Welcome to myAqua (“we”, “our”, or “us”). These Terms of Use (“Terms”) govern your use of the myAqua mobile application (the “App”).

By using the App, you agree to these Terms.

1. Use of the App

myAqua is an aquarium tracking and assistant app that allows users to upload aquarium photos from their gallery or take photos using their device camera in order to receive aquarium-related analysis, insights, reminders, and care suggestions.

The App may help users monitor aquarium conditions, track aquarium maintenance, organize care routines, and receive general guidance based on visual input and user-provided information.

You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that any information, images, or content you provide through the App is accurate, lawful, and does not infringe the rights of any third party.

2. Subscriptions

The App offers auto-renewable subscriptions, such as weekly, monthly, or yearly plans.

Payment will be charged to your Apple ID account at confirmation of purchase.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

Your account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage or cancel your subscription in your App Store account settings.

All payments are processed by Apple. We do not collect or store your payment information.

3. User Content

You may upload, capture, create, or customize content within the App, including aquarium photos, aquarium names, notes, reminders, parameters, and other aquarium-related information.

You are responsible for the content you provide.

You agree not to upload or use unlawful, offensive, harmful, infringing, or misleading content.

Depending on the App’s features, uploaded or captured photos and related information may be processed in order to provide analysis, recommendations, tracking, or assistant features.

We do not claim ownership of your user-generated content. You retain all rights to the photos and information you provide.

By using the App, you grant us a limited permission to process your content solely for the purpose of operating, improving, and providing the App’s features.

4. Aquarium Analysis and Care Suggestions

myAqua may provide aquarium-related analysis, observations, reminders, and care suggestions based on photos uploaded from your gallery, photos taken with your camera, or information you enter into the App.

Any analysis or suggestion provided by the App is for informational and general guidance purposes only.

The App does not replace professional veterinary, aquatic specialist, or aquarium expert advice.

Aquarium conditions may vary depending on water chemistry, fish species, plant species, tank size, filtration, lighting, feeding, maintenance habits, and other factors that may not be fully visible or known to the App.

You are solely responsible for decisions related to your aquarium, fish, plants, equipment, water changes, medication, feeding, and maintenance.

We do not guarantee that the App’s analysis, recommendations, reminders, or insights will be complete, accurate, or suitable for every aquarium.

5. Camera and Photo Access

The App may request access to your device camera and photo library so you can take or upload aquarium photos.

Camera and photo access are used to provide App features such as aquarium image analysis, visual tracking, and aquarium care assistance.

You can manage camera and photo permissions through your device settings.

If you do not grant these permissions, some features of the App may not function properly.

6. Intellectual Property

All rights, title, and interest in the App, including its design, software, features, branding, text, graphics, and other materials, excluding user-generated content, remain the property of myAqua or its licensors.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of any part of the App, except where permitted by applicable law.

7. Disclaimer

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied.

We do not guarantee that the App will be uninterrupted, error-free, secure, accurate, or compatible with all devices, operating systems, cameras, or aquarium setups.

We do not guarantee that the App will detect every aquarium issue, identify every species, diagnose diseases, measure water quality, or prevent harm to fish, plants, or other aquatic life.

You should always use your own judgment and, when necessary, consult a qualified aquarium expert, veterinarian, or aquatic specialist.

8. Limitation of Liability

To the fullest extent permitted by law, myAqua shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App.

This includes, but is not limited to, any loss, damage, illness, injury, or death of fish, plants, corals, invertebrates, or other aquatic life, as well as damage to aquariums, equipment, property, or data.

Your use of the App is at your own risk.

9. Termination

We may suspend or terminate your access to the App if you violate these Terms or use the App in a way that may harm the App, other users, or third parties.

You may stop using the App at any time.

10. Changes to Terms

We may update these Terms from time to time. If we make changes, we may update the “Last updated” date above.

Your continued use of the App after the updated Terms become effective constitutes your acceptance of the updated Terms.

11. Apple Terms

These Terms are in addition to the Apple Media Services Terms and Conditions.

In case of conflict between these Terms and Apple’s applicable terms, Apple’s terms shall prevail where required.
