1. Introduction and Scope

NEXTLINK PTY LTD (referred to as "we," "us," or "our") is a Software as a Service (SaaS) company operating a portfolio of mobile applications, games, and other digital services (collectively, the "Services"). This Privacy Policy applies to all Services published by NEXTLINK PTY LTD on platforms including, but not limited to, the Apple App Store and Google Play Store.

This page informs users ("you") regarding our policies for the collection, use, and disclosure of Personal Information if anyone decides to use our Services.

If you do not agree with any of these terms, you are prohibited from using or accessing the Service. The materials contained in the Service are protected by applicable copyright and trademark law.

Permission is granted to download a single copy of the Service per device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

This license shall automatically terminate if you violate any of these restrictions and may be terminated by NEXTLINK PTY LTD at any time. Upon termination, you must destroy any downloaded materials in your possession whether in electronic or printed format.

a. Disclaimer

The materials within the Service are provided on an ‘as is’ basis. NEXTLINK PTY LTD makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitations, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, NEXTLINK PTY LTD does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Service or otherwise relating to such materials or on any sites linked to the Service.

b. Limitations of Liability

In no event shall NEXTLINK PTY LTD or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Service, even if NEXTLINK PTY LTD or a NEXTLINK PTY LTD authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

4. Accuracy of Materials

The materials appearing in the Service could include technical, typographical, or photographic errors. NEXTLINK PTY LTD does not warrant that any of the materials on the Service are accurate, complete, or current. NEXTLINK PTY LTD may make changes to the materials contained in the Service at any time without notice. However, NEXTLINK PTY LTD does not make any commitment to update the materials.

5. Links to Third-Party Sites

NEXTLINK PTY LTD has not reviewed all of the sites linked to its app and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by NEXTLINK PTY LTD of the site. Use of any such linked website is at your own discretion.

6. Subscriptions and In-App Purchases

Our Services may offer subscriptions, in-app purchases, or other paid features. These transactions are subject to the terms and conditions of the respective App Store (Apple App Store or Google Play Store) and these Terms of Use. All sales are final unless otherwise required by law or the platform's policies. NEXTLINK PTY LTD reserves the right to change prices and availability of paid features at any time.

7. Platform-Specific Terms

a. iOS Apps (Apple App Store)

Your use of any Service obtained from the Apple App Store is subject to the Apple Licensed Application End User License Agreement (EULA). By downloading and using the Service, you agree to the terms and conditions of the Apple EULA, and for the purposes of that EULA, NEXTLINK PTY LTD is the "Application Provider." The terms of the Standard EULA are incorporated herein by reference, and you acknowledge and agree to the following sections in particular: Scope of License, Consent to Use of Data, Termination, External Services, NO WARRANTY, and Limitation of Liability.

b. Android Apps (Google Play Store)

Your use of any Service obtained from the Google Play Store is subject to the Google Play Terms of Service and the terms outlined herein.

8. Governing Law and Jurisdiction

These terms and conditions are governed by and construed in accordance with the laws of New South Wales, Australia (or your specified jurisdiction), and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
