Terms and Conditions for
Mindful Speaker (Call Manager)

By downloading, installing, accessing, or using the "Mindful Speaker" mobile application (the "App"), also referred to in some package names and older documents as "Call Manager," you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must not use the App.

The App is owned and operated by Krishnam Raju Datla ("Owner," "we," "us," or "our").

1. Purpose of the App

Mindful Speaker is a personal productivity tool designed to track your call durations, bring awareness to the time spent on phone calls, and provide proactive alerts to help you limit call times and increase personal productivity. It is provided for informational and personal management purposes only.

Mindful Speaker does NOT record, listen to, intercept, or access your call audio in any way. The App only tracks call duration and state (ringing, active, idle) using standard platform APIs.

2. Eligibility and Age Requirements

You must be at least 16 years of age (or the minimum age of digital consent in your country, whichever is higher) to use Mindful Speaker, create an account, and make any in-app purchases or subscriptions. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract.

Region and Minimum Age Requirements:

• EU/EEA (GDPR): 16 (or as low as 13 in some member states)1

• United States (COPPA): 131

• India: 18 for purchases; 16 for general use1

• All other regions: 16 or local minimum, whichever is higher

3. User Accounts and Registration

To use Mindful Speaker, you are required to sign in with your Google account.

• Accuracy: You agree to provide accurate, current, and complete information during the registration process.

• Security: You are responsible for safeguarding your login credentials. You agree not to disclose your credentials to any third party and to take sole responsibility for any activities under your account, whether or not authorized by you.

• Notification: You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

• One Account Per User: Each Google account may be associated with one Mindful Speaker account.

4. In-App Purchases, Subscriptions, and Ads

Mindful Speaker is supported by advertisements and offers premium features through in-app purchases and auto-renewing subscriptions, available globally via the Google Play Store and Apple App Store.

4.1 Advertisements

The free version of the App displays third-party advertisements served by Google AdMob. We are not responsible for the content, products, or services offered by third-party advertisers. Ad-related data collection is governed by Google's Privacy Policy.

4.2 Subscriptions and Auto-Renewal

• Auto-Renewal: Premium subscriptions (monthly and annual plans) automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.

• Pricing: Subscription fees are displayed in your local currency at the time of purchase, as determined by the respective app store.

• Billing: Payment is charged to your designated payment method (e.g., Google Play or Apple App Store account) at confirmation of purchase.

• Platform Dependency: All billing, payment processing, refunds, and subscription management are handled entirely by Google Play Store or Apple App Store. We do not directly process payments or refunds.

4.3 Cancellations and Refunds

• You may manage or cancel your subscriptions through your app store account settings (Google Play Store → Subscriptions, or Apple App Store → Subscriptions).

• Refunds are handled exclusively in accordance with the policies of the respective app store where the purchase was made.

• We do not directly process refunds. Please contact Google Play Support or Apple Support for refund requests.

4.4 Free Trial

If a free trial is offered, it will convert to a paid subscription at the end of the trial period unless canceled at least 24 hours before the trial expires. Unused portions of any free trial are forfeited upon purchasing a subscription.

5. No Call Recording Disclaimer

Mindful Speaker does NOT record, intercept, store, transcribe, or access the audio content of your phone calls. The App:

• Tracks only call state (ringing, active, idle) and call duration

• Does NOT require or use microphone access for call recording

• Uses text-to-speech (TTS) solely for timer voice announcements (e.g., "2 minutes remaining")

• Does NOT transmit any audio data to any server

The MODIFY_AUDIO_SETTINGS permission is used exclusively for adjusting TTS volume during active calls.

6. Data Handling and Privacy

6.1 Local-First Architecture

Mindful Speaker follows a **local-first design**. Your contacts, call history, and app settings are stored primarily on your device. Optional cloud features, analytics, crash reporting, consent handling, and ads are described in the Privacy Policy.

6.2 Optional Cloud Services

The following cloud services are used only when you explicitly opt in:

• Google Drive Backup: Your settings and call history can be backed up to your personal Google Drive using the `drive.file` scope.

• Other Backup Destinations: The app may also store backup archives in destinations you choose or configure, including OneDrive, Dropbox, iCloud Drive, WebDAV storage, or local export files.

• Cloud Sync: App settings can be synced across your devices via Firebase Firestore (stored under your unique user ID).

6.3 Analytics and Crash Reporting

We use Firebase Analytics and Firebase Crashlytics to collect usage telemetry, diagnostic data, and crash reports for improving app quality and stability. See the Privacy Policy for details about what is sent and how it is handled.

6.4 Third-Party Services

The App integrates the following third-party services, each with their own privacy policies:

• Google Firebase (Authentication, Analytics, Crashlytics, Remote Config, Firestore)

• Google AdMob / Google User Messaging Platform (Advertising and ad-consent handling)

• RevenueCat (Subscription management — anonymous user ID only)

• Google Sign-In (Authentication)

• User-selected backup providers such as Google Drive, OneDrive, Dropbox, iCloud Drive, or WebDAV storage when you choose to connect or use them

7. Acceptable Use and Prohibited Conduct

You agree to use Mindful Speaker only for its intended personal productivity purposes. You shall not:

• Use the App for any illegal or unauthorized purpose

• Attempt to reverse engineer, decompile, or hack the App

• Interfere with or disrupt the security, integrity, or performance of the App

• Use the App to harass, abuse, or harm another person

• Use the App to record, intercept, or eavesdrop on phone calls (the App does not provide such functionality)

• Circumvent any technical limitations or restrictions built into the App

8. Intellectual Property Rights

All intellectual property rights in the App, including but not limited to its design, code, algorithms, text, graphics, and logos, are the exclusive property of Krishnam Raju Datla. The App is licensed to you, not sold. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use, subject to these Terms

9. Disclaimer of Warranties

Mindful Speaker is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for accuracy, we do not warrant that:

• The call tracking times, alerts, or data provided by the App will be 100% accurate, uninterrupted, or error-free

• The App will be compatible with all devices, operating systems, or carrier configurations

• The App will function identically across all platforms (Android and iOS may have different capabilities due to platform restrictions)

Your use of the App is at your sole risk. We disclaim all warranties, express or implied, including fitness for a particular purpose.

Platform limitations: Call monitoring functionality depends on operating system permissions and restrictions. iOS imposes additional restrictions on background call monitoring compared to Android. VoIP call detection (WhatsApp, Telegram, Signal, etc.) relies on notification access and may not be available on all devices or OS versions.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Krishnam Raju Datla be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

1. Your access to or use of, or inability to access or use, the App

2. Any conduct or content of any third party on the App

3. Any unauthorized access, use, or alteration of your transmissions or content

4. Inaccurate call duration tracking or timer notifications

5. Any action taken or not taken based on the App's data or alerts

Nothing in these Terms excludes or limits our liability for matters where liability cannot be excluded or limited under applicable law, including but not limited to fraud, gross negligence, or death/personal injury caused by our negligence.

11. Account Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms. Upon termination, your right to use the App will immediately cease.

Important: Termination of your account does NOT automatically cancel your premium subscription. You must separately cancel your subscription through your app store account settings.

12. Account and Data Deletion

You have the right to request deletion of your account and associated cloud data at any time. You can use the in-app deletion flow or refer to the Privacy Policy here:

Upon receiving your deletion request through the current in-app account flow:

• - Your Google Sign-In session used by the app will be disconnected

• - Your Firebase user account and authentication data will be deleted

• - Your cloud-synced settings (Firestore) will be erased

• - The app will attempt to delete the Google Drive backup folder and files it created, when that backup connection is available

• - Local on-device data remains on your device until you uninstall the app or clear app storage from your device settings

• - Backup copies you created in OneDrive, Dropbox, iCloud Drive, WebDAV storage, or local files may need to be deleted manually by you

• - Your premium subscription must still be cancelled separately through your app store account settings if you do not want future billing

The in-app deletion flow attempts removal immediately after successful re-authentication. Manual requests are generally processed within **7 business days**.

13. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect (via in-app notification or email). By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India (and specifically the State of Telangana, where applicable), without regard to its conflict of law provisions.

For users in the European Economic Area (EEA): Nothing in these Terms affects your rights as a consumer under mandatory consumer protection laws of your country of residence. You may bring legal proceedings in either the courts of India or the courts of your country of residence.

For users in the United States: Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, except where prohibited by law. You retain the right to bring claims in small claims court if eligible.

For all other regions: Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Hyderabad, Telangana, India, unless your local law requires otherwise.

15. International Use and Export Controls

Although the App is accessible worldwide via the Google Play Store and Apple App Store, we make no representation that the App or its features are appropriate or available for use in all locations. If you choose to access or use the App from outside India, you do so on your own initiative and are solely responsible for compliance with your local laws.

You agree to comply with all applicable export and re-export control laws and regulations as enforced by the platforms distributing the App.

16. Region-Specific Rights

16.1 European Economic Area (EEA) — GDPR

If you are located in the EEA, you have additional rights under the General Data Protection Regulation (GDPR), including the right to access, rectify, erase, restrict processing, data portability, and object to processing of your personal data. Our legal basis for processing data is your consent (for optional features) and legitimate interest (for core app functionality and analytics).

16.2 United States — CCPA / CPRA

If you are a California resident, you have the right to know what personal information we collect and how it is used, the right to delete your personal information, the right to opt out of the sale of personal information, and the right to non-discrimination for exercising your rights. We do not sell your personal information. See our Privacy Policy for details.

16.3 India — IT Act / DPDP Act

We aim to comply with applicable Indian data protection and information security obligations, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023 where applicable. Financial information related to subscriptions is handled by Google Play Store and Apple App Store, not by us directly.

16.4 Brazil — LGPD

If you are located in Brazil, you have rights under the Lei Geral de Proteção de Dados (LGPD), including confirmation of processing, access, correction, anonymization, portability, deletion, and revocation of consent.

16.5 Other Jurisdictions

We endeavor to comply with applicable data protection laws worldwide. If your local law provides additional rights not listed here, please contact us and we will accommodate your request to the extent required by law.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid under applicable law, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

18. Multilingual Content and Translation Disclaimer

Mindful Speaker strives to provide an inclusive, native-language experience for users worldwide. To that end, the App's user interface, notifications, and help content are made available in multiple languages using a combination of professional, community, and machine-assisted translation.

18.1 No Warranty of Translation Accuracy

**We make no warranty, express or implied, that any translation of the App's content into any language other than the original English is complete, accurate, free from error, or culturally appropriate for every regional dialect, community, or context.** Translation is an inherently imperfect process, and despite our best efforts:

- Words, phrases, or idioms may carry unintended connotations in certain regional dialects.

- Machine-assisted translations may contain grammatical errors or mistranslations.

- Cultural nuances may not be fully captured in automated or third-party translations.

- Localized text may differ in length, register, or tone from the original English.

18.2 Limitation of Liability for Translations

**To the fullest extent permitted by applicable law, we expressly disclaim all liability — including any liability for offense, reputational harm, emotional distress, cultural insensitivity, or any other damage of any kind — arising from errors, inaccuracies, omissions, or culturally inappropriate renderings in any translated version of the App's content.**

Use of the App in any language other than English constitutes your acknowledgment and acceptance that:

1. Translation quality may vary across languages and regions.

2. No translation shall be construed as a representation, warranty, or binding commitment by us.

3. In the event of any conflict, ambiguity, or inconsistency between a translated version and the English version of these Terms, the **English version shall prevail** in all respects.

18.3 Reporting Translation Issues

We genuinely care about providing respectful, accurate translations for all communities. If you believe any translated content in the App is inaccurate, misleading, or culturally offensive, we invite you to bring it to our attention at:

We will review all reported translation concerns in good faith and, following reasonable deliberation, make corrections at our sole discretion. Submission of a translation issue report does not create any obligation on our part to make any specific change, nor does it give rise to any claim or right of action against us.

18.4 Non-Waiver

Nothing in this Section 18 shall be read as encouraging or excusing content that is knowingly harmful, deliberately discriminatory, or intentionally offensive. Our disclaimer applies solely to **unintentional errors** arising from the inherent limitations of the translation process.
