TRADEMARK NOTICE

"Nifty 50" and "Nifty" are registered trademarks of NSE Indices Limited, a subsidiary of the National Stock Exchange of India Limited. "Oracle" is a descriptive term used in its common English meaning of "a source of wise counsel or prophetic information." NiftyOracle is an independent application and is NOT affiliated with, endorsed by, sponsored by, or officially connected to NSE Indices Limited, National Stock Exchange of India Limited, or any of their subsidiaries or affiliates in any manner whatsoever. The use of the word "Nifty" in our app name is solely to identify the Nifty 50 index as the subject of analysis — not to claim any trademark rights over the word "Nifty."

1. Introduction and Scope

This Privacy Policy constitutes a legally binding disclosure document prepared by Dev Malkar, the independent developer of NiftyOracle, operating through the official business email niftyoracle.in@gmail.com. This Policy is prepared in full compliance with the Digital Personal Data Protection Act 2023, the DPDP Rules 2025, the Information Technology Intermediary Guidelines and Digital Media Ethics Code Rules 2021, and all applicable Google Play Store Finance category requirements.

By installing or using NiftyOracle, You expressly agree to all practices described in this Policy. If You do not agree, You must immediately uninstall the application.

3. What Data We Collect

We strictly follow the principle of Data Minimization under the DPDP Act 2023. We collect only what is absolutely necessary for the app to function.

3.1 Personal Identification Data

We collect your name and email address for account creation, authentication, and subscription management when you register on NiftyOracle.

3.2 Device Information

We collect non-persistent device metadata including Android OS version and app instance identifiers as permitted under Google Play Developer Policy updated April 2025. This is used purely for security and preventing unauthorized access to premium features.

3.2.1 Device Session Management

NiftyOracle implements single-device login policy. We collect and store:

• Device identifier (randomly generated)

• Login timestamp

• Platform information

This ensures your account is active on only ONE device at a time. If you login on a new device, your previous device session is automatically terminated for security purposes.

To change your primary device:

Simply login on your new device.Previous device will be logged out automatically.

3.3 Financial Transaction Data

We maintain records of transaction IDs, subscription start dates, end dates, and payment status as received from Razorpay payment gateway. We do NOT directly store your credit card numbers, bank account numbers, or UPI IDs. All payment processing is handled entirely by Razorpay.

3.4 IP Address

We log your IP address for API security purposes. NiftyOracle operates an AWS Mumbai (ap-south-1) server for market data processing. Angel One SmartAPI, our licensed NSE data vendors, mandate registered IP-based access for live market data delivery as per NSE regulations and the SEBI Algo Trading Framework 2026.

3.5 User Preference Data

The App stores your self-declared trading preference — Buyer, Seller, or Both — locally on your device using Android SharedPreferences. This preference data never leaves your device and is never transmitted to any server at any time.

3.6 Push Notification Data

With your explicit permission, the App sends market signal alerts, India VIX warnings, and expiry day reminders. You can disable notifications at any time through your Android device settings. No notification interaction data is shared with any third party.

3.7 Data We Do NOT Collect

We explicitly do NOT collect: Aadhaar number, PAN card details, bank account information, credit card details, biometric data, precise location, contacts, photos, call logs, or SMS data.

3.8 Mobile Phone Number

We collect your mobile phone number

when you choose to provide it during:

• Onboarding (optional)

• Subscription purchase (required)

Your phone number is used for:

• Payment confirmation via Razorpay

• Subscription renewal alerts

• Critical signal notifications (only with your permission)

• Account security verification

We do NOT use your phone number for:

• Marketing calls

• Sharing with third parties

• Any purpose beyond stated above

4. How Data is Collected

4.1 Direct Submission: Name and email are submitted by You during registration with your clear informed consent as required by Rule 3 of DPDP Rules 2025.

4.2 Automated System Logs: IP address and device metadata are collected automatically when You access live market data features for security verification.

4.3 Third-Party Signals: Subscription renewal and payment status information is received automatically from the Razorpay payment gateway via secure webhooks and payment verification APIs

4.4 Local Device Storage Only: Trading preference data is stored locally on your device only and never transmitted.

6. How Data is Stored and Security Measures

6.1 Algorithmic Computation Layer: All real-time market analysis computations are processed through our proprietary 5-worker Cloudflare infrastructure. This computation data is ephemeral — processed in memory and purged after each request cycle. No personal data is stored in this computation layer.

6.2 Subscription and Account Data: All personal data including email, display name, subscription status, trial status, and device session information are stored on exclusively in Firebase Firestore (Google Cloud, encrypted at rest and in transit). Our AWS Mumbai server processes market data only and does not store any personal user data. Payment credentials are managed exclusively through Razorpay's PCI-DSS compliant infrastructure.

6.3 Security Standards: We implement reasonable security safeguards including encryption of all data in transit using TLS 1.3 protocol and tokenization of sensitive session identifiers.

6.4 Data Breach Notification: In the event of a personal data breach, We will notify affected users and report to the Data Protection Board of India within 72 hours of discovery as required by the DPDP Act 2023.

6.5 No Sale of Data: We do NOT sell, rent, trade, or transfer your personal data to any third party for marketing, advertising, or any commercial purpose whatsoever.

6.6 Content Protection

NiftyOracle implements Android FLAG_SECURE technology to prevent:

• Screenshots of premium content

• Screen recording of signal data

• Third-party screen capture

This protection applies to:

• Oracle Signal screen

• Option chain data

• Trade setup levels

• All premium features

This is the same technology used

by banking apps and streaming apps.

This is for your protection — preventing unauthorized sharing of your premium subscription data.

Note: Screenshot protection applies to the Android app only. Browser access does not have this protection. We recommend using our Android app for best security.

7. Data Retention Period

7.1 Active Account Data: Retained for the full duration of your active account.

7.2 Financial Records: Transaction records retained for 8 years in compliance with standard Indian audit and tax requirements.

7.3 Inactive Account Purge: If You do not use the App for 3 consecutive years, We will delete or anonymize your data unless legally required to retain it. You will receive email notification at least 48 hours before deletion.

7.4 User Preference Data: Stored locally on your device only. Automatically deleted when you uninstall the App.

7.5 Push Notification Tokens: Retained only while you have the App installed and notifications enabled.

7.6 Payment Records

Payment transaction records are retained for 8 years as required by Indian tax and audit laws. Payment data includes:

• Razorpay order ID

• Payment ID

• Amount paid

• Subscription plan

• Payment date

No card numbers, UPI IDs, or bank account details are stored by NiftyOracle. All payment data is processed and secured by Razorpay.

7.7 Device Session Data

Device session identifiers are retained for the duration of the active subscription. Deleted within 30 days of account termination.

7.8 Phone Number

Retained for the duration of the active account. Deleted within 30 days of account deletion request.

8. Third-Party Services and Data Access

8A. PAYMENT DATA NOTE

NiftyOracle processes subscription payments through Razorpay Software Pvt Ltd, a Payment Aggregator licensed and regulated by the Reserve Bank of India (RBI).

NiftyOracle does NOT store:

• Credit or debit card numbers

• UPI IDs or VPA addresses

• Bank account details

• CVV or PIN numbers

All payment credentials are handled exclusively by Razorpay's PCI-DSS compliant infrastructure.

Note: NiftyOracle processes payments through Razorpay, not Google Play Billing. The Google Play Store is used solely as an app distribution platform and does not process any payments for NiftyOracle subscriptions

Important: None of the above services receive your trading preference, location, contacts, or any sensitive personal data.

9. User Rights Under DPDP Act 2023

As a Data Principal under Indian law You have the following statutory rights:

9.1 Right to Know: Request a summary of what personal data We hold about you and with whom it has been shared.

9.2 Right to Correction: Request correction of inaccurate or incomplete personal data.

9.3 Right to Erasure: Request deletion of your data once the purpose of collection is served, subject to legal retention requirements.

9.4 Right to Withdraw Consent: Withdraw your consent at any time through the Privacy Center in App settings. Withdrawal does not affect lawfulness of prior processing.

9.5 Right to Nominate: Nominate an individual to exercise these rights on your behalf in case of death or incapacity as provided under DPDP Act 2023.

10. Children's Privacy

NiftyOracle is strictly for adult retail traders aged 18 and above. In compliance with Section 9 of the DPDP Act 2023, We do not knowingly collect personal data from individuals under 18 years of age. If We discover a user is a minor, their account will be terminated immediately and all associated data purged without further notice.

11. Zero AI Disclosure

In adherence to SEBI transparency norms and the SEBI Research Analysts Third Amendment Regulations 2024, NiftyOracle explicitly discloses that the application uses ZERO Artificial Intelligence, Zero Machine Learning, and Zero Large Language Models anywhere in its entire system — including backend workers, scoring engine, and signal generation.

All market analysis signals — BULLISH, BEARISH, NEUTRAL — are generated entirely by a 100% deterministic White-Box algorithmic mathematical computation engine. All signals are based on verifiable static mathematical formulas applied to real market data. No probabilistic black-box AI model is used at any stage.

12. Algorithmic Processing Disclosure

The NiftyOracle proprietary engine processes 92 market factors across 7 categories using pure mathematical computation including:

•Put-Call Ratio calculated as total Put Open Interest divided by total Call Open Interest

•India VIX volatility normalization where values above 20 trigger elevated fear weighting

•FII and DII daily institutional flow aggregation for directional momentum scoring

•Technical indicators including RSI, MACD, Bollinger Bands, ADX, Supertrend, and Moving Averages combined into a weighted score

•9 dynamic market regime detection system that automatically adjusts factor weights based on current market conditions

This disclosure ensures users understand the purely mathematical and non-personalized nature of all outputs.

13. Market Data Disclaimer

Market data is sourced from licensed vendors including Angel One SmartAPI for NSE/NFO data, processed through our proprietary AWS Mumbai server infrastructure, Yahoo Finance for global market data, and FRED API for US economic data. All derived analytical outputs are calculated by NiftyOracle's proprietary mathematical engine and do not constitute redistribution of raw exchange data. Technical transmission may occasionally be subject to delays. All data is provided for informational purposes only. NiftyOracle and Dev Malkar are not responsible for any decisions made based on delayed, erroneous, or temporarily unavailable data.

14. Cookies and Local Storage

NiftyOracle uses local storage and secure session tokens solely to maintain your login state and verify premium subscription status. We do NOT use cookies for behavioral tracking, cross-site tracking, targeted advertising, or any purpose beyond essential app security functionality.

15. NSE and Third-Party Trademark Disclaimer

"Nifty 50," "Nifty Bank," and all associated index names are registered trademarks of NSE Indices Limited. NiftyOracle is an independent third-party application and is NOT affiliated with, endorsed by, or officially connected to NSE Indices Limited or National Stock Exchange of India Limited in any manner. The word "Nifty" is used solely in its descriptive capacity to indicate that the app analyzes the Nifty 50 index. Similarly, "Oracle" is used in its common English dictionary meaning. No trademark infringement is intended or claimed.

16. Changes to This Privacy Policy

We may update this Policy to remain compliant with evolving Indian laws or Google Play requirements. For material changes — such as new types of data collection — We will notify You via prominent in-app notification or email before the change takes effect. Continued use of the App after notification constitutes your acceptance of the updated Policy. All previous versions will be archived and available upon request.
