Terms of Service (ToS)

✷ General

1. The Terms of Service may be revised from time to time. Please review the Terms of Service when commissioning or using my works for any change or update.

2. Due to my schedule & health issues, delays are to be expected and may vary in duration. Please kindly put this into consideration before commissioning me.

3. Full payment is expected within 48 hours upon brief acceptance for all commission types, unless discussed otherwise for high-value orders. If payment is incomplete past due, the order is cancelled.

4. Your brief should include: Overall description of your commissioned character, notes to look out for (e.g. if the character has a small accessory) and visual references. Visual reference materials should be in high resolution, fully coloured and easy to understand. Please send your brief within 48 hours from your order confirmation.

5. I have the right to reject projects that I am unable to work on.

6. I may share work-in-progress (WIPs) of my designs and commissions on my social media platforms.

7. I do not accept sensitive and/or offensive names as credits in any work of mine. In case it happens, please provide an alternative name(s) to me.

8. Please do not do things that are not stated in these Terms of Service.

9. Please keep my personal information (including, but not limited to: full name, contact methods, payment information, and other sensitive information) confidential under any circumstances and situations. I will also keep you personal information confidential under any circumstances and situations.

✷ Deadline

1. Turnaround time (TAT): Default within 1~6 months. Actual deadline may vary.

2. Specified TATs will be given after I have read and confirmed the brief. If there is no specification, it is understood that the commission will take one month (30 days) to complete.

3. I do not accept projects with tight deadlines (<30d/1 commission).

4. If you have a specified deadline, it must be ≧90 days from the day an order is submitted.

✷ Communication

1. You can view my working schedule in the [Commission] page.

2. Please communicate in a respectful and patient manner.

3. After an order is submitted, it may take up to 3 days to be viewed and accepted. This period of time is not included in the TAT.

4. Enquiries will be answered on my working days. Sometimes, your messages may not be visible to me. In that case, please bump them and let me know via my other platforms if it does not work.

5. If no response or affirmation is heard in 3 days from when I sent questions regarding brief contents and materials, or the WIPs for approval or revision, I will assume that you leave it up to my judgement, and/or have approved the WIPs for the next stage and no more revision is needed.

6. If the commission has not reached the set deadline or if it is not labled as prioritised, please kindly refrain from notifying me.

✷ Commission — Overview 

1. Process: Order confirmation → Payment  → Sketch → Lining → Rendering → Completion & Delivery.

2. Client's approval of the work is needed for the [Sketch], [Lining] and [Rendering] stages before proceeding to their following stages.

3. You can only adjust your brief before the [Order confirmation] stage, so please pay extra attention when preparing one.

4. Revisions are available during the [Sketch] stage. The first two revisions will be done for free. After those two revisions, addition fees will be applied to the third revision onwards. This fee will be concluded and paid when the sketch is ready for lining. Revisions are only done without charge if those are by my mistakes and misunderstandings of the reference materials.

5. After receiving the end product, revisions are not acceptable unless those by my mistakes and misunderstandings of the references. You are not allowed to have it modified either by yourself or another artist.

✷ Commission — [Surprise me!] type

1. Process: Order confirmation → Payment → Work → Completion & Delivery.

2. There will be no communication during the [Work] stage.

3. You can only adjust your brief before the [Order confirmation] stage, so please pay extra attention when preparing one. You cannot specify the requirements you want for this type of commission.

4. Revisions are only done without charge if those are by my mistakes and misunderstandings of the reference materials.

5. After receiving the end product, revisions are not acceptable unless those by my mistakes and misunderstandings of the references. You are not allowed to have it modified either by yourself or another artist.

✷ Delivery

1. All delivered works and products are digital goods.

2. All adoptable, designs and commissions will be delivered as .PNG files via email.

3. Commissions are stored for 7 days max. After the aforementioned period, these may be deleted to free up storage. Please download your files as soon as possible.

5. After commission-related files and documents have been deleted, I will not accept any further requests for data recovery.

✷ Rights & Usage of Work

1. All designs and commissions are for personal use only, unless otherwise discussed.

2. I retain all ownership, intellectual property rights, copyrights and moral rights to all of my artworks, including but not limited to: display, advertising and redistribution.

3. As an artist and a service provider, I have the right to:

   • Use my creative works (including completed works and WIPs) for self-promotion;

   • Rescind the order and confiscate my works and designs should you violate any term with a possible no-refund penalty.

4. As clients and buyers, you are allowed to use the commissions for:

   • For personal purposes (i.e. profile displays, wallpapers) and/or freely upload the commissions to your social media platforms with proper crediting;

   • Personal printing (e.g. OC trading goods). The maximum quantity is 20 copies/type of goods. Please contact me in advance if you need to print more than 20 copies, or print for many different types of goods;

   • As references for other artworks you commission.

5. As clients and buyers, you are not allowed to use the commissions for:

   • Commercial purposes (i.e. monetised contents, merchandise), unless discussed otherwise;

   • Offensive & hateful contents;

   • AI model training and NFT, crypto.

   • If you violate any of the above terms, you may risk being blacklisted. Depending on severity, I may post a public PSA regarding the matter(s).

6. You are strongly encouraged to use the watermarked version provided along with your commission to upload and post in order to protect your commission as well as my work.

7. Publications using my work for personal purposes are required to credit my name and handle/username on the publication. For publications intended for commercial purposes/already holding a commercial license, agreements will be made on a case-by-case basis.

   • Examples: OC trading goods, non-profit printings for events.

   • Placement: Credits can be placed on the back of the publication (e.g. with polaroid/trading card/postcard/art print, credits can be placed on the back card, and if printing a magazine or artbook, credits will be placed in the section of the same name), or inserted into the corner of the picture without affecting the overall composition of the artwork;

   • The credits need to be clear, unobscured and large enough to be easily readable.

8. You are required to credit me as [reuriemydear] or [moss (mnphtlne)] when using and uploading your commissioned works to social media platforms. Claiming that the commissions are drawn by you is strictly prohibited.

   • Please contact me beforehand if you have printing needs for non-commercial events (in addition to the purposes listed above).

✷ Cancellation & Refund policy

1. All commissions are not cancellable and non-refundable after I start working. [Surprise me!] commissions are not cancellable and non-refundable after [Payment] stage. Requests for refunds on completed commissions will not be accepted.

2. Full refunds for orders are only eligible when initiated by me, or when I violate the ToS.

3. By cancelling a project, you forfeit all rights to the artwork, as well as WIPs and sketches related to and of that project, and allow all of them to be reused in my other products.

4. In the event that you commission me after a previously cancelled commission, your order's priority with be lowered and placed behind other clients for a set period of time. If the cancellation happens repeatedly, you will be added to my blacklist.

5.  If you issue a chargeback when either party has not violated the ToS, and/or when both parties are still involved in the process of either working on a commission or settling on a refund, or after you have approved and received the finished product, you risk having your commission cancelled, losing all rights to all products and commissions purchased, or being blacklisted.

Q: I forgot to include a certain detail in my brief, do I still have time to change?

A: You do, as long as it is not your turn yet. Once I begin working on your slot, depending on the commission type, you may or may no longer change it.

Q: What tools do you use for work?

A: Device: iPad Pro (11-inch) (4th gen.) & Apple Pencil (2nd gen.) / Apps: Procreate (main workspace), ibisPaint (misc.) / Brushes: Default and custom brushes.
