TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your access to and use of the NurseShift: Paycheck Tracker mobile application and related services (collectively, the "Service") operated by Khandker Tafiqul Islam ("we", "us", or "our").
By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
1. Eligibility
The Service is intended for nurses and related professional users. By using the Service, you confirm that you are legally permitted to use the Service under applicable law and that the information you provide is accurate and complete.
2. Purpose of the Service
NurseShift: Paycheck Tracker is designed to help users track shifts, pay, and related work information.
The Service is provided as a productivity and record-keeping tool only. It may contain bugs, errors, delays, or inaccuracies. You must not rely solely on the Service for payroll, tax, legal, employment, financial, scheduling, or other important decisions. You are responsible for reviewing and verifying all records, calculations, and outputs before relying on them.
3. No Professional Advice
The Service does not provide legal, tax, accounting, payroll, employment, or financial advice. Any information generated by the Service is for general informational and organizational purposes only.
4. Account, Device, and Access
You may need an Apple device, App Store access, iCloud access, or other compatible services to use some or all features of the Service.
You are responsible for:
a. maintaining the security of your device, Apple ID, and iCloud account;
b. ensuring your device and backups are protected;
c. restricting unauthorized access to the Service on your device; and
d. any activity that occurs through your device or account, except where caused by our misconduct.
5. Local and iCloud Storage
The Service may store data locally on your device and/or in your iCloud account, depending on your settings and device configuration.
You acknowledge and agree that:
a. locally stored data may be lost if your device is damaged, reset, replaced, or accessed by unauthorized persons;
b. iCloud storage and synchronization depend on Apple’s services and availability;
c. we do not guarantee uninterrupted availability of local storage, iCloud syncing, backup, or recovery; and
d. you are responsible for maintaining appropriate backups and protecting access to your device and iCloud account.
6. App Store Distribution
The Service is distributed through the Apple App Store. Your use of the Service must also comply with any applicable Apple terms and conditions.
You acknowledge that:
a. these Terms are between you and Khandker Tafiqul Islam, not Apple;
b. Apple is not responsible for the Service or its content;
c. Apple has no obligation to provide maintenance or support services for the Service, except as required by law; and
d. to the extent permitted by law, Apple is a third-party beneficiary of these Terms and may enforce them against you.
7. Subscriptions and Payments
Some features of the Service may require payment, subscription, or in-app purchase through the Apple App Store.
If you purchase a subscription or paid feature:
a. payment will be charged through your App Store account;
b. billing, renewal, cancellation, and refund terms will be governed by Apple’s App Store rules and policies, except where otherwise required by law;
c. subscriptions may renew automatically unless canceled in accordance with Apple’s settings; and
d. prices may change from time to time with notice where required by applicable law.
8. Acceptable Use
You agree not to:
a. use the Service for any unlawful, fraudulent, or harmful purpose;
b. interfere with the operation or security of the Service;
c. attempt to gain unauthorized access to the Service or related systems;
d. copy, modify, reverse engineer, decompile, or exploit the Service except as permitted by law;
e. upload malicious code or harmful data; or
f. use the Service in a way that may harm us, other users, or third parties.
9. Analytics and Microsoft Clarity
We may use Microsoft Clarity and similar analytics tools to better understand how users interact with the Service, improve functionality, identify usability issues, and enhance performance.
By using the Service, you acknowledge that certain usage information, device information, interaction data, and technical data may be collected and processed by us and by Microsoft Clarity in accordance with our Privacy Policy and Microsoft’s applicable terms and policies.
10. Privacy
Your use of the Service is also subject to our Privacy Policy. The Privacy Policy explains how we collect, use, store, and share information, including data stored locally on your device and through iCloud where applicable.
11. Intellectual Property
The Service, including its software, name, design, text, graphics, logos, features, and content, is owned by or licensed to Khandker Tafiqul Islam and is protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended personal or professional purpose, subject to these Terms.
12. Service Availability and Bugs
We aim to keep the Service available and functioning properly, but we do not guarantee that the Service will always be available, uninterrupted, secure, accurate, or error-free.
You acknowledge that the Service may contain bugs, defects, or inaccuracies, and that features may change, be suspended, or be discontinued at any time.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.
We do not warrant that:
a. the Service will meet all of your needs or expectations;
b. the Service will be uninterrupted, timely, secure, or error-free;
c. the information or calculations generated by the Service will be complete, accurate, or reliable; or
d. defects will always be corrected.
14. Limitation of Liability
To the fullest extent permitted by law, Khandker Tafiqul Islam will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, loss of income, loss of profits, loss of business opportunity, payroll errors, work record discrepancies, or other losses arising out of or related to your use of the Service.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid for the Service in the twelve (12) months before the event giving rise to the claim, or BDT 5,000 if no such payment was made.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
15. User Responsibility
You are solely responsible for reviewing your shift information, pay calculations, saved records, and exported or displayed data. You should independently confirm all payroll and work-related information before using it for official, financial, tax, or employment purposes.
16. Termination
We may suspend or terminate your access to the Service at any time if:
a. you violate these Terms;
b. your use creates legal, security, or operational risk; or
c. we decide to discontinue the Service.
Upon termination, your right to use the Service will end immediately. Any provisions that by their nature should survive termination will remain in effect, including provisions regarding intellectual property, disclaimers, limitation of liability, and governing law.
17. Changes to the Service or Terms
We may update the Service or these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Service after any updated Terms become effective constitutes your acceptance of the revised Terms.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of Bangladesh.
Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Bangladesh.

20. Entire Agreement
