THE REGULATORY AND ADMINISTRATIVE CHALLENGES ASSOCIATED TO THE PARTIAL CERTIFICATE OF COMPLETION AND COMPLIANCE (PARTIAL CCC) IN MIXED-DEVELOPMENT PROPERTY

ABSTRACT
The mechanism of Partial Certificate of Completion and Compliance (Partial CCC) within Malaysia's building certification framework has raised significant concerns, particularly for housing and development stakeholders. Issues such as safety and health risks, property abandonment, and complications regarding the legal delivery of properties have been publicly recorded. Notably, the Housing Development Act (HDA) mandates that Vacant Possession (VP) may only be granted following the issuance of a full CCC, not a Partial CCC. This study investigates the relevance of Partial CCCs in building certification, with a specific focus on mixed-use development property – residential and commercial elements, where phased completions are common. Adopting a qualitative approach, the research involved in-depth interviews with key players such as the construction stakeholders, house buyers, local authorities and relevant government bodies to identify the quandaries related to Partial CCCs. Key issues include lapses in professional integrity, inadequate regulatory guidelines, buyers' rights violations, safety and health risks, limitations in local authority enforcement, developer mismanagement, and financial constraints. These challenges highlight systemic vulnerabilities in the current housing regulatory framework. The study proposes several recommendations to address these issues, including amending the HDA, strengthening monitoring and enforcement, improving project management practices, and refining the Partial CCC guideline. The study seeks to propose strengthening the housing regulatory framework, specifically the mechanism of Partial CCC, to address the challenges for housing in mixed-development property in Malaysia.
