, data, goodwill, or business opportunities.

- Personal injury or property damage resulting from your use of or inability to use the Game.

- Unauthorized access to or alteration of your data or transmissions.

- Damages resulting from the acts or omissions of any third-party service provider (including Meta, PlayFab, or Photon).

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability is limited to the maximum extent permitted by law. In all cases, our total cumulative liability to you for any claims arising under these Terms shall not exceed the total amount you paid, if any, to access the Game in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Silly Games and its developer(s), affiliates, officers, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Game; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content or data you transmit through the Game.

10. Termination

Silly Games reserves the right to suspend or permanently terminate your access to OG Fun Monke Horror at any time, with or without notice, for any conduct we determine, in our sole discretion, to violate these Terms, to be harmful to other players, or to be otherwise unlawful or inappropriate. Upon termination, your license to use the Game immediately ceases. Provisions of these Terms that by their nature should survive termination (including Sections 5, 7, 8, 9, and 11) will survive.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Silly Games operates, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Game shall first be attempted to be resolved informally by contacting us. If informal resolution fails, disputes shall be submitted to the competent courts of the applicable jurisdiction. Nothing in this section limits your rights as a consumer under the laws of your country of residence.

12. Updates and Changes

We may update, modify, or amend these Terms at any time. The most current version will be posted in the Game's store listing on the Meta Horizon Store. We will update the "Last Updated" date at the top of this agreement when changes are made. Your continued use of the Game following any posted changes constitutesyour acceptance of those changes.
