STACKWATCH TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of StackWatch, an application provided by NorthStack Digital (“we”, “our” or “us”).
By downloading, accessing or using StackWatch, you agree to these Terms. If you do not agree, do not use StackWatch.
ABOUT STACKWATCH
StackWatch provides tools for recording and reviewing precious metals, gemstones, cryptocurrency and custom assets.
Depending on availability and subscription status, StackWatch may provide features including:
• Device-only portfolio tracking
• Public precious-metal spot prices
• Foreign-exchange conversion
• Purchase records and cost-basis calculations
• Portfolio value and allocation calculations
• Targets and planning tools
• Analytics and historical snapshots
• Metal-ratio calculations and simulations
• Dealer discovery and comparison tools
• StackWatch Pro subscription features
Features may differ according to app version, device, country, data-source availability and StackWatch Pro entitlement.
INFORMATIONAL PURPOSE ONLY
StackWatch provides calculations, market information, simulations and organisational tools for general informational purposes only.
StackWatch does not provide personal financial, investment, taxation, accounting or legal advice.
StackWatch does not recommend that you buy, sell, hold or exchange any particular asset.
Ratio calculations, purchase scenarios, analytics, targets, dealer comparisons and other tools illustrate possible scenarios. They do not predict future prices, returns or outcomes.
You remain responsible for your own financial decisions. Consider obtaining independent professional advice appropriate to your circumstances before making significant financial decisions.
YOUR HOLDINGS AND PORTFOLIO INFORMATION
Your holdings and private portfolio information are stored locally on your device only.
NorthStack Digital does not receive, collect, store, view, retrieve or recover your holdings or private portfolio information.
StackWatch will never transmit your holdings or private portfolio information to NorthStack Digital or to a third-party portfolio-storage service.

LOCAL STORAGE AND LOSS OF DATA
StackWatch configures Android to disable cloud backup and excludes StackWatch app data from supported Android backup and device-transfer mechanisms where Android supports and honours those controls.
NorthStack Digital does not maintain a cloud copy of your holdings.
No built-in manual backup or export is provided in this version of StackWatch.
Uninstalling StackWatch, clearing its app data, resetting your device, or losing or damaging your device may permanently remove your holdings and private portfolio information.
You are responsible for maintaining an independent record of your holdings if you may need to recover them.
NorthStack Digital cannot recover information that exists only on your device.
USER-ENTERED INFORMATION
You are responsible for the accuracy of information you enter into StackWatch.
Calculations and displayed results depend on the quantities, units, product sizes, purchase amounts, currencies, dates, values, categories and other information you provide.
Incorrect, incomplete or outdated entries may produce incorrect portfolio values, profit or loss figures, allocations, analytics or simulations.
PUBLIC MARKET INFORMATION
StackWatch may display public precious-metal prices, foreign-exchange rates, timestamps, market movements and service-availability information obtained from external data services.
Market information may be delayed, unavailable, incomplete or different from the price available from a dealer, exchange or financial institution.
Displayed market information does not include all transaction costs. Dealer premiums, spreads, taxes, payment-method fees, shipping, insurance, minimum-order requirements and local charges may affect the actual amount paid or received.
Users should verify important prices and transaction terms directly with the relevant provider before acting.
DEALER WORLD AND DEALER INFORMATION
Dealer World is intended to help users discover available precious-metal dealers and, where authorised and connected, compare relevant dealer information.
A dealer shown as “Not connected” does not provide verified live dealer pricing through StackWatch.
StackWatch must not represent a dealer as connected, verified or live unless an approved dealer source has been established.
Dealer names, prices, products, stock availability, shipping, fees, premiums and other information may change without notice.
Users must confirm final prices, availability, fees, delivery terms, returns and transaction conditions directly with the dealer.
Unless expressly stated otherwise, NorthStack Digital:
• Does not sell precious metals
• Does not take custody of precious metals
• Does not process dealer transactions
• Does not act as the buyer or seller
• Does not guarantee dealer performance
• Does not guarantee that every available dealer or product is included
Any transaction entered into with an independent dealer is between the user and that dealer.
If StackWatch introduces paid dealer partnerships, affiliate links or sponsored placements, those commercial relationships will be disclosed clearly. Payment will not alter objective price calculations or organic best-price rankings.
STACKWATCH PRO
StackWatch may offer optional paid access through the StackWatch Pro subscription.
The subscription product is provided through Google Play under the product identifier stackwatch_pro.
StackWatch Pro currently uses a monthly, automatically renewing subscription.
The price, currency, billing period and any eligible introductory offer or free trial are displayed by Google Play before purchase.
StackWatch does not rely on a hard-coded subscription price. Regional prices may differ.
FREE TRIALS AND INTRODUCTORY OFFERS
A free trial or introductory offer is available only when Google Play displays that offer to an eligible user.
Offer eligibility is determined through Google Play.
If a free trial is offered, its duration and the recurring subscription price that follows the trial will be displayed before confirmation.
Unless cancelled before the trial ends, the subscription will automatically convert to the recurring paid subscription shown by Google Play.
Users who are not eligible for an introductory offer may be offered the standard monthly subscription without a free trial.
SUBSCRIPTION RENEWAL AND CANCELLATION
StackWatch Pro subscriptions renew automatically unless cancelled through Google Play before the next billing date.
Users can manage or cancel their subscription through their Google Play account.
Uninstalling StackWatch does not cancel a Google Play subscription.
Cancelling prevents future renewal but may allow Pro access to continue until the end of the already-paid subscription period, subject to Google Play’s subscription status.
Subscription restoration and entitlement depend on Google Play confirming an active and verified stackwatch_pro purchase.
PAYMENTS AND REFUNDS
Google Play processes StackWatch Pro payments.
NorthStack Digital does not receive or store users’ full payment-card details.
Refund requests may be handled according to Google Play’s refund processes and applicable consumer law.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.
PRO FEATURE AVAILABILITY
A StackWatch Pro subscription provides access to the Pro functionality available in the installed version of StackWatch.
Particular features may depend on:
• Internet availability
• Market-data availability
• Foreign-exchange availability
• Google Play Billing availability
• Dealer-source permissions and connectivity
• Country or regional availability
• Device compatibility
• App version
Dealer pricing and cryptocurrency pricing may remain unavailable until approved data sources are connected.
StackWatch will display an unavailable or “Not connected” state rather than knowingly presenting unverified live data as valid.
A Pro subscription does not guarantee that every external data source, dealer, country, product or market will be connected at all times.
ACCEPTABLE USE
You must not:
• Attempt to interfere with StackWatch’s operation or security
• Attempt to gain unauthorised access to StackWatch services
• Use automated methods to overload or abuse StackWatch services
• Circumvent StackWatch Pro access controls
• Copy, modify, distribute or resell StackWatch except where permitted by law
• Misrepresent StackWatch data as guaranteed financial advice
• Use StackWatch for unlawful, fraudulent or harmful activity
INTELLECTUAL PROPERTY
StackWatch, its design, software, branding, calculations, graphics, content and original functionality are owned by or licensed to NorthStack Digital and are protected by applicable intellectual-property laws.
These Terms provide you with a personal, limited, non-exclusive, non-transferable and revocable right to use StackWatch for lawful purposes.
These Terms do not transfer ownership of StackWatch or its intellectual property to you.
THIRD-PARTY SERVICES
StackWatch may rely on Google Play Billing and external market-price or foreign-exchange services.
Those services remain responsible for their own systems and the information they process directly.
StackWatch does not provide those services with your holdings or private portfolio information.
Opening an independent dealer website or another external service leaves StackWatch. Your use of that external service is governed by its own terms.
SERVICE CHANGES AND AVAILABILITY
NorthStack Digital may maintain, correct, improve, add, remove or replace StackWatch functionality.
Changes may be required because of technical conditions, security requirements, data-source availability, dealer permissions, legal obligations, Google Play requirements or improvements to the service.
We will not intentionally represent unavailable dealer, cryptocurrency or market information as verified live information.
Temporary interruption, maintenance or external-provider failure may make some features unavailable.
TERMINATION
You may stop using StackWatch at any time.
NorthStack Digital may restrict access to StackWatch services where reasonably necessary to address misuse, unlawful activity, security threats or violations of these Terms.
Termination of app access does not automatically cancel a Google Play subscription. Subscriptions must be managed through Google Play.
AUSTRALIAN CONSUMER LAW
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms is intended to exclude, restrict or modify rights or remedies that cannot lawfully be excluded, restricted or modified.
Where permitted by law, responsibility for a failure will be limited to the remedies available under applicable consumer law and the circumstances of that failure.
GOVERNING LAW
These Terms are governed by the laws of Victoria, Australia, subject to any mandatory laws that apply in another jurisdiction.
CHANGES TO THESE TERMS
NorthStack Digital may update these Terms when StackWatch, its subscriptions, dealer services, external integrations or applicable requirements change.
The “Last updated” date will be revised when these Terms are updated.
Continued use of StackWatch after updated Terms become effective means you accept the updated Terms, except where applicable law requires another form of notice or consent.
