1. Introduction

These Terms of Service (“Terms”) govern your use of MyLife | Memory (“the App”), developed and operated by GSDSI (“GSDSI”, “we”, “our”, or “us”).

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree with these Terms, you should not use the App.

The App is designed to help users and authorized caregivers organize reminders, contacts, location-based safety features, and other support functions.

2. Eligibility

You may use the App only if you are legally permitted to enter into these Terms under the laws applicable to you.

If the App is used on behalf of another person, including a person receiving care or assistance, you confirm that you have the appropriate authority or permission to use the App and manage information on their behalf.

3. App Purpose and Limitations

MyLife | Memory is a support and organizational tool.

The App is not a medical device, medical service, emergency response service, or substitute for professional medical care.

The App does not diagnose, treat, cure, or prevent any medical condition.

Information, reminders, alerts, location features, and other functionality provided by the App should not be relied upon as the sole means of ensuring a person's health or safety.

In an emergency, users should contact the appropriate local emergency services.

4. Safety Features

The App may provide features such as:

• SOS or safety alerts

• Location sharing

• “Where am I” functionality

• Medication or health-related reminders

• Emergency contacts

• Caregiver access

• Notifications and reminders

These features depend on device permissions, network connectivity, device availability, operating system functionality, and other technical factors.

We do not guarantee that an alert, notification, location update, reminder, or other safety feature will always be delivered, displayed, accurate, or available.

You should maintain appropriate alternative safety and emergency arrangements where necessary.

5. Location Services

Certain App features may require access to your device's location.

You control location permissions through your device settings. If location permission is disabled, some App functionality may not work correctly.

Location information may be shared with authorized caregivers or contacts when you enable the relevant functionality.

You are responsible for ensuring that any person who receives your location information is someone you trust and are authorized to share it with.

6. Caregiver Use

The App may allow users to designate caregivers or trusted contacts.

If you add a caregiver or other person, you are responsible for:

• Providing accurate information

• Ensuring that you have permission to share information with that person

• Selecting appropriate and trusted individuals

• Reviewing and managing their access

• Removing access when it is no longer appropriate

Caregivers must use information obtained through the App responsibly and only for legitimate care, support, or safety purposes.

GSDSI is not responsible for how a caregiver or other authorized person uses information obtained through the App.

7. User Responsibilities

You agree to use the App lawfully and responsibly.

You must not:

• Use the App for unlawful purposes

• Provide intentionally false or misleading information

• Attempt to gain unauthorized access to another person's information

• Interfere with or disrupt the App or its infrastructure

• Reverse engineer, decompile, or attempt to extract the source code of the App except where permitted by applicable law

• Use the App to abuse, threaten, harass, or unlawfully monitor another person

• Use the App in a way that could reasonably create a safety risk

You are responsible for maintaining the accuracy of information you enter into the App.

8. Account and Device Security

Certain versions or features of the App may not require a traditional user account.

Where authentication or account functionality is provided, you are responsible for maintaining the security of your credentials and device.

You should not share authentication information with unauthorized persons.

You are responsible for activity performed through your account or device where such activity results from your failure to maintain appropriate security.

9. Notifications and Permissions

The App may request permissions for features such as:

• Location

• Notifications

• Contacts

• Photos

• Other device functionality required by specific features

You may refuse or revoke permissions through your device settings.

Some App features may become unavailable or limited when the required permissions are disabled.

10. Third-Party Services

The App may rely on third-party services, platforms, APIs, cloud infrastructure, mapping services, notification services, or other technologies.

Third-party services may be subject to their own terms and privacy policies.

GSDSI does not control third-party services and cannot guarantee their continued availability, accuracy, security, or performance.

11. Intellectual Property

The App, including its software, design, graphics, interface, text, logos, trademarks, and other content, is owned by or licensed to GSDSI and is protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended personal purposes.

You may not copy, modify, distribute, sell, sublicense, or create derivative works from the App except where expressly permitted by applicable law.

12. Availability and Updates

We may modify, update, suspend, or discontinue the App or any of its features at any time.

We may release updates to improve functionality, security, compatibility, or performance.

You are responsible for installing available updates where necessary for continued functionality.

We do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with every device or operating system.

13. Disclaimers

To the maximum extent permitted by applicable law, the App is provided on an “as is” and “as available” basis.

We do not guarantee that:

• The App will always be available

• Information provided through the App will always be accurate or complete

• Location information will always be accurate

• Notifications or alerts will always be delivered

• SOS or other safety features will always operate without interruption

• The App will meet every individual user's requirements

You acknowledge that mobile applications depend on devices, operating systems, internet connectivity, telecommunications networks, and third-party services that may be outside our control.

14. Limitation of Liability

To the maximum extent permitted by applicable law, GSDSI and its officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App.

This includes, where permitted by law, damages resulting from:

• Failure of notifications or alerts

• Inaccurate or unavailable location information

• Device or network failures

• Unauthorized access resulting from circumstances outside our reasonable control

• Reliance on reminders, alerts, or other App functionality

• Actions or omissions of caregivers or other authorized users

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless GSDSI and its affiliates, officers, employees, contractors, and service providers from claims, damages, liabilities, losses, and expenses arising from:

• Your violation of these Terms

• Your misuse of the App

• Your violation of another person's rights

• Your unauthorized sharing or use of personal information

16. Termination

You may stop using the App at any time and may uninstall it from your device.

We may suspend or terminate access to the App where reasonably necessary, including if you materially violate these Terms, misuse the App, or create a security or legal risk.

Upon termination, provisions that by their nature should continue to apply will remain in effect, including provisions concerning intellectual property, disclaimers, limitation of liability, and applicable law.

17. Privacy

Your use of the App is also subject to our Privacy Policy, which explains how personal data is collected, used, stored, and shared.

The Privacy Policy forms part of these Terms.

18. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may provide notice through the App or other appropriate means.

Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

19. Governing Law

These Terms are governed by the laws applicable to GSDSI, except where mandatory consumer protection or other laws in your country provide otherwise.

Nothing in these Terms limits any mandatory rights or protections available to consumers under applicable law.
