Mill Creek Cemetery By-Laws
It has been established that Mill Creek Primitive Baptist Cemetery is a private, family owned cemetery and only open to the descendants from the original families. Anyone married into one of the families must still be married at the time of death.
The bi-annual cemetery cleaning/meeting will be held on the 1st Saturday in May and the 4th Saturday in September at 9:00am in order for us to conduct any business. Amendment 5.10.14—The cemetery meeting/cleaning day for May was changed to 1st Saturday in May.
No one is to be buried at Mill Creek Cemetery without first contacting one of the directors as listed below for approval.
The Executive Directors of the cemetery are as listed:
Carolyn Murphy, Chairwoman
Roger Crews, Secretary
Wayne Crews, Treasurer
Denise Barnard, Reggie Canaday, Faye Farris, Roy Sikes, Johnny Hartley and Kim Rowe
Once a director vacates their position for any reason, another person will be appointed by the Directors, if possible, from the same family to take their place.
An internment fee of $100.00 will be required for each person buried at the Mill Creek Cemetery and will be collected by the funeral home. This fee amount will be reviewed yearly by the association in order to keep it current and up to date. Amendment 5.8.2010—A letter will be given to the family from the association when meeting with them for burial to let them know of the $100.00 burial fee.
A monument deposit of $100.00 will be required for each person buried here and will be collected by the funeral home. If a monument is erected within 90 days after burial, or you can show proof to one of the directors that one has been ordered, then the $100.00 deposit will be refunded, in full, to the responsible party once it has been erected. Once erected, a call to one of the directors for a refund will be your responsibility. If an extension is needed due to the monument company’s time table, the chairman or vice chairman must be notified for approval. After six months, if no marker has been placed, the association will erect a marker and the money will not be refunded.
Amendment 5.12.12: If you have a cemetery plot and are cremated, that person can be buried just like everyone else as long as the remains are in a container and the usual grave opening and monument deposit fees are paid with a head stone (monument) to follow.
Due to limited space, we request that only markers for burial plots be placed for mother, father and children up to 18 years of age.
Markers at grave sites may be flat or up to 48” in height. No tombstone or decoration shall exceed 48” in height per amendment to original by-laws as of 5.9.09.
Single tombstones should not exceed 40 inches in width. Double tombstones should not exceed 80 inches in width.
Coping, chains, fencing or rock/gravel of any type around graves will no longer be allowed.
There will be no permanent plants or trees planted in the cemetery per amendment added 5.7.16
If ever needed, the directors will ask for donations at the bi-annual meetings. Donations are accepted at any time.
Church building can be used for church services but only after interview and approval by the Board of Directors, in addition to being used as a community center for reunions, receptions and the like. Permission to be granted by the directors per amendment as of 5.9.09.
By-laws will be reviewed annually for any amendments.
The Mill Creek Cemetery Association, directors and committee members, cannot and will not assume any responsibility for any injuries or accidents on the premises.
