Staff Recommendations: On October 30, 2024 an application was submitted for the structural renovation of 2212 Wirth Place. The scope of work included the removal of over 50% of the roof structure in order to accommodate more interior living space which required HDLC Commission approval.
On Monday, November 25, 2024 the applicant was emailed the Commission Agenda for the December 4, 2024 Commission meeting. The December 4, 2024 Commission meeting was cancelled due to The Advocate's failure to publish the legally required public notice due to issues surrounding the Thanksgiving holiday week. The applicant was notified that the meeting was cancelled and the item would now be slated for the January 8, 2025 Commission meeting.
After a phone discussion with the building owner on December 18, 2024 an HDLC Staff member performed a visual inspection of the property noting that the project had moved forward without receiving Certificate of Appropriateness from the HDLC or Building Permit from the Department of Safety and Permits.
The building at 2212 Wirth is front facing to Worth Place and rear facing to Nashville Avenue. Any additions to the previously existing one and a 1/2 story building would have had to adhere to zoning setbacks that would not allow for the expansion of the ground floor footprint. HDLC Staff agreed that working toward a vertical solution for the building's expansion in keeping with the style of the building would have been a path forward for an approval recommendation to the Commission.
HDLC Staff would have recommended HDLC Commission approval of the proposed project had the December 4, 2024 meeting been held. However, the project commenced without a Certificate of Appropriateness from the HDLC or a building permit from the Department of Safety and Permits. For the aforementioned reasons Staff recommends the approval of the retention of demolition without a CofA with a Tier 1 fine.
