Welcome to MyUtsav (“Platform,” “we,” “our,” or “us”). MyUtsav is a community platform designed to connect individuals with local Mandals (community organisations) and enable discovery of cultural, religious, social, and sporting events across India. The Platform is developed and operated by Charvi Digital Solutions, a registered Micro Enterprise under the Ministry of Micro, Small and Medium Enterprises, Government of India.

Please read these Terms and Conditions (“Terms”) carefully before downloading, accessing, or using the MyUtsav mobile application. By creating an account or using any part of the Platform, you confirm that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, and any other policies referenced herein.

If you do not agree with any part of these Terms, you must immediately discontinue your use of the Platform.

1. Eligibility

1.1 Age Requirement

The MyUtsav Platform is intended for individuals who are 18 years of age or older. By registering an account, you confirm that you meet this age requirement. If we discover that a user is under the age of 18, we reserve the right to immediately suspend or permanently delete their account without prior notice.

1.2 Legal Capacity

By agreeing to these Terms, you represent and warrant that:

•        You are a natural person with the legal capacity to enter into a binding agreement under the laws of India.

•        You are not barred from using the Platform under any applicable law.

•        All registration information you submit is truthful, accurate, and complete.

1.3 Account Registration

You must register for an account to access the Platform's core features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at myutsav21@gmail.com of any unauthorised use of your account.

2. User Roles and Responsibilities

The MyUtsav Platform supports the following user roles, each with distinct rights and responsibilities:

2.1 Individual User

An Individual User is a person who registers on the Platform to discover and participate in community events and Mandals.

Rights:

•        Browse public events and Mandal profiles

•        Request membership in one or more Mandals

•        Register for public and members-only events

•        Submit spam or abuse reports

Responsibilities:

•        Provide accurate personal information during registration

•        Maintain respectful conduct when interacting with Mandals and other users

•        Comply with the specific rules of any Mandal you join

2.2 Mandal Administrator

A Mandal Administrator is a user who registers and manages a Mandal on the Platform. Mandal registration is subject to approval by the MyUtsav Super Administrator.

Rights:

•        Create, edit, and manage the Mandal's profile and events

•        Approve or reject member join requests

•        Assign roles to approved Mandal members

•        Post Mandal-specific content and announcements

Responsibilities:

•        Ensure all event information published on the Platform is accurate, truthful, and not misleading

•        Manage member data responsibly and in accordance with applicable privacy laws including the Digital Personal Data Protection Act, 2023

•        Ensure events listed are legal, safe, and compliant with local regulations

•        Promptly update or remove event listings that are cancelled or modified

•        Honour any prizes or commitments advertised for competitions hosted through the Platform

2.3 Super Administrator

The Super Administrator is MyUtsav's internal platform operator who oversees the overall integrity of the Platform, including approving Mandal registrations, moderating content, and managing user accounts.

3. Platform Use and Acceptable Conduct

3.1 Permitted Use

You may use the MyUtsav Platform solely for lawful personal and community purposes in accordance with these Terms.

3.2 Prohibited Conduct

You agree NOT to use the Platform to:

•        Post, share, or transmit any content that is false, misleading, defamatory, obscene, hateful, sexually explicit, or promotes violence or discrimination based on religion, caste, gender, ethnicity, or any other protected characteristic.

•        Impersonate any person or organisation, or misrepresent your affiliation with any entity.

•        Collect or harvest any personally identifiable information of other users without their explicit consent.

•        Publish or distribute spam, unsolicited promotional material, or malicious software.

•        Attempt to gain unauthorised access to any part of the Platform, other users' accounts, or our server infrastructure.

•        Use the Platform for any commercial advertising or solicitation without our prior written consent.

•        Engage in any conduct that disrupts, damages, or impairs the normal functioning of the Platform.

•        Violate any applicable local, state, national, or international law or regulation in connection with your use of the Platform.

3.3 Push Notification Consent

By using the Platform, you consent to receiving push notifications for membership updates, event reminders, event cancellations, and community announcements. You may opt out of push notifications at any time through your device settings. Disabling push notifications will not affect your core access to the Platform.

3.4 Content Reporting

You may report Events or Mandal profiles that you believe violate these Terms using the in-app reporting feature. MyUtsav will review all reported content and take appropriate action at our sole discretion, which may include removal of content or suspension of accounts. We do not guarantee that action will be taken on every report submitted.

4. Mandal Registration and Management

4.1 Registration Approval

Mandal registration on the MyUtsav Platform is subject to review and approval by our Super Administrator. We reserve the right to reject any Mandal registration application without providing a reason. Approval of a Mandal does not constitute endorsement of that Mandal's activities or values by MyUtsav.

4.2 Mandal Administrator Obligations

As a Mandal Administrator, you confirm that you are duly authorised to represent the Mandal on this Platform. You are solely responsible for the accuracy and legality of all content posted under your Mandal's profile. You are responsible for handling member data collected through the Platform in accordance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023.

4.3 Suspension and Removal

MyUtsav reserves the right to suspend or permanently remove any Mandal from the Platform for violations of these Terms, receipt of multiple verified user complaints, or any conduct deemed harmful to the community, without prior notice and without liability.

5. Events and Event Registration

5.1 Event Listings

Events listed on the MyUtsav Platform are created and managed entirely by Mandal Administrators. MyUtsav acts solely as a technology intermediary and does not independently verify, endorse, or take responsibility for the accuracy, legality, or safety of any event listed on the Platform.

5.2 User Participation

When you register for or attend an event listed on MyUtsav, you acknowledge that your participation is entirely at your own risk, that the Mandal or event organiser — not MyUtsav — is responsible for the conduct, safety, and logistics of the event, and that MyUtsav bears no responsibility for any injury, loss, damage, or disappointment arising from your participation.

5.3 Event Registration Fees

Where an event requires a paid registration fee, you acknowledge that the fee is collected by the Mandal organiser, not by MyUtsav. MyUtsav does not process or hold event registration payments at this time. Payment arrangements, refunds, and disputes are entirely between you and the Mandal organiser. MyUtsav accepts no liability for payments made in connection with events listed on the Platform.

5.4 Event Cancellations

If an event is cancelled by the Mandal organiser, the Platform will send a notification to registered attendees where possible. MyUtsav does not guarantee notification delivery and bears no responsibility for any losses incurred due to event cancellations.

6. Mandal Membership

6.1 Joining a Mandal

Membership in a Mandal on the Platform is subject to approval by the Mandal Administrator. Submitting a join request does not guarantee membership. The Mandal Administrator may approve, reject, or cancel your membership at their discretion.

6.2 Member Conduct

As a Mandal member, you agree to abide by any additional rules or codes of conduct established by the Mandal Administrator. Failure to do so may result in your removal from the Mandal by the Administrator.

6.3 Membership Termination

Your membership in a Mandal may be terminated at any time by the Mandal Administrator. MyUtsav is not responsible for and does not mediate disputes between members and Mandal Administrators regarding membership decisions.

7. Future Subscription Plans

MyUtsav plans to introduce optional, paid subscription plans for Mandal Administrators in a future release. These plans will offer enhanced features for community management and event promotion. Detailed terms governing subscriptions, billing cycles, auto-renewal, cancellation, and refund policies will be provided at the time of launch and will form an addendum to these Terms. No subscription fees are currently charged on the Platform.

8. Future In-App Advertising

MyUtsav may introduce in-app advertising in a future release to support the Platform's sustainability and continued development. If and when advertising is introduced, we will update these Terms and our Privacy Policy to reflect the relevant practices. Advertisements will be clearly labelled, and you will be provided with appropriate notice and consent mechanisms before any advertising is activated. MyUtsav will not permit advertising content that is misleading, harmful, or contrary to Indian law.

9. Intellectual Property

9.1 Platform Ownership

The MyUtsav name, logo, tagline (“Where Community Celebrates”), application design, interface elements, source code, and all associated proprietary technology are the exclusive intellectual property of Charvi Digital Solutions and are protected under applicable Indian and international intellectual property laws. You are strictly prohibited from copying, reproducing, distributing, or creating derivative works from any part of the Platform without our prior written consent.

9.2 User Content

You retain ownership of all content you upload to the Platform, including profile photos, Mandal logos, and event banners. By uploading content, you grant MyUtsav a non-exclusive, royalty-free, worldwide, sub-licensable licence to use, display, reproduce, and distribute such content solely for the purposes of operating, promoting, and improving the Platform. You warrant that any content you upload does not infringe on the intellectual property rights, privacy rights, or any other rights of any third party.

9.3 Prohibited Reproduction

You may not use any MyUtsav name, logo, or brand assets in any manner that suggests endorsement or association with MyUtsav without our explicit written permission.

10. MyUtsav as an Intermediary — Safe Harbour

MyUtsav operates as a technology intermediary platform as defined under the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

10.1 Role of MyUtsav

MyUtsav does not create, generate, own, or endorse any event listing, Mandal profile, or user-generated content on the Platform. All content is published by independent third-party users — Mandal Administrators and Individual Users.

10.2 Safe Harbour Protection

MyUtsav shall not be liable for any third-party content, information, or communications transmitted through the Platform, provided that we did not originate the content, did not select or modify the content, and act expeditiously to remove or disable access to content upon receiving actual knowledge of its unlawful nature.

10.3 Takedown Requests

If you believe any content on the Platform violates your legal rights or applicable law, please submit a written complaint to myutsav21@gmail.com. We will review and respond to all valid takedown requests within the timelines prescribed by applicable law.

11. Limitation of Liability

To the maximum extent permitted under applicable Indian law, MyUtsav, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the Platform. In no event shall our aggregate liability to you for any claim arising out of these Terms exceed the amount paid by you to MyUtsav in the three (3) months immediately preceding the claim, or INR 1,000 (Indian Rupees One Thousand), whichever is lower. We do not guarantee uninterrupted, error-free, or completely secure access to the Platform at all times.

12. Indemnification

You agree to indemnify, defend, and hold harmless Charvi Digital Solutions, its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to your use of the Platform in violation of these Terms, any content you post, upload, or transmit through the Platform, your violation of any applicable law or third-party rights, or any dispute between you and another user or Mandal.

13. Disclaimer of Warranties

The MyUtsav Platform is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be free of viruses or other harmful components.

14. Force Majeure

Charvi Digital Solutions shall not be held liable for any failure or delay in the performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government orders or regulations, strikes, pandemics, internet outages, power failures, or the failure of third-party service providers including Google Firebase, Google Maps, or payment gateway partners. In such events, our obligations shall be suspended for the duration of the force majeure event.

15. App Store Compliance

When you download the MyUtsav App from the Google Play Store or Apple App Store, additional terms imposed by those platforms may apply. Those platform-specific terms are supplementary to and do not replace these Terms and Conditions. In the event of a conflict between these Terms and the platform-specific terms, these Terms shall prevail to the extent permitted by law.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.

16.2 Amicable Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform, the parties shall first attempt to resolve the matter amicably through good faith negotiation within thirty (30) days of written notice.

16.3 Arbitration

If the dispute is not resolved amicably, either party may refer the dispute to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator mutually agreed upon by both parties. The seat and venue of arbitration shall be Mumbai, Maharashtra, India, and all proceedings shall be conducted in the English language.

16.4 Jurisdiction

Without prejudice to the arbitration clause above, the courts located in Mumbai, Maharashtra, India, shall have exclusive jurisdiction over any matter that is not subject to arbitration under these Terms.

17. Modifications to These Terms

MyUtsav reserves the right to update or modify these Terms at any time. We will notify you of any material changes by updating the 'Last Updated' date at the top of this document and, where appropriate, by sending an in-app notification. Your continued use of the Platform after any revised Terms take effect constitutes your acceptance of the new Terms. If you do not agree with the revised Terms, you must stop using the Platform immediately.

18. Termination

MyUtsav reserves the right to suspend or permanently terminate your access to the Platform at any time, with or without notice, for breach of these Terms or our Privacy Policy, conduct that is harmful, abusive, or illegal, repeated complaints from other users or Mandal Administrators, or any other reason that MyUtsav, in its sole discretion, determines warrants termination.

Upon termination, your right to use the Platform immediately ceases. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) shall continue to apply.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.

20. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or guidelines posted on the Platform, constitute the entire agreement between you and Charvi Digital Solutions with respect to your use of the Platform and supersede all prior agreements, understandings, and representations between the parties.
