Please read these Terms of Service ("Terms") carefully before using the NexSa AI mobile application ("NexSa", "the App", "our App") operated by NexSa AI ("we", "us", "our", "the Company").
By downloading, installing, or using NexSa AI, you ("User", "you", "your") agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
NexSa AI is a mobile phone assistant application that uses artificial intelligence to help users perform tasks on their Android devices. The App can view the screen, tap buttons, type text, scroll, navigate apps, search the web, compare prices, and assist with form filling through a floating bubble interface.
NexSa AI is a tool that assists users. It does not replace human judgment, professional advice, or manual verification.
You must be at least 13 years of age to use NexSa AI. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you confirm that you meet these requirements.
NexSa AI does not require account creation. The App generates a random device identifier stored locally on your phone for service functionality and rate limiting. No personal account, email address, or password is required to use the App.
NexSa AI uses screen capture (MediaProjection) and Android Accessibility Services to view and interact with your device. When you give NexSa a task or ask a question:
a) NexSa captures a screenshot of your current screen.
b) The screenshot and your message are sent to third-party AI providers (such as OpenAI and Anthropic) via encrypted HTTPS connections for processing.
c) The AI provider analyses the screenshot and message, then returns instructions.
d) NexSa executes the instructions on your device (tapping, typing, scrolling).
By using NexSa AI, you acknowledge and consent to this process.
NexSa AI requires the following Android permissions to function:
a) Accessibility Service — to perform taps, types, scrolls, and read screen elements on your behalf.
b) Screen Capture (MediaProjection) — to take screenshots of your screen for AI analysis.
c) Display Over Other Apps (Overlay) — to show the floating bubble interface.
d) Internet Access — to communicate with AI providers and backend services.
These permissions are used solely for the purpose of providing the NexSa AI service. They are never used to collect, store, or share your personal data for advertising, marketing, or any purpose unrelated to the App's core functionality.
a) You are solely responsible for all tasks you instruct NexSa AI to perform.
b) You must review all actions before confirming. NexSa AI is designed to pause and ask for your confirmation before completing sensitive actions such as purchases, form submissions, payments, and account changes.
c) You are responsible for the accuracy and completeness of any personal data you enter into your NexSa profile (name, address, date of birth, and other details).
d) You must not use NexSa AI to perform any illegal, fraudulent, or harmful activities.
e) You must not use NexSa AI to access systems, accounts, or data that you do not have authorisation to access.
f) You must not attempt to reverse-engineer, decompile, or modify the NexSa AI application.
g) You are responsible for keeping your device secure. NexSa AI is not responsible if an unauthorised person uses your device and instructs NexSa to perform actions.
You agree not to use NexSa AI to:
a) Fill forms with false, misleading, or fraudulent information.
b) Impersonate another person or submit applications on behalf of others without their explicit consent.
c) Bypass security measures, CAPTCHAs, login systems, or verification processes on any website or app.
d) Perform automated mass actions such as spam, bulk form submissions, or denial-of-service activities.
e) Access, collect, or scrape personal data belonging to others.
f) Violate any applicable local, national, or international laws or regulations.
g) Interfere with or disrupt the NexSa AI service, servers, or networks.
h) Use the App to make purchases, send money, or complete financial transactions without your active review and manual confirmation.
a) NexSa AI uses third-party artificial intelligence models to interpret your screen and decide actions. AI technology is not perfect and may make errors.
b) NexSa AI may misread screen content, tap incorrect elements, type incorrect information, or misunderstand your instructions.
c) NexSa AI may not understand every app interface, website layout, or language variation.
d) AI responses, recommendations, and actions should always be treated as suggestions, not guarantees.
e) You must always review the actions NexSa AI has taken before confirming any final step, especially for form submissions, purchases, transactions, and sensitive operations.
f) NexSa AI is not responsible for errors, omissions, or incorrect actions performed by the AI.
a) NexSa AI may provide product comparisons, price information, seller reviews, and purchasing recommendations. This information is obtained through web searches and AI analysis at the time of your request.
b) Prices, availability, seller ratings, and product details change frequently. NexSa AI does not guarantee the accuracy, completeness, or timeliness of any shopping information provided.
c) NexSa AI is not a seller, retailer, or marketplace. It does not sell products or process transactions.
d) Any purchasing decision you make based on NexSa AI's recommendations is your sole responsibility.
e) NexSa AI is not responsible for any financial loss, overcharges, delivery issues, product quality problems, or disputes arising from purchases you make.
f) Coupon codes, discount information, and cashback suggestions provided by NexSa AI are not guaranteed to work and may expire at any time.
a) NexSa AI may assist with filling forms on websites and applications, including government portals.
b) NexSa AI fills forms using data from your saved profile and your verbal or typed instructions. You are solely responsible for verifying that all information entered is correct, complete, and truthful before submission.
c) NexSa AI will never submit a form without your explicit confirmation. The final submit action always requires your manual approval.
d) NexSa AI is not responsible for rejected applications, incorrect submissions, missed deadlines, penalties, or any consequences arising from information entered into forms, whether correct or incorrect.
e) NexSa AI is not affiliated with any government body, department, or agency. It is an independent tool that assists users in navigating publicly available websites and portals.
f) NexSa AI does not guarantee the success of any application, form submission, or registration process.
a) NexSa AI is designed to NEVER complete financial transactions on your behalf. The App will always pause and ask for your confirmation before any payment, purchase, or money transfer action.
b) NexSa AI will never enter passwords, OTPs, PINs, CVV numbers, CAPTCHA codes, or other security credentials.
c) NexSa AI does not provide financial advice, investment recommendations, tax advice, or banking guidance.
d) NexSa AI is not responsible for any unauthorised transactions, financial losses, or payment errors that may occur while using the App.
e) You should never use NexSa AI while banking apps or financial dashboards displaying sensitive account information are visible on screen.
a) NexSa AI does not provide medical advice, diagnosis, or treatment recommendations.
b) NexSa AI does not provide legal advice, legal representation, or legal interpretation.
c) Any health-related or legal information provided by NexSa AI is for general informational purposes only and should not be relied upon as professional advice.
d) Always consult a qualified medical professional or legal advisor for health or legal matters.

b) Screenshots of your screen are sent to third-party AI providers (OpenAI and Anthropic) for processing via encrypted HTTPS connections. These screenshots are processed in real-time and are not stored on our servers.
c) Your profile data (name, address, date of birth, and other personal details) is stored locally on your device only. It is not uploaded to our servers.
d) We do not sell, share, or distribute your personal data to advertisers or third parties.
e) We do not control how third-party AI providers (OpenAI, Anthropic) handle data sent to their APIs. Please refer to their respective privacy policies for more information.
f) NexSa AI does not access your photos, contacts, SMS messages, call logs, or any data beyond what is visible on your screen at the time of use.
a) NexSa AI relies on third-party AI providers (including but not limited to OpenAI and Anthropic) for artificial intelligence processing. We are not responsible for the availability, accuracy, or performance of these third-party services.
b) NexSa AI may interact with third-party apps and websites on your device at your instruction. We are not affiliated with and do not control these third-party apps and websites.
c) We are not responsible for the terms, policies, content, or actions of any third-party app or website that NexSa AI interacts with on your behalf.
d) NexSa AI is not responsible for data processed, stored, or handled by third-party AI providers. Please refer to their privacy policies:

a) NexSa AI depends on internet connectivity and third-party AI services. The App may not function during network outages or when AI provider services are unavailable.
b) We reserve the right to limit the number of daily requests per device to ensure fair usage and service quality.
c) We reserve the right to modify, suspend, or discontinue the NexSa AI service at any time, with or without notice.
d) We reserve the right to limit or terminate access to users who violate these Terms or abuse the service.
e) NexSa AI is provided on an "as available" basis. We do not guarantee uninterrupted or error-free service.
a) NexSa AI, including its design, code, branding, logos, and content, is the intellectual property of NexSa AI and is protected by applicable copyright and intellectual property laws.
b) You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.
c) You may not copy, modify, distribute, sell, or create derivative works based on NexSa AI without our written permission.
NexSa AI is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, whether express, implied, or statutory.
We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
a) The App will meet your specific requirements.
b) The App will be uninterrupted, timely, secure, or error-free.
c) The AI will always produce accurate, complete, or reliable results.
d) Any errors in the App will be corrected.
e) The App will be compatible with all devices, operating systems, or apps.
To the maximum extent permitted by applicable law:
a) NexSa AI, its developers, owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
b) This includes but is not limited to damages arising from: errors in AI actions, incorrect form submissions, financial losses, rejected applications, missed deadlines, data loss, device damage, unauthorised access, or any other consequences of using the App.
c) NexSa AI is not responsible for any damages, losses, or errors caused by using the App, whether or not we were advised of the possibility of such damages.
d) Our total liability to you for all claims arising from the use of the App shall not exceed the amount you paid for the App (which is zero for the free version).
e) You agree to use NexSa AI at your own risk. You are solely responsible for any consequences arising from your use of the App.
You agree to indemnify, defend, and hold harmless NexSa AI, its developers, owners, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:
a) Your use or misuse of the App.
b) Your violation of these Terms.
c) Your violation of any applicable law or regulation.
d) Any form, application, or submission made using the App.
e) Any content or data you provide to or through the App.
a) We reserve the right to modify these Terms at any time. Updated Terms will be posted within the App or on our website.
b) Your continued use of NexSa AI after any changes constitutes your acceptance of the updated Terms.
c) We recommend reviewing these Terms periodically for any changes.
a) These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, where the developer of NexSa AI is based.
b) NexSa AI is available to users worldwide. By using the App, you agree that any disputes arising from these Terms shall first be attempted to be resolved through informal negotiation by contacting us at nexsaai23@gmail.com.
c) If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of the United Kingdom. However, this does not prevent you from exercising any consumer protection rights available to you under the mandatory laws of your country of residence.
d) For users in India: NexSa AI complies with the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023 (DPDPA) to the extent applicable. Indian users may also have rights under the Consumer Protection Act, 2019. Any disputes specific to Indian law may be resolved under Indian jurisdiction if required by applicable Indian law.
e) For users in the European Union and United Kingdom: You may have additional rights under GDPR (General Data Protection Regulation) and local consumer protection laws. Nothing in these Terms limits your statutory rights under applicable EU or UK consumer protection legislation.
f) For users in all other countries: You are responsible for ensuring that your use of NexSa AI complies with all applicable local, regional, and national laws and regulations in your jurisdiction. NexSa AI is not responsible for your compliance with local laws.
g) If any part of these Terms conflicts with mandatory local laws in your jurisdiction, those local laws shall prevail to the extent of the conflict, and the remaining provisions of these Terms shall continue in full force.
h) NexSa AI makes no representation that the App is appropriate or available for use in all locations. Users who access the App from jurisdictions where the content or use is illegal are responsible for compliance with local laws.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NexSa AI regarding your use of the App and supersede any prior agreements or communications.
