URBAN RENEWAL AND STRATA SCHEME TERMINATION: A PROPOSAL FOR EN BLOC SALE: THE MALAYSIAN APPROACH

ABSTRACT
Strata scheme development has proliferated in Malaysia as a response to the Fourth Malaysia Plan in optimizing land use and improving society standard of living. Recently the need for urban renewal is become more crucial because of the rapid growth of urban development in high-density cities. To sustain the land source in metropolitan cities, the state authority needs to work doubly hard to managed and control the development in the urban area. One of the approaches implemented in Singapore is to terminate old strata building by using En Bloc Sale method. Strata scheme involving multiple owners will be difficult to terminate using existing provision under Strata Title Act 1985 that requires unanimous consent from the owner. Hence, En Bloc Sale is seen as an initiative of strata scheme termination to promote redevelopment in urban areas. This research aimed to examine the potential implementation of En Bloc Sale in Malaysia. Matters discussed in this study included the legal framework of En Bloc Sale applies for the interested developer based on Singapore implementation and also to study economic motivation underpinning developer's decision in En Bloc Sale. To achieve the objectives of the study, the interview method is conducted to produce a qualitative analysis that will describe the idea and argument of the respondents, where its conclusion will support to achieve each objective. At the end of the study, it can conclude that En Bloc Sale has the potential implementations in Malaysia, thus, researcher has proposed En Bloc Sale Model in Malaysian Approach based on the respondent's recommendation.
